TO CITY SECRETARY CONTRACT No. 46057
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 46057, (the
CONTRACT) which was authorized by M&C C-27028 on the 14TH day of October,
2014 in the amount of $ $217, 925.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $33, 000 which was authorized on the 7th day of
January, 2016, Amendment Number 2 in the amount of $133, 700 which was
authorized by M&C #C 28414 on the loth day of October, 2017 for a total
contract amount of $384, 625.00.
WHEREAS, the CONTRACT involves engineering services for the
following project:
Six Points Urban Village Streetscape Phase I, Project No. 00705;
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated June 5, 2019, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$98, 042. (See Attached Funding Breakdown Sheet, Page -3-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $482, 667.
3.
All other provisions of the Contract, which are not expressly

Dear Ms. Smith:
Freese and Nichols,Inc. (FNI) is pleased to submit this fee proposal for additional services to accommodate
out of scope work related to drainage design and design modifications necessary to accommodate the
adjacent proposed development, "The Presidio at Oakhurst Scenic Dr& Race St" as part of the Six Points
project (previously called phase 2 but since combined into phase 1). This fee proposal also includes
additional services for Six Points Urban Village Phase 1 project. These additional services are to
accommodate out of scope work related to additional meetings, project team management, and design
effort associated to accommodate landscape planting revisions requested by the City during construction.
FNI proposes a contract modification fee not to exceed $98,042. Refer to the attached level of effort
spreadsheet for a detailed breakdown of the proposed services. The following is a summary of our DBE
participation for this project.

Scope for Engineering Design Related Services for Street Improvements
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
The project includes the following tasks:
PHASE
• Coordination with internal and external project team members and stakeholders to
accommodate planting revisions as directed by the City Parks and Recreation
Department.
• Redesign of the planting for the entire project.
• Redesign of the irrigation for the entire project.
• Public Meeting during extended construction phase of Phase I.
PHASE II
• Coordination, review, and modification of plans to include accommodate the
developer's proposed design, including storm drain, paving, and retaining wall.
• Design of a storm water system to convey water across/under Oakhurst Scenic Drive
as directed by the City. Design of a water quality device approved by the City and
TRW D.
• Parks Dept coordination for storm water outfall re-design.
• Coordination with Tarrant Regional Water District (TRWD).
• Traffic Signal re-design.
• Re-design of approximately 500 linear feet of sidewalk with landscaping along the
north side of Race Street.
• Revise the design by removing a proposed driveway on the north side of Race Street
approximately 425 feet east of Oakhurst Scenic Drive.
• Design a new proposed driveway to accommodate the adjacent development, "The
Presidio at Oakhurst Scenic Dr and Race St". The new driveway is to be designed
on the north side of Race Street approximately 550 feet east of Oakhurst Scenic
Drive.
• Re-design the proposed lighting as required to accommodate the re-design of the
sidewalk, driveways, and retaining wall as a result of the adjacent development.
• Additional Construction phase meetings and site visits.
• Revise waterline relocation plans.

TASK 1. DESIGN MANAGEMENT.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.
1.1 & 1.3 Managing the Team (PH I & II)
• Lead, manage and direct design team activities
• Ensure quality control is practiced in performance of the work
• Communicate internally among team members
• Task and allocate team resources
1.2 & 1.4 Communications and Reporting
• Conduct drainage review meetings with the CITY as the drainage design is
developed. (Up to 3 meetings, 3 hours each including preparation and
documentation) (PH II)
• Prepare for and attend an additional public meeting during the extended construction
period for Phase I. This public meeting is to update the public on the status of
construction for Phase I as well as the Phase II design and construction schedule.

TASK 2. CONCEPTUAL DESIGN (30 PERCENT) -- Included in Previous Contracr.
TASK 3. PRELIMINARY DESIGN (60 PERCENT) — Included in Previous Contra.
TASK 4. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS
(100 PERCENT).
ENGINEER will prepare construction plans as follows:
4.1 Roadway Design Revisions (PH II)
• Final design of the roadway to accommodate the new adjacent development at the
northeast corner of Race Street and Oakhurst Scenic Drive. The new development
requires the removal of a previously proposed driveway approximately 400 LF east of
Oakhurst Scenic Drive and new design of a new driveway approximately 500 LF east of
Oakhurst Scenic Drive.
4.2 Roadway Drainage Analysis and Design (PH II)
• Final design (90%) of the drainage plans and calculations to convey water across/under
Oakhurst Scenic Drive. The design shall include a curb inlet located and sized to City
requirements on each side of Race Street. The design shall include a storm water
closed system to from the curb inlets to the west side of Oakhurst Scenic Drive and
approximately 30 feet south of Race Street and Oakhurst Scenic Drive. The design shall
include rock riprap at the outfall, if warranted.
4.3 Drainage—Water Quality Design and Analysis (PH ll)
• Design a water quality device approved by the City's Transportation and Public Works
Department and Tarrant Regional Water District (TRWD).
4.4 Drainage - Revise design to accommodate adjacent development (PH II)
• The ENGINEER shall revise the storm water design and calculations to accommodate a
storm water connection of the development at the northeast corner of Race Street and
Oakhurst Scenic Drive to the proposed Race Street drainage system.
4.5 Utility- Revise design of waterline relocation to accommodate adjacent development
(PH ll)
• The ENGINEER shall revise the waterline relocation design to accommodate the
adjacent development. The adjacent development requires the Race Street drainage
system to be lowered which results in the need to revise the water line relocation plans
completed prior to bidding.
4.6 Traffic Signal Design (PH ll)
• Then ENGINEER shall revise the traffic signal design at the intersection of Sylvania Ave
and Race Street to a four-signal pole layout in lieu of the three-signal pole layout
previously designed to the final design level.
• The ENGINEER shall meet with the City Traffic Reviewer to discuss the new 4-signal
pole design concept (one meeting).
• The ENGINEER shall meet with the City Traffic reviewer to review the revised traffic
signal plans (one meeting).

4.7 Pedestrian Lighting Design Revisions (PH II)
• The ENGINEER shall revise the pedestrian lighting as necessary to account for the
removed driveway and the new driveway as described in Item 4.1 "Roadway Design
Revisions" and 4.8 Landscape / Streetscape Revisions.
4.8 Landscape/ Streetscape Design Revisions (PH II)
• The LANDSCAPE ARCHETICT shall revise the hardscape and planting layout to
account for the removed driveway and the new driveway as described in Item 4.1
"Roadway Design Revisions".
4.9 Quality Control Review (PH II)
• The ENGINEER shall review the revised design for quality prior to submitting to the
OWNER.
4.10 Irrigation Design Revisions (PH II)
• The ENGINEER shall revise the irrigation design to accommodate the revised planting
layout as described in Item 4.8 "Landscape/Streetscape Design Revisions".
4.11 Prepare Change Order 1 (PH II)
• The ENGINEER shall prepare a change order to amend the construction contract
between the OWNER and the CONTRACTOR. The change order shall incorporate the
revisions described in this scope of work.
4.12 Landscape Planting Plans Revised (PH 1)
• The ENGINEER shall prepare revised planting plans based on comments provided
by the City Parks and Recreation Dept during the construction phase.
4.13 Landscape Planting Revision Meetings (PH 1)
• The ENGINEER shall prepare for and attend up to 5 meetings related to the
revised landscape planting layout as directed by the City Parks and Recreation
Department.
4.14 Prepare Landscape Planting Exhibits (6 Exhibits) (PH 1)
• The ENGINEER shall prepare up to 6 plan view exhibits based on planting layout
and species comments provided by the City Parks and Recreation Department
during construction.
ASSUMPTIONS
• The water quality device will be a hydrodynamic separator. (PH 1)
• The storm drain system will be within existing public right-of-way. (PH 1)
• The design will not encroach on the park property; therefore, a park conversion is not
included in this scope of work. (PH 1)
• 2 sets of 11"x17" size drawings and 1 set of 22"x34" and 2 specifications will be
delivered for the 90% Design package.

• A DWF file for the 90% Design will be created from design CAD drawings and will be
uploaded to the project folder in Buzzsaw.
• 1 sets of 11"x17" size drawings and 1 set of 22"x17" size drawings and 2 specifications
will be delivered for the 100% Design package.
• A DWF file for the 100 % Design will be created from design CAD drawings and will be
uploaded to the project folder in Buzzsaw.
• The revised illumination design does not include a photometric study or revised voltage
drop calculations.
DELIVERABLES
A. 100% construction plans and specifications and change order required for revisions after
the bid opening.
B. Detailed estimates of probable construction costs including summaries of bid items and
quantities using the CITY's standard bid items and format.
TASK 6. CONSTRUCTION PHASE SERVICES.
ENGINEER will support the construction phase of the project as follows.
6.1 RFI Response (PH II)
• The ENGINEER shall provide necessary interpretations and clarifications of
contract documents and review RFI's related to drainage.
6.2 Submittal Review (PH II)
• The ENGINEER shall review the water quality device submittal.
6.3 Attend Monthly Construction Progress Meetings (10 meetings) (PH II)
• The ENGINEER shall attend Monthly construction progress meetings as
requested by the City's Project Manager.
6.4 Project Site Visits (12) (PH II)
• The ENGINEER shall visit the site, as requested by the City, Inspector, or
Contractor.
ASSUMPTIONS
• 12 site visits are assumed at 3 hours per visit. (PH II)
• 10 Monthly construction progress meetings are assumed at 3 hrs per visit.(PH ll)

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance to increase appropriations in the 2014 Bond
Program in the Six Points Urban Village Project in the amount of$204,283.36 (City Project No.
C00705) from available funds; and
2. Execute amendment No 3 to a Professional Engineering Services Agreement with Freese
and Nichols Inc., City Secretary Contract No 46057 in an amount not to exceed $98,042.00 for a
Total Revised Contract Amount of$482,667.00
DISCUSSION:
The Six Points Urban Village project is comprised of two phases with improvements constructed along
Race Street and Sylvania Avenue. Phase One is expected to be complete by the end of January
2020 and construction of Phase Two is estimated to be complete by the end of February 2020.
The purpose of this M&C is to appropriate additional funding to the Six Points Urban Village project to
fund this Amendment No 3 to City Secretary Contract No 46057 with Freese and Nichols, Inc. for
additional engineering services.
There have been two previously approved amendments to the original contract. The following table is

The estimated cost for these additional services performed by the Engineer is an amount not to
exceed of$98,042. City staff has reviewed the proposed fee and agrees that this amount is fair and
reasonable for the services rendered.
Freese and Nichols, Inc. agrees to maintain its initial DBE commitment of 13\% that it made on the
original agreement and extend and maintain that same DBE commitment of 13\% to all prior
amendments up to and inclusive of this Amendment No. 3. Therefore Freese and Nichols, Inc.
remains in compliance with the City's BOE Ordinance and attests to its commitment by its signature on
the Acceptance of Previous DBE Commitment form executed by an authorized representative of its
company.
These projects are included in the 2014 Bond Program. Available resources within the General Fund
will be used to provide interim financing until debt is issued. Once debt associated with the project is
sold, bond proceeds will reimburse the General Fund, in accordance with the statement expressing
Official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election
(Ordinance No. 21241-05-2014) and subsequent actions taken by the Mayor and City Council.

Funding for this project was not included in the FY2020-2024 Capital Improvement Plan due to the
project being scheduled to be completed in FY 2019. The action in this M&C will update the FY2020-
2024 Capital Improvement Plan.
