ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF James Street & Crowley Rd. Inter.
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
GLADE CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS-
MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with GLADE CONSTRUCTION COMPANY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:
1. JAMES STREET AND CROWLEY ROAD INTERSECTION: From California
Parkway to 110 feet north of the north line of Frazier Drive,
a 2-inch hot-mix asphaltic concrete,surface on an noh
v cement stabilized gravel base on a ariable 44' to ' roadway.
Project No. 097-35000-118.
WHEREAS,-by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. aM , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5359 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:
Iit.
When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

Deviation from Bid Price: $8,986.87 Over-run on account of the following
reasons:
1) Where there was poor quality and/or insufficient
existing gravel base, additional new base material
was required. + $ 4,446.00
2) To densify subgrade after heavy rains, the entire
subgrade of project was lime stabilized. + 2,265.00
3) More concrete median surfacing and sidewalk replacement
was required than originally anticipated. + 1,100.22
4) Variations between quantities estimated in the contract
specifications and quantities measured and used at the
job site account for the remaining difference between
contract price and contract cost. + 1,175.65
Total Overrun $ 8,986.87
Compliance With Specifications
Attached is a tabulation of paving test cores showing compliance with
specifications within construction tolerance on James and Crowley Road
Improvements. During testing on this project, 18 corings were made
with the following results:

On this entire project, the average thickness of the hot-mix asphaltic
concrete is 2.84 inches as compared to 2.0 inches specified and the
average base thickness 8.67 inches as compared to 8.0 inches specified.
Tests made during construction of subgrade, base and pavement show that
the materials used were in compliance with specifications.
Recommendations
It is recommended:
1) That a bond fund transfer of $6,353.22 be approved by adoption of an
ordinance and that final payment of $3,494.22 be authorized to Glade
Construction Company.
2) That a bond fund transfer of $6,353.22 be approved from Project No.
097-35000-901 "Unspecified" to Project No. 097-35000-118 to provide
additional funds for the above project.
