HomeMy WebLinkAboutOrdinance 7215 ORDINANCE NO. �/J AN ORDINANCE PROVIDING THAT THE PORTION OF THE ALLEY IN BLOCK 38, ARLINGTON HEIGHTS ADDITION, FIRST FIL- ING, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TMCAS, ABUTTING LOTS 11 THROUGH 20 AND LOTS 21 THROUGH 30, BE ABANDONED, VACATED AND CLOSED3 PRO- VIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LANDI REPEALING ALL ORDINANCES IN CONFLICT HEREWITHi AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS t SECTION 1. That the portion of the alloy in Block 38, Arlington Heights Addition, First Filing, an addition to the City of Fort worth, Tarrant County, Texas, abutting Lots 11 through 20 and Lots 21 through 30, be and the same is hereby vacated, closed and permanently abandoned as a public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort worth in the fee to the land in said portion of the allay is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that a sixteen (16) foot easement is retained therein for utilities, including but not limited to water lines, sewer lines, telephone and electric facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. IJ44H4 A" RJUI ' The reviewing City departments and private utility companies have no UMAN SANTE RRE objection to this request provided: uFa wIL � 1) The vacated right-of-way is retained as a utility easement; 2) The vacated right-of-way is replatted with abutting property; 3) Public ingress-egress is provided from both ends of that portion 1ES of the alley remaining open; w� 4) The vacated right-of-way is physically closed with stand up curb and gutter, or provided with a standard driveway approach, at Kenley Street. The City Plan Commission has reviewed this request and recommends sWo that an ordinance be adopted vacating subject right-of-way as re- quested. A satisfactory replat has been submitted to City Staff. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
