ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF WICHITA STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH ERNEST LOYD FOR THE CONSTRUCTION CF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with ER NEST LOYD for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: UNIT 1: WICHITA STREET From Wilbarger Street to Vaughn Boulevard, known and designated as Unit 1, Project No. 104-22000-118. UNIT 1-A: VAUGHN BOULEVARD From Wichita Street to Berry Street, known and designated as Unit 1-A, Project No. 104-22000-118. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6342 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public placers and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6342 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall' be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and After the date of its passage. PASSED AND APPROVED THIS day of , 19 APPROVED AS TO FORM AMID LEGALITY: City Attorney PROJECT NO. �UNIT E WICHITA STREET FROM WILBARGER STREET TO VAUGHN BOULEVARD, to be improved by co:struct-ag a seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade, seven-inch high concrete curb and eighteen-inch concrete gutter, so that the finished roadway will be forty feet wide and by constructing six-inch thick concrete driveways and four.-foot wide concrete sidewalk where specified. Deviation from Bid Price: The final cost of this project is .$1,846.62 over the revised contract price. Exceeds Even with Below Specs but Below Specs secs within Tolerance Tolerance Paving 24 8 3 0 Base 7 28 ' 0 0 DATE REFERENCE SUBJECT: Final Payment - Widening and PAGE NUMBE7 12 71 FP-813 Paving of Wichita Street 2 of 2 On the entire project the average thickness of the HMAC paving is 7.12 inches as compared to the 7.00 inches specified, and the average thickness of the soil cement stabilized base is 6.04 inches as compared to the 6.00 inches specified. Tests made during construction .show that materials used were in compliance with contract specifications. Recommendations It is recommended that the .project described above be accepted by the adop- tion of an ordinance and that final payment of $16,842.90 be authorized to Ernest Loyd.
