An ordinance providing for the levy and C611eetion of an annual, direct ad valorum tax on all property real, personal and mixed, situated within the territorial limits of the City of Fort Worth, and all personal property owned in said City of Fort Worth, except such �. property as may be exempt from taxation; and providing for thelety and collection of a poll tax of $1.00 of and from every male person residing in the City of Fort Worth upon the lst, day of January A. D. 1909, over the age of 21 years and under the age of 60 years except such persons as may be exempt therefrom under the Constitut- ion aud,laws of the State of Texas, and providing penalties for the non-payment of taxes prescribed by law, and granting certain rebates for the payment of taxes prior to the maturity thereof; and provid- ing that none of the provisions of this ordinance shall include the property, real,personal and mixed situated in and personal property owned in the following described Alimits within the City of Fort Worth, r on the 1st, day of January A. D. 1909, to-wit: Beginning at a point on the east bank of the Trinity River where the south line of the H. C. Holloway tract of land intersects with the said east bank;then- ce down the east bank of the said Trinity River to a point east and opposite the north bank of Marine Creek, where \it empties into t the river; thence northwesterly along the north bank df Marine Creek , to the east line of North Main Street where it crosses between 25th, and 26th, Streets in the former corporate limits of the City of North Fort Worth; thence north along the east line of - North Main Street to the south line of the M. C. Jobe survey; thence west along the south line of the said M. C. Jobe and Cohn Surveys to the east line of the A. T. Card Survey; thence north to the north east corner of the said Card Survey; thence west along the north line of the said Card survey to the north west corner of the same; thence south along the west line of the A. T. Card and L. Moore Surveys to the north line of the John Childress Survey and continuing south to the south boundary line of the said Childress survey; thence east along the south boundary line of the Childress Survey to the north west corner of the R. 0. Reevessurvey; thence south along the west line of the R. O."leeves Survey to the north bank of the Trinity River; thence following the meanderings of said River to the south line of the J. Baugh Survey; thence eastward along the south line of the said J. Baugh survey to the south east corner thereof and the northwest corner of � Gauhenant Survey; thmaeL east with the former corporate line between the City of Fort Worth and the City of North Fort Worth to the east bank of the Trinity River; thence down said east bank with its meanderings to the place of beginning. Being that portion of the former City of North Fort Worth included within the corporate limits of the City of For Worth by the present City Charter of the City of Fort Worth. BE IT ORDAINED BY THI BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: Sec. 1. That there is hereby levied and shall be collected as provided by law an annua direct special ad valorum tax for the year 1909 for the improveme t of streets and thoroughfares of the City of Fort Worth of 1'kl'., cents on every $100.00 valuation on all property real, personal and mixed, situated in and all personal pro- perty owned in the said Cit of Fort Worth on the lst, day of Jan- uary A. D. 1909, liable under the law to taxation and notexempt by the Constitution or laws of the State of Texas therefrom. Sec. 2. Upon the requisition of the Board of School Trustees of the Independent School D strict of the City of Fort Worth and in conformity with the certific to to that effect there is also hereby levied and there shall be collected as provided by law an annual direct special ad valorum t for the year 1909 for school purposes of �_ cents on ever $100.00 valuation on all property real, personal and mixed, situated in and all personal property owned in the City of Fort Worth on thje lst, day of January A. D. 1909, liable under the law to taxation a d not exempt therefrom under the Con- stitution or laws of the S ate of Texas. Sec. 3. There is also hereby levied and there shall be col- lected as provided by law annual direct special ad valorum tax for the year 1909 for t e supportand maintenance of a free public Library in the City of For Worth of 2 cents on every $100.00 valua- tion on all property real, p rsonal and mixed situated in and all personal property owned in the said City of Fort Worth on the 1st, day of January A. D. 1909, liable under the law to taxation and not exempt therefrom under the Constitution or laws of the State of Texas Sec. 4. There is also hereby levied and there shall be col- lected as provided by law an annual direct sp#etal ad valorua tax for the year 1909 for the use and benefit of the Park Fund of the said City of Fort Worth of 10 cents on every $100.00 valuation on all k property real, personal and mixed situated in and all personal pro- perty owned in the said City of Fort Worth on the let, day of January A. D. 1909, liable under the laws to taxation and not exempt therefrom by the Constitution or laws of the State of Texas. Sec. 5. That there is also hereby levied and shall be col- lected as provided by law an annual direct special ad val&Vum tax for the year 1909 for interest and sinking fund upon the existing bonded indebtedness of the said City of Fort Worth, in which is included the issue of $650,000.00 as follows: $65,000.00 for additions to and improvements for the Police & Fire Departments, $135,000.00 for street and public thoroughfares and $450,000.00 for sewerage,water works and lighting systems; which bond issue was authorized by resolu- tion of the Board of Commissioners of the said City of Fort Worth upon the 6th, day of August A. D. 1909, calling for an election upon said bond issue, which election was held on the 19th, day of Augttht 1909, which resulted as follows: for the bond issue 612 votes and against the same 112 votes. Which result was declared by the said Board of Commissioners on the 21st, day of August 1909, 'L; . cents on every $100.00 valuation of all property real, persona and mixed situated in and all personal property owned in the said City of Fort Worth on the let, day of January A. D. 1909, liable under the law to taxation and not exempt therefrom by the Constitution or laws of the State of Texas. OpOrSec. 6. That there is also hereby levied and shall be col- lected as provided by law an annual direct special ad valorum tax for the year 1909 for all such other purposes (besides those herein- beforeenumerated) as are authorized by law and by Charter of the City of Fort Worth, of Wa&./cents on every $100.00 valuation on all property real, personal and mixed situated in and all personal property owned in the said City of Fort Worth on the let, day of January A. D. 1909, liable under the law to taxation and not exempt therefrom-by the Constitution or laws of the State of Texas. There is hereby appropriated out of the levies made under this Section and is hereby set aside so much of the proceeds of the levy here- in made as may be necessary and requisite to pay the interest on and provide a sinking fund of 2% of those obligations of f?:e 7it; of Fort Worth other than bonds, upon and concerning which the said City a/ of Fort Worth has agreed to levy a&t&,,tax in payment of such interest and to make provision for a sinking fund thereof. Sec. 7. There is also levied and shall be collected in the manner provided by law from every male person over the age of 21 years and under the age of 60 years residing within the said City of Fort Worth on the 1st, day of January A. D. 1909 an annual poll tax of $li00 each for the said year. Provided, however, that the follow- ing persons shall be exempt from the payment of said poll tax, to-wit All persons who are insane, blind, or deaf and dumb and all persons who have lost one hand or foot and all other persons who may be exempt from poll tax by the Constitution or laws of the State of Texas and provided further that said poll tax shall be included in and become a part of the public school fund and shall be used for that purpose only. Sec. 8. That those spedial tax levies which are hereinbefore in this ordinance made to provide for the payment of interest and to creat a sinking fund or to discharge and pay the principal and interest of any obligation due or owed by the said City of Fort Worth Q91inot to be taken as in addition to levies for the same purpose made in the respective ordinances authorizing and creating said obligationq, byt the levies hereinbefore made in this ordinance are made pursuant to and for the purpose of carrykng out and com- plying with the provisions of said prior ordinances, and all ad �r valerum taxes levied herein mete 41re levied upon Athe taxable property real, personal and mixed, situated in and all// personal property owned in the City of Fort Worth as assessed value4and described in the correct assessment, tax rolls and tax books of the said City of Fort Worth for the year 1909 as the same have been presented to the Board of Commissioners of the City of Fort Worth by the Assessor and Collector of taxes of said City. Sec. 9. That the taxes herein levied and authorized and required to be collected shall be and become due and payable on -5- September let, 1909, but the same shall not be construed to be delinquent so as to incur the penalties hereinafter described until February let, 1910, on .11 which saAd date in event of payers default hereinafter specified Ae ll seex'ue and be attached to and become a part of the total amount to be paid by such defaulting and delin- quent tax payer. Sec. 10. That the 31st, day of January A. D. 1910 is hereby fixed as the final day upon which taxes shall be paid to the City of Fort Worth without imposition of penalty, but it is further provided that each and every person, firm, assoication or corporator paying and discharging in full his, their or its city taxes as hereby and herein fixed and levied on or before the 315t, day 9f� t. !Y Septaimber A. D. 1909 shall be allowed a rebate or discount of^ the full amount thereof; and by paying the same as aforesaid after September 15th, 1909 and before the let, day of October A. D. 1909, shall be allowed a rebate of 27j% thereof as aforesaid and by paying the same on or after the lst, day of October and on or before the 15th, day of October a discount of 2% therefrom and by paying the same manw after the 15th, day of October 1909 and before the let, day of November 1909 a rebate of lj% therefrom and by paying the same on or after the let, day of November 1909, and before the let, day of December 1909 a rebate of 1% therefrom as aforesaid Sec. 11. That on and after the let, day of February 1910 all such taxes hereinbefore levied that remain unpaid as required berein 2' PAL- ,ion or before January,rA. D. 1910 shall be deemed delinquent and ,,shall have added thereto a penalty of l% per month or part of month upon the full amount of such unpaid taxes for the time the same shall have remained unpaid. Said penalty of 1% per month to be added to said taxes upon the let, day of February 1910 and upon the let, day of each and every month thereafter until said taxes shall have been paid, which penalty shall be and become a part of such taxes and payable as such; and provided further that in the event by- 4 publication of delinquent tax lists or if suit be brought to recover such taxes and penalty the delinquent tax payer shall be and become liable therefor and the property of such tax payer shall be subject -8- to the payment of said taxes, penalties and costs and the same shall j,,*beaLnd become a lien upon the property of such tax payer as pre- ed by law. Sec. 12. That this ordinance does not provide for the levy and collection of any taxes within and none other provisions of this ordinance shall apply to any property real, personal or mixed situated in nor any personal property owned within the following described +errito y 1 hin the corporate limits of said City of -Fort Worth.,^to-wit: Beginning at a point on the east bank of the Trinity River where the south line of the $. Card Survey; thence north to the north east corner of the said Card Survey; thence west alonng the north line of the said Card Survey to the north west corner of the same; thence south along the west line of the A. T. Card and L. Moore Surveys to the north line of the John Child- ress Survey and continuing south to the south boundary line if the Childress Survey; thence east along the south boundary line of the said Childress survey to the north west corner of the R.. 0. Reeves Survey; thence south along the west line of the R. 0. Reeves Survey to the north bank of the Trinity River; thence following the meander- ings of said river to the south line of the J. Baugh; th nce eastwa- rd along the south line of the said J. Baugh survey to the south east corner thereof and the north west corner of A. Gauhenant Survey; thence east with the former corporate lime between the City of Fort Worth and the City of North Fort Worth to the east bahk of the Trinity River; thence down said east bank with its meanderings to the place of beginning. Being all of the territory formerly within the corporate boundary of the City of North Fort Worth, Tarrant County, Texas, included within the present described boundaries of the City of Fort Worth by the terms of the present City Charter of said City of Fort Worth. Sec. 13.
