AN ORDINANCE GRANTING AN EXCEPTION TO FORT WORTH
CAB AND BAGGAGE COMPANY CONCERNING MAXIMUM RATES
CHARGEABLE UNDER SECTION 34-12, FORT WORTH CITY
CODE WHEN TRANSPORTING HIGH RISK PASSENGERS WITH
SPECIALIZED EQUIPMENT UNDER CONTRACT WITH GOVERN-
MENTAL AGENCIES AND PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth
heretofore on November 24, 1975, granted the Fort Worth Cab and
Baggage Company a privilege to use the streets, alleys and
public thoroughfares of the City in the conduct of its taxicab
.business for a period of 10 years commencing January 15, 1976,
by Ordinance No. 7265; and
WHEREAS, said Ordinance No. 7265 conditions the
Company's privilege therein granted upon continuing compliance
with all Federal, State and local laws and ordinances, includ-
ing Chapter 34, Code of the City of Fort Worth, Texas (1964) ,
as amended; and
WHEREAS, Section 34-12 of Chapter 34, Code of the City
of Fort Worth, Texas (1964) as amended, specifies the maximum
price to be charged by all taxicab operators in the City; and
WHEREAS, the Fort Worth Cab and Baggage Company has
made application for an exception to the fee schedule set forth
in Section 34-12 of Chapter 34, Code of the City Fort Worth,
Texas (1964) as amended, when transporting handicapped and
elderly persons in specially designed and equipped vehicles
(vans) , pursuant to a contract or contracts with government
agencies (Federal, State or Local) as part of its taxicab
business; and
WHEREAS, the City Council finds a need for such
service as proposed does exist; that the current taxicab fee
limitations do not take into account the higher risk attend-
ing the transportation of handicapped and elderly persons;
and that the limited exception applied for should be granted
in the public interest, NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That the Fort Worth Cab and Baggage Company, a Texas
Corporation, is hereby granted an exception to the fee limita-
tions imposed by Section 34-12, Chapter 34, Code of the City of
Fort Worth, Texas (1964) as amended, in the transportation of
handicapped and elderly persons, pursuant to contract with
government agencies, in specially equipped vehicles, as part of
its taxicab business.
SECTION 2.
That the maximum fee to be charged by the Fort Worth
Cab and Baggage Company in cases falling within the exception
hereinabove granted shall be the contractual fee agreed upon by
and between the Company and the government agency concerned for the
special service contemplated on a per person, per trip basis plus
the maximum fees authorized per person, per trip under and in
accordance with Section 34-12, Chapter 34, Code of the City of
Fort Worth, Texas (1964) , as amended.
SECTION 3.
That within ten (10) days after the adoption of this
Ordinance, grantee herein shall file with the City Secretary
written acceptance of the terms and provisions hereof.

SECTION 4.
That this Ordinance shall be in full force and effect
from the date of its adoption and acceptance as hereinabove
provided.

On August 13, 1976, Fort Worth Cab and Baggage Company notified the City
that it had received a contract from the Texas Department of Public Welfare
to transport elderly and handicapped persons obtaining funds through that
agency. The contract is for a period of one year beginning September 1, 1976,
and terminating August 31, 1977. The agreement will allow Fort Worth Cab and
Baggage to transfer such incapacitated persons and be paid an additional sum
of $5 per person over the meter rate. The Company plans to use specially pur-
chased vans with wheelchair lifts for the conduct of this business.
Fort Worth Cab and Baggage has properly requested that the City authorize
them to make the charges agreed to in their contract with the Department of
Public Welfare, which are over and above the ordinary and existing meter rate
as established in the Code of the City of Fort Worth. Attached is the pro-
posed ordinance permitting Fort Worth Cab and Baggage limited exceptions to the
existing fee schedule.
Recommendation
It is recommended that the City Council approve the attached ordinance.
