AN ORDINANCE AMENDING CHAPTER 15 OF THE FORT WORTH CITY CODE (1964), AS AMENDED, BY ADDING THERETO A NEW SECTION TO BE DESIGNATED AS SEC. 15-424, WHICH SHALL PROVIDE THAT WARNING SIGNALS CONSIST- ING OF ALTERNATING HIGH AND LOW AUDIO TONES SHALL BE USED BY THE FIRE DEPARTMENT OF THE CITY OF FORT WORTH ONLY AND BY NO OTHER INDIVIDUAL, ORGANIZATION BUSINESS, DEPARTMENT OR AGENCY; PROVIDING A' SEVER- ABILITY CLAUSE; REPEALING CONFLICTING ORDINANCES; MAKING THIS ORDINANCE CUMULATIVE OF EXISTING ORDI- NANCES; PROVIDING A PENALTY; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 15 of the Fort Worth City Code (1964) , as amended, be and the same is hereby amended by adding thereto a new section designated as Sec. 15-424, which section shall be and read as follows: Sec. 15-424. A continuing series of a high fre- quency audio tone and a low frequency audio tone, alternating instantaneously without intermediate frequencies are designated as an official emergency warning signal of the Fire Department of the City of Fort Worth. It shall be unlawful for any individual, or- ganization, business, department or agency, governmental or otherwise, other than the Fire Department of the City of Fort Worth, to utilize such a signal for any purpose what- ever within the City and corporate limits of the City of Fort Worth. SECTION 2. Should any section, clause or provision of this ordinance be declared by any court of competent jurisdiction to be uncon- stitutional, such decision shall not affect any other portions of this ordinance other than the section, clause or provision so declared to be unconstitutional. SECTION 3. That all portions of the Fort worth City Code (1964) , as amended, in direct conflict with this ordinance are here- by repealed, but this ordinance shall be and is hereby de- clared to be cumulative of all provisions of said Code not in direct conflict herewith. SECTION 4. That any person or the agent, servant or employee of any person who violates, disobeys, omits, neglects or refuses to comply with any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to ex- ceed Two Hundred Dollars ($200.00) for each violation hereof. SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publica- tion as required by law, and it is so ordained. The test conducted by the Fire Department indi- cates that a warning signal of this type is superior to sirens presently in use. However, in order for the proposed warning device to be most effective, it is necessary that use of this warning signal within the city limits of Fort Worth be limited to use by the City Fire Department. Conversion to the new warning device will be made over a period of time as new equipment is acquired or present sirens require extensive maintenance. Proposed Ordinance An ordinance has been prepared which designates a continuing series of high-low audio tones alternating instantaneously without intermediate frequencies, as the official emergency warning signal forthe Fort Worth Fire Department. The proposed ordinance makes it unlawful' for any individual organization, business, department or agency, governmental or otherwise, other than the Fort Worth Fire Department tc utilize such a signal for any purpose whatever within the city limits of Fort Worth. Enforcement of the ordinance is provided by a fine not to exceed $200 for each violation. Recommendation It is recommended that the City Council adopt the proposed ordinance establishing the use of alternating high-low audio tones as the official warning signal for the Fort Worth Fire Department and prohibiting its use by other individuals, organizations, or agencies.
