HomeMy WebLinkAboutOrdinance 7515 ORDINANCE NO. _75 S AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF BYERS AVENUE IN THE 4700 BLOCK A LENGTH OF 100' AND A WIDTH OF 10' WEST FROM KENLEY STREET ADJACENT TO LOT 1-R, BLOCK 37, ARLINGTON HEIGHTS 1ST FILING TO THE CITY OF FORT WORTH; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS OR- DINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Byers Avenue in the 4700 Block a length of 100' and a width of 10' West from Kenley Street adjacent to Lot 1-R, Block 37, Arlington Heights 1st Filing to the City of Fort Worth be and the same is hereby vacated, abandoned and permanently closed as a right-of-way for street purposes. SECTION 2. That the fee to the land in the above described street right-of-way is hereby released and will revert to the ad- jacent owners as provided by law, SAVE AND EXCEPT that ease- ments are reserved therein for any and all existing utilities including utility lines. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. LLWILKS DAVIS 7/77 PZ-780 Byers Avenue V-76-60 1 or E YAAA, First Church of Christ Scientist, owner of Lot 1-R, Block 37, Arlington Heights 1st Filing, has requested that the City vacate the north 10 feet of 80 ft. right-of-way of Byers Avenue in the 4700 block a length of 100 ft. west from Kenley Street adjacent to Lot 1-R, Block 37, Arlington Heights 1st Filing. The subject right-of-way is vacant parkway containing utility lines. Other- wise, the right-of-way is unimproved. In this area, Byers Avenue has a 36 ft. pavement width centered in an 80 ft. right-of-way, leaving a 22 ft. parkway on the north side. The City Plan Commission has reviewed this request and recommends approval as submitted. A replat showing necessary easements has been submitted to the City Staff. Recommendation It is recommended that an ordinance be adopted vacating the subject right-of- way as requested.
