AN ORDINANCE DECLARING CERTAIN FINDINGS: PROVIDING
FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF
729.83 ACRES (1.167 SQUARE MILES) OF LAND, MORE OR
LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND
ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH,
TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL
BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE
INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF
ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT
THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN
CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT I.N
DIRECT CONFLICT; PROVIDING FOR SEVERABILITY AND
NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of the City
of Fort. Worth, Texas, wherein all interested persons were provided
with an opportunity to be heard on the proposed annexation of the
territory hereinafter described, was held at the City Council
Chambers in the Municipal Office Building of Fort. Worth, Texas, on
the 22nd day of May, 1979, which date is not, more than twenty (20)
nor less than ten (10) days prior to the institution of annexation
proceedings; and
WHEREAS, notice of such public hearing was published prior
thereto in a newspaper having general circulation in the City of
Fort Worth, Texas, and in the hereinafter described territory on the
loth day of May, 1979, which date was not more than twenty (20) nor
less than ten (10) days prior to the date of the public hearing; and
WHEREAS, the population of the City of Fort. Worth, Texas, was
in excess of 367,000 inhabitants on January 1, 1963 and in excess of
400,000 inhabitants on January 1, 1979; and
WHEREAS, the corporate area of the City of Fort, Worth, Texas,
was 152.580 square miles on January 1, 1963 and was 243.779 square
miles on January 1, 1979; and
WHEREAS, the hereinafter described territory lies within the
exclusive extraterritorial jurisdiction of the City of Fort. Worth,
Texas; and
WHEREAS, the hereinafter described territory lies adjacent to
and adjoins the City of Fort Worth, Texas; and

WHEREAS, the hereinafter described territory contains 729.83
acres (1.167 square miles) of land, more or less;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That. the following described land and territory lying adjacent,
to and adjoining the City of Fort Worth, Texas, is hereby added to
and annexed to the City of Fort Worth, Texas, and said territory
hereinafter described shall hereafter be included within the
boundary limits of the City of Fort Worth, Texas, and the present
boundary limits of said City, at the various points contiguous to
the area hereinafter described, are altered and amended so as to
include said area within the corporate limits of the City of Fort.
Worth, Texas, r.o-wit:
Being a 729.83 acre tract of land out of the James Spillman
Survey, Abstract. No. 1377; the J. Watson Survey, Abstract No. 1666;
the Nathan Proctor Survey, Abstract. No. 1230; the John F. Heath
Survey, Abstract No. 641; Joseph A. Dunham Survey, Abstract. No. 409;
Mary E. Asberry Survey, Abstract. No. 49; and Jacob Wilcox Survey,
Abstract No. 1742; all situated in Tarrant County, said 729.83 acre
tract of land being more particularly described by metes and bounds
as follows:
BEGINNING at a point, said point. being 50 feet West, from the East
line of the James Spillman Survey and 50 feet. South from the
North line of the said James Spillman Survey, said point also
being located in the existing City limit line of the City of
Fort Worth, Tarrant. County, Texas;
THENCE South along and with a line 50 feet. West from and parallel to
the common survey line of the James Spillman and J. Watson
Surveys to a point which is the intersection point of a line
50 feet South of the North lines of the Rueben Burnett
Survey, Abstract No. 1922, the Jerry Burnett. Survey, Abstract
No. 1923, the D. M. Schultz Survey, Abstract No. 1941 and the
I. & G.N. RR Co. Survey, Abstract No. 832 produced West to a
point of intersection with said line;
THENCE East along and with the aforementioned line produced West a
distance of 50 feet to a point for corner in the common
survey line of the James Spillman and J. Watson Surveys;
THENCE South to a point which is 2,664.67 feet South of the North-
east corner of the J. Spillman Survey;
Thence S 27057' E leaving said survey line a distance of 589.38 feet
to a point, said point, being the beginning of a curve to the
left whose radius is 270 feet;

THENCE S 89046120" E a distance of 4,297.97 which is also in the
Fort Worth City limit line, said point being the beginning of
a non-tangent curve to the left whose radius is 1,264.80
feet, said point also being the northwest corner of the
intersection point of the West right-of-way line of Hulen
Street, a 128-foot public street, and the centerline of
Oakmont. Parkway, a 120-foot public street;
THENCE in a southeasterly direction along said non-tangent curve to
the left through a central angle of 02051'50" a distance of
60.02 feet to a point.;
THENCE N 8904612011 W along the said existing City of Fort Worth city
limit line and said centerline of Oakmont Parkway a distance
of 4,394.9 feet to a point, said point being the common
survey corner of the J. B. McDermott. Survey, Abstract No.
1063 and the J. F. Heath Survey, Abstract No. 641;
THENCE S 00012,48" W along the common survey line of the said J. F.
Heath Survey and the said J. B. McDermott Survey and the said
existing city limit line, a distance of 2,910.4 feet to a
point, said point being the northwest corner of Tract 1 of
the J. B. McDermott Survey;
THENCE South along and with the East line of Tract 1 of the J. B.
McDermott. Survey, 345.7 feet to the Southeast corner of Tract.
1 thereof;
THENCE East, along and with the South line of the J. B. McDermott
Survey to a point for corner at its intersection with the
East right-of-way line of the A.T. & S.F. RR;
THENCE Southwesterly, along and with the East right.-of-way line of
the A.T. & S.F. RR to a point for corner at its intersection

centerline also being the common city limit between the City
of Fort. Worth and the City of Benbrook, a distance of 3275.2
feet to a point. 50 feet. South from the North survey line of
the James Spillman Survey, Abstract No. 1377;
THENCE East along a line 50 feet South from and parallel to the
North survey line of the James Spillman Survey a distance of
2450.0 feet, and along the existing city limit line of the
City of Fort. Worth to the POINT OF BEGINNING and containing
729.83 acres of land.

SECTION 2.
That the above described territory is shown on Exhibit. Map A
which is attached hereto and expressly incorporated herein by
reference for the purpose of illustrating and depicting the loca-
tions of the hereinabove described territory.
SECTION 3.
That the above described territory and the area annexed shall
be part of the City of Fort Worth, Texas, and the property so added
hereby shall bear its pro rata part of the taxes levied by the City
of Fort. Worth, Texas, and the inhabitants thereof shall be entitled
to all of the rights and privileges of all the citizens and shall be
bound by the acts, ordinances, resolutions and regulations of the
City of Fort. Worth, Texas.
SECTION 4.
That thereafter the City Limit Line of Fort. Worth shall be:
A part of the James Spillman Survey, Abstract No. 1377; the J.
Watson Survey, Abstract No. 1666; the Nathan Proctor Survey,
Abstract. No. 1230; the John F. Heath Survey, Abstract No. 641;
Joseph A. Dunham Survey, Abstract. No. 409; and the Mary E. Asberry
Survey, Abstract No. 49; all situated in Tarrant County, and being
more particularly described by metes and bounds as follows:
BEGINNING at a point for corner in the present Fort Worth City Limit.
Line, which point for corner is the southeast corner of a
tract of land conveyed to E. G. Rall, Volume 481, Page 622,
Tarrant. County Deed Records;

Line, which is the intersection point of a line 50 feet south
of the North lines of the Reuben Burnett Survey, Abstract No.
1922, the Jerry Burnett, Survey, Abstract No. 1923, the D. M.
Schultz Survey, Abstract No. 1941 and the I. & G.N. RR Co.
Survey, Abstract No. 832 produced West to a point of
intersection with a line 50 feet West of the James Spillman
Survey, Abstract No. 1377 and John Watson Survey, Abstract
No. 1666 common survey line;
THENCE East along and with the aforementioned line produced West, a
distance of 50 feet to a point for corner in the common

SECTION 5.
That this ordinance shall and does amend every prior ordinance
in conflict, herewith, but as to all other ordinances or sections of
ordinances not in direct conflict , this ordinance shall be, and the
same is hereby made cumulative.
SECTION 6.
That it is hereby declared to be the intent of the City Council
that, the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 7.
That this ordinance shall be in full force and effect, from and
after the date of its passage on second reading as provided for in
Section 40 of Chapter XXVIII of the Charter of the City of Fort.
Worth and it is so ordained.
