AN ORDINANCE AMENDING SECTION 29-73 OF CHAPTER 29
OF THE FORT WORTH CITY CODE, WHICH IS THE PLUMBING
CODE, BY DELETING A PORTION THEREOF; MAKING THIS
ORDINANCE CUMULATIVE OF ALL PRIOR ORDINANCES REGU-
LATING PLUMBING IN THE CITY OF FORT WORTH; PROVID-
ING ,A SEVERABILITY CLAUSE; AND PROVIDING AN EF-
FECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 29-73 of Chapter 29 of the Fort Worth City
Code, which is the PLUMBING CODE OF THE CITY OF FORT WORTH,
be and the same is hereby amended so that the same shall
hereafter be and read as follows:
Sec. 29-73. Deep sewer connections.
The city maintains in part of the downtown
area a separate sanitary sewer system to serve the
basements of the buildings located in that area.
This separate system is referred to as the deep
sewer.
The construction of the sewer tap and the
sewer service lateral shall be done by city forces;
provided, that where the sewer service lateral can
be constructed without cutting the surface of a
public street, the plumber or person holding the
permit may be permitted by the plumbing inspector
to construct the sewer service lateral in accordance
with the requirements of this chapter and all other
applicable ordinances of the city, and subject to
the approval of the plumbing inspector.
Any work done by city forces in making a deep
sewer connection shall be paid for by the plumber
or other person holding a permit. (Ord. No. 2978,

SECTION 2.
This ordinance shall be and is hereby declared to be
cumulative of all other ordinances of the City of Fort Worth
providing for the regulation of plumbing in the City of Fort
Worth, and this ordinance shall not operate to repeal or
affect any of such other ordinances except insofar as the
provisions thereof might be inconsistent or in conflict with
the provisions of this ordinance, in which event such con-
flicting provisions, if any, in such other ordinance or ordi-
nances are hereby repealed.
SECTION 3.
If any section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be unconstitutional,
such holding shall not affect the validity of the remaining
portions of this ordinance, and all of the remainder of this
ordinance not so held to be unconstitutional shall continue
to be in full force and effect.
SECTION 4.
This ordinance shall become effective and be in full
force and effect from and after the date of its passage.

The City maintains in part of the downtown area a separate sanitary sewer system
to serve the basements of the buildings located in that area. This separate
system is referred to as the "deep sewer". The City Code, Section 29-73, pro-
vides for a deep sewer connection charge of $5 per front foot of building, based
on the north-south frontage of the building to be served, and in case the build-
ing to be served extends from one north-south street to another, the tap charge
is based on the total frontage of the building on both north-south streets.
The locations of deep sewers contiguous to the Tarrant County Convention Center
site are shown on the attached sketch, and the locations of the four planned
deep sewer connections required to serve the three Convention Center building
units are indicated by the numbered triangles. The Center buildings will ex-
tend through from Commerce Street to Houston Street and front foot charges
would be based on both frontages. The three building components are irregular
in shape but continuous in extent from north to south. Each of the three com-
ponents have at least one deep sewer connection. A reasonable method for com-
puting the standard front foot charges is to double the length of the three
buildings as measured along the center line of Main Street. The front foot
charges computed on this basis would be approximately:
2 x 1056 feet x $5.00 per foot = $10,560
The need for the deep sewer connections was reviewed with Mr. Slaughter, of
Romine & Slaughter, Inc., mechanical engineering consultants on the Center,
and it has been determined that it is more feasible to use the deep sewer
system for the indicated connections than to install and operate sewage lift
facilities necessary to utilize the shallow sewer system. Front footage
charges are not required for connections to the shallow sewer system.
The deep sewer system was installed about 1910, and charges for connection
to it have been collected since at least 1938. There have been no instances
of connecting to the deep sewer without paying the special connection charge
for at least 28 years, according to the recollection of employees of the
Water Department and public Works Building Division. The Building Division
reports that there have been no connections to the deep sewer since 1952.
Fees collected are recorded as plumbing permit fees in the General Fund.
The Chairman of the County Convention Center Advisory Committee has requested
a waiver of the standard deep sewer connection fee, on the basis that those
who established the charge did not contemplate a public usage such as the
Convention Center. The public building mos ecentl connected to the deep

It is requested that the City Council determine whether the standard
deep sewer charge will be made in the construction of the Tarrant
County Convention Center, or whether an exception will be made due
to the special nature of this public facility.
