AN ORDINANCE GRABTING L. L. HAWES, HIS SUCCESSORS
AND ASSIGNS, THE RIGHT TO LAY, CONSTRUCT AND EXTEND
A SIDE OR SPUD, RAILWA-Y TRACK ACROSS SECOND STREET

STREET ON A LINE, THE CENTER OF SAID TRACK TO BE
f PARALLEL TO, MID EIGHT FEET EAST OF THE WEST LINE
OF HX.PION STREET TO A POIITT APPROXIIATFI.Y NEAR THE
SOUTH LINE OF FIRST STREET.
BE IT ORDAINED BY THE BOARD OF CO2PTISSIONERS OF THE
CITY OF FORT FORTH:
Section 1:
WHEREAS, L. L. Hawes owns certain property
lying between Second and Third Streets in t'-e City
of Fort ';.orth; Texas, and along the East edge of
which he desires to build, and cause to be built
and constructed a certain spur railway track
connecting with the track of the Fort '�,orth & Denver
City Railway Company, which said spur or side track
is to be used to supply the property just west of the
same for industrial purposes, and
WHEREAS, the said L. L. Hawes owns the East
half of the Block of ground lying between Second
Street and First Street ,and abutting on Hw._::.ton
Street, and
WHEREAS, he desires to develop the said half
Block of ground for industrial pur_ ses;
NOW, THEREFORE, the right, : rivil;-ge az.a
franchise is hereby granted to the said L. L. Hawes,
his successors and assigns, to extend said industrial
spur track from the south edge of Second Street

northerly across said Second Street on a line, the center
of said track being parallel to, and eight feet East of
the Nest line of Hampton Street to a point approximately
near the South line of First Street.
All tracks laid under the provisions of this
Ordinance shall be laid under the supervision,and according
to the directions of the City Engineer of the City of Fort
Worth, and all tracks laid or constructed under the pro-
visions of this Ordinance shall be made to conform to the
surface of the street where the sane is laid, and the top
of each rail of said spur track, and the spaces between
the rails, and for eighteen inches' on each side of the
rails of said track, shall be kept level with the street
alongside of said track, and said track shall be so
constructed and maintained that travel on said street
shall not be unnecessarily obstructed or endangered at
any place, and all matters of construction and maintenance
shall be subject to the apIroval of the city engineer and
the Board of Commissioners of the City of Fort ;orth.
Section 2:
All tracks laid under the terms of this ordinance,
on said street that are now, or shall hereafter be paved,
shall be of firstclass rails of such kind as shall be
designated by the city engineer of the City of Fort '('orth,
and shall be laid in such manner as to make the least
ossible obstruction to vehicles, and shall be :maintained
in that condition.
Section 3:
The said L. L. Hawes, his successors and assigns,
shall, at his or their cost and expense, pave and repave,
or otherwise surface and resurface, and kee: constantly in
good order and condition with the sar::e material with which
the street on the outside of said tracks is paved, and
surface all that part of each street or streets occupied
by it, or that -.hich lies oetween the rails of said tracks,
and for eighteen inches on eac: side thereof as ma,, be
laid under the provisions of this Ordinance, and the said
L. L. Hawes,Ais successors and assigns, shall conform
said trac':s, or any , mrt `4 ereof, tc V., �ro_ er .grade of
the street,and change the level of said tracks as often
and whenever the grade of any such streets is changed so
that every part of each track shall always be kept at the
duly established grade line, or asnJJ,�,�aar�r thereto as the
surface of the grade of the street

Section 4:
The said L. L. Hawes, his successors and assigns,
to
do hereby agree axt indemnify and hold the City of Fort
orth harmless because of, and promptly to pay off and

F discharge, or repay to the a"Ld Cit; , all dai:.ages,
claims, judgments, attorney' s fees, and other cost and
expense rendered against, or incurred or paid out by the
said City of Fort Worth by reaso. of injuries either to
persons or property occasioned as the proximate result of
anything done, or permitted or in any way proximately
arising out of the construction, operation or maintenance
upon the above street and thoroughfare of the said a-)ur
track.
Section 5:
This Ordinance shall take effect and be in force
from and after its passage..
