AN ORDINANCE APPROPRIATING REVENUE OF THE CITY IN EXCESS OF ITS TOTAL ESTIMATED IN- COME AS SET FORTH IN THE ANNUAL BUDGET FOR THE PURPOSE OF APPROPRIATING THE ADDITIONAL SUM OF $185,400.00 NECESSARY TO COMPLETE FUNDING OF THE HEREITAGE PARK PLAZA; PROVIDING A SEVERABILITY CLAUSE; MAKING THE ORDINANCE CUMULATIVE OF PRIOR APPRO- PRIATION ORDINANCES; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That the City Manager of the City of Fort Worth shall be provided with such revenue as may be secured from the various sources included in Ordinance No. 7598 and in the Budget of the City Manager; and, in addition thereto is hereby appropriated an additional sum of One Hundred Eighty-Five Thousand Four Hundred Dollars ($185,400.00) , in addition to the amount heretofore budgeted for the purpose of designing and constructing the Overlook Bridge of the Heritage Park Plaza, that the additional sum of $185,400 is hereby appropriated from General Fund Balance to Non-Departmental Capital Improvement Account (90-9000) I.C. 329029. The City Manager shall be authorized to transfer such $185,400 to Heritage Park Project, Phase III, 306-105-13 from I.C. 329029. SECTION 2. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 7598, but all other ordinances and appropriations for which provision has been heretofore made are hereby expressly repealed if in conflict with the provisions of this ordinance. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Heritage Park comprises approximately 112 acres centered around the confluence of the West and Clear Forks of the Trinity River on the north end of Fort Worth's Central Business District. This park and plaza were recommended as high priority projects in the Central Business District Sector Plan, 1971, and the Trinity River Planning Report, 1970, both approved by the Fort Worth City Council. Heritage Park and Plaza will accomplish three primary objectives: 1. Since the Park is centered around the confluence of the two forks of the Trinity River, it will become the "hub" of the River Greenbelt System, much of which is already implemented. 2. The bluff areas to be preserved within Heritage Park and the bluff top north of the Courthouse are the location of the original Fort Worth Army Post established in 1849 which subsequently resulted in the establishment of the City of Fort Worth. The Park will serve to protect, and give citizens access to, this historic landmark. 3. Heritage Park will provide a much needed open space and scenic attraction for the north portion of the Central Business District which is presently deficient in open space. Revival and redevelop- ment of the CBD'iS important to all citizens of Fort Worth. Project Financing and Present Funding Status The Heritage Park Project is now being constructed and financed in two phases. Phase I is the lower park improvements and land acquisition. Phase II is the Overlook Plaza. Phase I - The Lower Park Improvements and Land Acquisition Phase I involves land acquisition and park improvements along the river includ- ing clean-up, grading, lagoon construction, trail and pedestrian bridge, light- ing, landscaping and other amenities. Phase I is under construction and is scheduled to be complete by late this Spring. Land Gift $286,000 Tarrant County Water Control District 61,000 $673,000 $347,000 Phase II - The Heritage Park Plaza Phase II involves construction of the Heritage Park Plaza. The design concept for the Plaza includes several levels of plaza spaces, a Franklin Street entrance walkway, water features, and the Overlook Bridge which spans out from the bluff slopes affording a dramatic view of the River and north Fort Worth. Initial cost estimates prepared by engineering consultants indicated that all of the Plaza including the Overlook Bridge could be afforded with available funds. Unfortunately, inflation and complex construction conditions have caused the Plaza bids to exceed available funds by $185,400 which represents the cost of the Overlook Bridge. The Plaza project is under construction except for the Overlook Bridge. The Plaza costs and funding sources are as follows: Plaza Costs: 1. Construction (excluding Overlook Bridge) $1,078,900 2. Design, Engineering, Public Works Administration, Inspection, Survey, Testing 148,290 Total $1,227,190 Plaza Funding Sources: 1. Streams and Valleys Committee (Private Sources) $1,073,190 (87%) 2. Bureau of Outdoor Recreation 118,000 (10%) 3. City of Fort Worth 36,000 (3%) Total $1,227,190 The Streams and Valleys Committee has sought additional funding from all known foundations and private sources, however, all such funds are previously com- mitted. Unless additional funds are made available in the amount of $185,400, the Overlook Bridge will have to be deleted from the project. NUMBER DATE REFERENCE SUBJECT: Heritage Park Plaza - PAGE 3/21/78 C-4133 Overlook Bridge 3 of 3 The Overlook Bridge price of $185,400 is based on a firm bid from Haws and Garrett, General Contractors, who are now constructing the Plaza. Haws and Garrett was low bidder on the Plaza base bid and was awarded the Plaza construc- tion contract November 1, 1977 (M&C C-3966) . Inspection costs have already been provided by the Streams and Valleys Committee to cover inspection on the Overlook Bridge construction. Park and Recreation Advisory Board At their March 14, 1978 meeting the Park and Recreation Advisory Board voted unanimously to "recommend that $185,400 be allocated from the City's General Fund to complete funding of the Heritage Park Plaza." Recommendations It is recommended that the City Council approve: 1. A supplemental appropriation ordinance appropriating $185,400 from General Fund Balance to Non-departmental Capital Improvement. Account (90-9000) IC 329029. 2. $185,400 be transfered to Heritage Park Project, Phase III, 306-105-13 from IC 329029. 3. A contract be awarded to Haws & Garrett, General Contractors, Inc. , based on its bid of $185,400 for the Overlook Bridge.
