(p 5 AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011'; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Montgomery Survey Abst. #1030 in Tarrant County, Texas, said iron being the southeast corner of a tract of land as shown in Vol. 3788, Page 32, Deed Records of Tarrant County, Texas; THENCE south with the west line of Montgomery St. 304.5 feet a cross cut in concrete wall, in the north line of Camp Bowie Blvd.; THENCE south 63° 30' west with said north line 20.6 feet an iron pin at the intersection of said north line with the east line of Bertrose Ave.; - 2 - Z-69-96 (continued) THENCE north 500 west with said east line 249.5 feet a cross cut in concrete walk; THENCE north with the east line of Buford Ave. 133.31 feet an iron pin the southwest corner of a tract of land as shown in Vol. 617, Page 306, Deed Records of Tarrant County, Texas, as now located on the ground; THENCE east with the south line of said tract and with fence line 95.0 feet an iron pin the southeast corner of said tract; THENCE north with the east line of said tract and fence line 20.0 feet an iron pin the southwest corner of said tract as shown in Vol. 3788. Page 32, Deed Records of Tarrant County, Texas; THENCE east with the south line of said tract 115.0 feet to the Place of Be- inning. Montgomery @ Camp Bowie, Bertrose & Buford Sts.) From "C" to "6" - 3 - SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed to lessen congestion in the streets;'to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6.
