ORDINANCE NO.
AN ORDINANCE PROVIDING THAT THE DEDICATION TO A
t PORTION OF THE M. G. ELLIS ADDITION TO NORTH FORT
WORTH, BLACKS 185, 186, 187, 188 AND 189; LOTS
NUMBERED 1 TO 16 INCLUSIVE IN EACH OF SAID BLOCKS,
AND BLOCKS 190; 191, 192, 193 and 194, LOTS NUM-
BERED 1 to 24 INCLUSIVE IN 'EACH BLOCK, AND THE STREET
BETti'PEEN BLOCKS 185 AND 186, and BLOCK 193 AND 194,
BEGINNING AT THE SOUTH LINE OF SUCH BLOCKS 185 and
186, EXTENDING TO THE NORTH BOUNDARY LINE OF SUCH
BLOCKS 193 and 194, AND BETWEEN BLOCKS 186 and 187,
AND BLOCKS 192 and 193, BEGINNING AT THE SOUTH LINE
OF SUCH BLOCKS 186 and 187 AND EXTENDING TO THE NORTH
BOUNDARY LINES OF SUCH BLOCKS 192 AND 193, AND THE
STREET BETWEEN BLOCKS 187 and 188, AND BLOCKS 191

AND 185 AND 194, THE SAME APPEARING TO BE AN EXTEN-
SION TO THE EAST OF TWENTY-SEVENTH STREET, AND
BEGINNING AT A POINT ON THE LINES OF BLOCKS 189
AND 190 AND EXTENDINGTO A POINT ON THE LINES OF

ING THROUGH BLOCKS 189, 190, 188, 1910 187, 192,
186, 193, 194, and 185, IN THE CITY OF FORT WORTH,
TEXAS, BE ABANDONED, CLOSED AND VACATED, AND PRO-
VIDING FOR THE.REPEAL OF ALL ORDINANCES OR PORTIONS
OF ORDINANCES IN CONFLICT HEREWITH, AND ROVIDING
THAT THIS ORDINANCE BE IMMEDIATELY EFFECTIVE.
WHEREAS, on the llth day of February, 1890, M. G. Ellis
filed and had recorded in the records of the County Clerk's
office of Tarrant County his dedication of the M. G. Ellis
Addition to North Fort Worth, a part of which was Blocks 185,
186, 187, 188, 189, 190, 191, 192, 193, and 194, which said
blocks were in such dedication subdivided into lots, those in
Blocks 185, 186, 187, 188 and 189 being numbered from 1 to 16,
inclusive, and those in Blocks 190, 191, 192, 193, and 194 being
numbered from 1 to 24, inclusive; and on the plat in such dedi-
cation so filed as aforesaid there appeared to be a street
running between Blocks 185 and 186 and Blocks 193 and 1940
beginning at the south boundary line of such Blocks 185 and
186 and extending to the north boundary line of such Blocks
193 and 194; and between Blocks 186 and 187 and Blocks 192 and
193, beginning at the south boundary lines of such Blocks 186
and 187 and extending north to the north boundary lines of
such Blocks 192 and 193; and a street between Blocks 187 and
188 and Blocks 191 and 192, beginning at the south boundary
lines of such Blocks 187 and 188 and extending to the north
boundary lines of such Blocks 191 and 192; and a street be-
tween Blocks 188 and 189 and Blocks 190 and 191, beginning
at the south boundary lines of such Blocks 188 and 189 and
extending north to the north boundary lines of Blocks 190 and
191; and also a street running east and west between Blocks
189 and 190, 188 and 191, 187 and 192, 186 and 193, and 185 and
194, the same appearing to be an extension to the east of 27th
Street and beginning at a point on theAline9Cof Blocks 189

and 190" and extending to a point on the Aline of Blocks 185
and 194; and
WHEREAS, there also appeared on the map and plat of
such dedication various alleyways, to wit! one extending
through the middle of Block 189 and running from north to
south; another extending through the middle of Block 190 and
running from north to south; another extending through the
middle of Block 188 and running from north to south; another
extending through the middle of Block 191 and running from
north to south; another extending through the middle of Block
187 and running from north to south; another extending through
the middle of Block 192 and running from north to south;
another extending through the middle of Block 186 and running
from north to south; another extending through the middle of
Block 193 and running from north to south; another extending
through the middle of Block 194 and running from north to -
south; and another extending through the middle of Block 185
and running from north to south; and

WHEREAS, it appearing to the City Council of the City
of Fort worth, Texas, that none of the blocks above mentioned
by number in such M. G. Ellis Addition to North Fort worth,
Texas, have ever had any residences or buildings or improvements
placed upon the same as lots, nor have the same ever been used
as lots or blocks, but that the same have been since said year
,of 1890 and at all times since the filing of such plat, map
and dedication in acreage used as such, and that none of the
streets or alleys have ever been opened or used as streets or
alleys and that the same constitute and are a part, in large
measure, of the stockpens and yards of the Fort Worth Stock
Yards Company; and that all of the same which is not used as
stock pens and yards of such Fort worth Stock Yards Company
is the small portion of the same on which the line of the
Fort worth Belt Railway Company has been built and is now
maintained and the said Fort worth Belt Railway Company's
roundhouse and houses, shops, and the various switches and
turnouts of the same; that portion so occupied by the tracks,
switches, turnouts, roundhouses, shops, water and fuel stations,
and buildings of such Fort Worth Belt Railway Company being
land in bulk or acreage, but according to the said map, plat
and dedication of said blocks hereinbefore mentioned being
the east portion of Lots 1, 2, 3, 4, 5, 6, 7, and 8 of Block
186; the west portion of Lots 9, 10, 11, 12, 13, 14, 15, and
16 of Block 185 and the aforementioned unnamed street between
such blocks; and a portion of Lots A7 and 8 in such Block 185
and the major portion of the east and west street betwe U such.
Blocks 185 and 190; also a portion of Lots 1,2, 3, 4, 50A 190
18, 17, 16, 15, and 14 and all of Lots 20, 21, 22, 23, and 24
of Block 194j also all of such unnamed street between Blocks
185, 166, 194, and 193; also a portion of Lots 1, 2, 3, 4, 51
6, 7, 6, 9, 10, 11, and 12. in such Block 193; such portion so

used by such Fort Worth Belt Railway Company, however, belonging
to and being the property of the said Fort Worth Stock Yards
Company and leased by it to such Fort Worth Belt Railway Company;
and
WHEREAS, it appearing to the City Council of the City of
Fort Worth that the above described property was purchased by
the Fort Worth Stock Yards Company on or about the llth day of
May, A. D. 1895; that it has heretofore conveyed a portion of
Block 185 to Armour & Company, which such portion is described
as Lots 1, 2, 3, 4, 5, and a portion of Lots 6, 7, and 8, and
a portion off of the east ends of Lots 91 10, 11, 12, 13, 14,
15, and 16; all in such Block 185; and a portion of such un-
named street between Blocks 185 and 194; that such land so
conveyed to {armour & Company is yet owned by such Armour &
Company and used and occupied by them not as lots but as
acreage; tUat it appears from such map, plat and dedication
so oh file in the office of the County Clerk of Tarrant County
that the right-of-way of the Gulf, Colorado & Santa Fe Railway
Company is platted and that a portion of Lots3, 4, 5, 6, 7,
8, 9,^ 17, 16, 15, 14, and 13 of such Block 194 is in and a
part of the right-of-way of the Gulf, Colorado & Santa Fe
Railway Company; that in truth and in fact the said Gulf;
Colorado & Santa Fe Railway Company purchased as acreage such
right-of-way many years prior to the dedication of such addition
as aforesaid and has continuously and at all times since its
such purchase of such right-of-way and the building of its
line thereon operated its trains and maintained its tracks
on and along such right-of-Way. In the year 1895 the Chicago;
Rock Island & Gulf Railway Company built its line of railroad
to
along and across portions of Lots/ill and 12 of such Block 194;
and legally procured such right-of-way and has ever since the
building of its said line of railroad operated its trains and
maintained its tracks along and over such portions of such lots
as acreage and not as lots or blocks; and that immediately to

the north of Lots 13 and 12 in Block 190, of Lots 13 and 12 in
Block 191, of Lots 13 and 12 in Block 192, of Lots 13 and 12 in
Block 193, and of Lots 13 and 12 in Block 194 there appears on
said map, plat and dedication an open space between such north
line of such Lots and the south line of the M. C. Jobe Survey
of about 68 feet, such open space being conveyed to the Fort
Worth Stock Yards Company along with the other lands herein
described by general warranty deed and being yet owned by it
and used by it; that all of the land so owned by such Fort
Worth Stock Yards Company is now, and has been at all times
since it has so owned the same, under fence; and the land de-
scribed as belonging to Armour & Company is under a separate
fence and the rights-of-way of the aforementioned Gulf, Colorado
Manta Fe Railway Company and the Chicago, Rock Island & Gulf
Railway Company are likewise under fence, which said fences
have been maintained for a period of more than twenty years;
and
WHEREAS, it appearing to the City Council of the City
of Fort Worth, Texas, that such dedication insofar as subdivid-
ing such land into lots and blocks and the fixing of streets
and alleys along, over and upon the same has always been
ineffective and not in use, and because of said ineffective-
ness of such dedication and nonuser of such streets and alleys,
such streets and alleys should be closed; that the public
interest is not served by a continuation of such dedication,
and, in fact, such public interest will be served by the closing
of such streets and alleys above described, insofar only as the
aforementioned Blocks 185 to 194 inclusive are concerned, and
that it will serve a useful public purpose to so close said
streets and alleys, and that it is to the best interests of the
public that said streets and alleys be closed, abandoned and
vacated as public thoroughfares, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION I.
That that portion of streets running between Blocks 185
and 166, and Blocks 193 and 194, beginning at the south line of
such Blocks 185 and 186, and extending to the north boundary
line of such Blocks 193 and 194, and between Blocks 186 and 187..
and Blocks 192 and 193, beginning at the south boundary lines
of .such Blocks 186 and 187, and extending north to the north
boundary lines of such Blocks 192 and 193, and between Blocks
187 and 188 and Blocks 191 and 192, beginning at the south
lines of such Blocks 187 and 188, and extending north to the
north boundary lines of such Blocks 191 and 192, and between
Blocks 188 and 189, and Blocks 190 and 191, beginning at the
south boundary lines of such Blocks 188 and 189 and extending
north to the north boundary lines of Blocks 190 and 191, and
between Blocks 189 and 190, 188 and 191, 187 and 192, 186 and
193, and 185 and 194, the same appearing to be an extension
to the east of 27th Street, and beginning at a point on the -A-U-f'
lineg of Blocks 189 and 190, and extending to a point on the AJ411-
line of Blocks 185 and 194, all in M. G. Ellis Addition to
North Fort Worth, Texas, be and the same hereby are vacated,
closed and permanently abandoned as streets or public thorough-
fares of any kind or character.
SECTION II.
That that portion of the alleyways appearing on the
map and plat of such M. G. Ellis' dedication of M. G. Ellis
Addition to North Fort Worth, to wit, one extending through
the middle of Block 189 and running from north to south;
another extending through the middle of Block 190 and running
from north to south; another extending through the middle of
Bloc, 188 and running from north to south; another extending
through the middle of Block 191 and running from north to
south; another extending through the middle of Block 187
and running from north to south; another extending through
the middle of Block 192 and running from north to south;

another extending through the middle of Block 186 and running
from north to south; another extending through the middle of
Block 193 and running from north to south; another extending
through the middle of Block 194 and running from north to
south; and another extending through the middle of Block 185
and running from north to south, be and the same are hereby
vacated, closed and permanently abandoned as streets or alley-
ways or public thoroughfares of any kind or character.
SECTION III
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION IV
That this Ordinance shall take effect and be in full
force and effect from and after the date of its passage.
