HomeMy WebLinkAboutOrdinance 6116 ORDINANCE NO 6116 AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 8.16 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PRO- VIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was opened in the City Council Chamber in the City Hall of Fort Worth, Texas, on the loth day of February, 1969; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 28th day of January, 1969 which date was not more than twenty (20) and not less than ten (10) days prior to date of the opening of such public hearing; and WHEREAS, on the loth day of February, 1969, the City Council held a public hearing on the proposed annexation, which hearing lasted approximately four hours, at the end of which the Council VOTED . . that the hearing in connection with the proposed annex- ation of land contiguous and adjacent to the City Limits of Fort Worth on both the east and west sides of I-35W South of the City, containing approximately 8.16 square miles, be continued for a period of six months to allow sufficient time for the City admin- istrative staff to answer more specifically the questions asked of the Council and the staff during the hearing concerning the City of Fort Worth furnishing services and utilities to the area and WHEREAS, the public hearing was, in fact, continued from day to day and from time to time, and WHEREAS, on the 26th day of May, 1969 the continued public hearing was re- opened, and at that hearing the Council found that " On the 14th Day of May, 1969 the City Manager furnished the City Council members with the information requested concern- ing the city services and cost of services to the residents of the area by Informal Report No. 1581 ; that Informal Report No. 1581 advised the Council that a change in policy regarding sani- tary sewer extensions becomes effective July 1 , 1969 and should requests for sewer service be received after July 1 , the cost for such service would be appreciably increased; that on the evening of May 22, 1969, the Mayor, City Manager, and Assistant to the City Manager in charge of area development met with residents of the area under consideration for annexation and reviewed the report to the Council, Informal Report No. 1581 , relative to services and cost of services; that the residents of the area were then and at that time notified that the hearing would be resumed at the regular City Council meeting of May 26, 1969, at which time every interested person would be given additional opportunity to be heard; and that publicity in the local paper provided further notice of resumption of the hearing on Monday, May 26, 1969 and that residents of the area would be given additional opportunity to be heard . . " ; and WHEREAS, at the public hearing held on the 26th Day of May, 1969, the Council found that all specific questions raised at the regular Council meeting on the loth Day of February, 1969 were fully and completely answered and that all interested parties and persons had had a full opportunity to be heard; and WHEREAS, at the conclusion of the public hearing on the 26th Day of May, 1969, the Council VOTED " . . . that the hearing be closed and that the city staff be instructed and directed to institute proceedings to annex the area to the City of Fort Worth . . . "; and WHEREAS, the City Council directed that an appropriate annexation ordinance be prepared for presentation and introduction before the Council for its consider- ation on the 9th day of June, 1969, which date is not more than twenty (20) and not less than ten (10) days following the date on which the continued public hearing was closed on the 26th Day of May, 1969; and - 2 - WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 198.222 square miles on the 1st day of January, 1969; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains approximately 8.16 square miles of land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the area here- inafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: TRACT 1 BEING a tract of land approximately 10 miles south of the Court House of Tarrant County, Texas, and situated in and including all or part of the Sara Grey, J. Steele, Wm. Stone, J. E. Phillips, Henry Lane, S. A. & M. G. R.R. Co. , J. M. Robinson, John Sise, G. Hamilton, and J. Martin Surveys; BEGINNING at a point in the present City limit line of the City of Fort Worth, at its intersection with the west right-of-way line of the M. K. & T. R.R. Co., in the G. Hamilton Survey, said point also being 2,500 feet south of the south right- of-way line of County Road 1059 (Sycamore School Road); THENCE east along a line 2,500 feet south of and parallel to the south right-of-way line of County Road 1059, to its intersection with the west line of the J. J. Scott Survey, A-1449; THENCE south along the west line of the J. J. Scott Survey, A-1449, produced south, to its intersection with the south right-of-way line of County Road 1078; - 3 - THENCE east along the south right-of-way line of County Road 1078, to its inter- section with the west right-of-way line of U. S. Highway No. 81 south, same being the present City limit line of the City of Fort Worth; THENCE south along the west right-of-way of U. S. Highway No. 81 south, to a point 50 feet north of the south line of Tarrant County, the same being the present City limit line as established by Ordinance No. 4823 and amended by Ordinance 4982; THENCE west along a line 50 feet north of the south line of Tarrant County, to its intersection with the westerly right-of-way line of the M. K. & T. R.R. Co.,; THENCE northerly along the westerly right-of-way line of the M. K. & T. R.R., to the point of beginning and containing 3.34 square miles TRACT 2 BEING a tract of land approximately 10 miles south of the Court House of Tarrant County, Texas, and situated in and including all or part of the Sara Grey, Abner Lee, G. B. Stone, Hiram Little, J. M. Robinson, G. Ratcliff, G. Hamilton, I. Power, Jessie B. Renfro, D. McVane, Blocks 7 and 8, Shelby County School Land, and J. Martin Surveys; BEGINNING at a point in the present City limit line of the City of Fort Worth, at its intersection with the present east right-of-way line of U. S. Highway No. 81 south and the south line of County Road 1078; THENCE east along the south line of County Road 1078, to its intersection with the east right-of-way line of County Road 1023 THENCE north along the east right-of-way line of County Road 1023, to the south right-of-way line of County Road 1098; THENCE east along the south right-of-way line of County Road 1098, to the west right-of-way line of County Road 1004, as annexed by Ordinance No. 5505; THENCE south along the west line of County Road 1004, to its intersection with the north line of the D. McVane Survey, A-1061; THENCE west 2,466.5 feet along the north line of the D. McVane Survey, A-1061, to a point in the easterly line of a TESCO easement; THENCE southwesterly along the easterly line of a TESCO easement, to its inter- section with the north right-of-way line of County Road 1023; THENCE east along the north right-of-way line of County Road 1023, to its inter- section with the west right-af-way line of County Road 1004; THENCE south along the west right-of-way line of County Road 1004, to its inter- section with the south right-of-way line of State FM Road 11U; THENCE west along the south right-of-way line of State FM Road 1087, to its inter- section with the Easterly line of a TESCO easement; - 4 - THENCE southwesterly along the east line of a TESCO easement, to a point in the present City limit line of the City of Fort Worth, established by Ordinance No. 4821 and amended by Ordinance No. 4984, said point being 50 feet north of the south line of Tarrant County; THENCE west along a line parallel to and 50 feet north of the south line of Tarrant County, to a point where said line intersects the east right-of-way line of U. S. Highway No. 81 south; THENCE north along the east right-of-way line of U. S. Highway No. 81 south to the place of beginning and containing approximately 4.82 square miles. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhab- itants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading - 5 - as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.
