SUBJECT: ANNEXATION OF THE FUTURE HULEN STREET RIGHT -OF -WAY IN
,.n THE FAR SOUTHWEST SECTOR
The June 16 City Council agenda will contain an ordinance to approve the annexation of a portion
of an enclave in the Far Southwest sector of Fort Worth. The purpose of the annexation is to
allow the City to design and construct a portion of the Hulen Street right -of -way.
The property owner, Jerry Savelle Ministries, has voluntarily submitted a petition requesting that
we annex the future right -of -way, at the request of the Transportation and Public Works
Department. This request meets the criteria defined in Texas Local Government Code Section
43.028 for owner - initiated annexation and will not require public hearings. Attached is a fiscal
impact analysis and exhibit map for reference.
The draft 2010 Annexation Program proposes annexation for the remainder of this enclave in
2014. The annexation policy notes a three -year transition timeframe for both the City and the
property owner to move from the ETJ status to inclusion within the Fort Worth city limits. The
property currently has an agricultural tax exemption which would require the City to offer a
development agreement in lieu of annexation.
The fiscal impact analysis indicates the annexation will have a negative impact on the General
Fund and will require capital improvements to construct the roadway. However, the area is
classified as an enclave, and the annexation policy does not require enclaves to produce a
positive fiscal impact due to the efficiencies gained in service delivery. In addition, Hulen Street is
designated as a principal arterial on the Master Thoroughfare Plan, and it is critical the street be
built and maintained to City of Fort Worth standards. Staff has determined that the City is able to
provide municipal services upon annexation in accordance with State law, without negatively
impacting service provision within the city. Annexation of this site is thus consistent with the
City's annexation policy.
The annexation, if adopted, will be an addition to Council District 6.

c, Patrol of the area will be added to Beat K15 in Neighborhood Policing District 8.
o Police services will be extended from present staff at the date of annexation. The
Police Department conducted an analysis of call demand for the subject annexation
area. The Police Department estimates no call activity upon annexation for the first
year. Within five years if adjacent land is annexed and development occurs, we
anticipate 3 to 5 calls for service per year at an estimated cost of $801 to $1,335
based upon an average cost per call of $267.

o EMS
o Basic Life Support (BLS) emergency medical services by existing personnel and
equipment of the Fort Worth Fire Department will be provided to the annexation area
commencing on the effective date of the annexation. The Fort Worth Fire
Department serves as the first responder on life threatening medical emergencies as a
part of the MedStar system. All Fort Worth Fire Department personnel are certified
as Emergency Medical Technician basic level or higher. All engines, trucks, and
rescue units carry Automated External Defibrillators for use with victims who are in
cardiac arrest.
o Advanced Life Support response provided by MedStar is greater than 9 minutes to
the proposed annexation area with a potential of at least a 30-minute transport time
to the nearest trauma center.

u Parks
o Area would be added to the South operations district of the Parks and Community
Services Department
o If the area is annexed, an additional 0.48 miles of rights-of-way will be added within
the annexed area, to be maintained by the City. An additional $646.00 in funding
will be required annually for the additional maintenance. An Agreement may be
required between the City and Developer and/or Homeowner's Association to
maintain additional plantings on medians or rights-of-ways, if any.

o Area to be annexed consists of 3.6 acres currently used for agricultural purposes.
c, This area will be developed for non-residential purposes only; therefore, Library
service estimates are not warranted.
u Solid Waste / Environmental
o Service to single-family and duplex residential units in this annexation area would be
provided through the existing City residential solid waste contract. Customers would
pay monthly charges through their water bill that cover the direct and indirect costs
of these services.
o Private service providers at the discretion of the customer may continue to provide
solid waste collection services for businesses and multi-family dwelling complexes
having three or more units. Private solid waste collection providers must have an
active Grant of Privilege issued by the City of Fort Worth to provide service within
A the city limits.

o Storm Water Quality Protection services will be extended at no anticipated additional
costs directly related to this annexation.

Summary
The owner-initiated annexation of the Hulen Street right-of-way (AX-09-003) has no preliminary
plat or concept plan on file as of April 24, 2009. Therefore, existing conditions, right-of-way land
use, and future growth were considered while assessing the financial impact to the General Fund.
This land is currently taxed as agricultural land and produces property tax revenue of approximately
$3 annually. Based on the projected revenue for this property and operating costs projected from
the Police, Code Compliance, Transportation and Public Works, and Animal Care and Control
Departments, the fiscal impact for the first year of annexation would be negative to the General
Fund. Assuming conditions remain constant, this area is eligible for annexation as an enclave, under
the Annexation Criteria and Procedure section of the Annexation Policy. Therefore, due to the
enclave status, this development warrants the anticipated cost of City services, assuming current tax
rates.
Water, Sewer, Storm Water, and Solid Waste Funds will not be impacted because those Funds will
recover costs from their customers, and revenues will equal expenditures or offset expenditures.
Therefore, due to the enclave status of the property and the ability of the area to meet the City's
criteria for full-purpose annexation, staff recommends that the Hulen Street ROW (AX-09-003) be
considered for full-purpose annexation at this time.
