AN ORDINANCE PROVIDING THAT LITTLE STREET BETWEEN THE SOUTH LINE OF EAST BERRY STREET AND THE SOUTH LINE OF BLOCK 5, BRANDT'S SUBDIVISION; LOIS STREET BETWEEN THE WEST LINE OF BLOCK 5 AND THE EAST LINE OF BLOCK 6, BRANDT'S SUBDIVISION; AND ALL EASEMENTS IN BLOCKS 3, 4, 5 AND 6, BRANDT'S SUBDIVISION, AS RECORDED IN VOL. 388-H, AT PAGE 101, OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED; PRO- VIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Little Street between the south line of East Berry Street and the south line of Block 5, Brandt's Subdivision, and Lois Street between the west line of Block 5 and the east line of Block 6, Brandt's Subdivision, be and the same are hereby closed, abandoned and permanently vacated as streets or public thoroughfares of any kind or character whatever; and that all easements in Blocks 3, 4, 5 and 6, Brandt's Subdivi- sion, as recorded in Vol. 388-H, at page 101, of the Plat Records of Tarrant County, Texas, be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for pub- lic utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said streets and easements is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Mathis, Joe M. Williams, and the East Berry Baptist Church, owners of all abutting property, have requested that the City of Fort Worth abandon all rights-of-way and easements in Blocks 3, 4, 5, & 0, Brandt's Subdivision, as shown on the attached print. Messrs.Mathis and Williams, owners of all property within these blocks, have acquired Tracts 2A, 3, and 4A, and request the closing of streets and easements to permit better development of a commercial center. The property was rezoned "F-R" Commercial on December 16, 1963. Private utility companies, Public Works, Water, Traffic Engineering, and Planning Department do not object to the proposed closing. on December 10, 1964, the Plan Commission reviewed the proposed closing and requested that the owner file either a vacation plat or vacation instrument on this portion of Brandt's Subdivision so that no lots of record will remain without street frontage, to which provision the owners have agreed. The owners also agree to remove curb returns at Little and East Berry Streets and construct new curb and gutter on East Berry Street closing the former Little Street inter- section. The City Plan Commission recommends City Council adoption of an ordinance abandoning the rights-of-way and easements as requested.
