AMENDMENT NO. 2 TO CITY SECRETARY
CONTRACT NO. 41540 WITH FREESE AND NICHOLS, INC. FOR THE
ENVIRONMENTAL AND ENGINEERING MANAGEMENT SERVICES FOR THE
FORMER RIVERSIDE WASTEWATER TREATMENT PLANT CLOSURE
THIS CONTRACT AMENDMENT NO.2 is entered into by and between the City of Fort Worth
("City"), a home-rule municipality in the State of Texas, acting through Dana Burghdoff, its duly
authorized, Assistant City Manager, and Freese and Nichols, Inc., ("Contractor"), by and through
Robert Chambers, its duly authorized representative.
WHEREAS, the City and Contractor, entered into City Secretary Contract No. 41540 for a term
beginning October 16, 2018 and ending December 31, 2019; and
WHEREAS, the Contract involves engineering management services for the Former Riverside
Wastewater Treatment Plant closure; and
WHEREAS,the parties entered into Amendment No.l to increase the Contract amount and extend
the contract until December 31, 2019, as described in the Contractor's attached proposal; and
WHEREAS,Contractor performed additional services it deemed necessary to close out the Contract
project which were not included in Amendment No. 1 and the City agrees that those services were
necessary; and
WHEREAS,the City wished to retroactively agree to extend the date of the Contract and amend it
to allow for the Contractor to be compensated for the additional services performed as presented in
Attachment A to this Amendment No. 2; and
WHEREAS,both parties agree to amend the Contract as provided herein.
NOW,THEREFORE,for and in consideration of the mutual covenants contained herein,and other
good and valuable consideration,the receipt and sufficiency of which are hereby acknowledged and
confessed, the parties hereto agree as follows:
Section I: The Contract is amended to allow for the Contractor to be compensated for
the additional services already provided or to be provided as identified in as Attachment A.
No other services shall be provided by the Contractor.The cost to the City for the additional
services identified in Attachment A is$22,510.00. No additional amounts shall be provided
for by the Amendment No. 2.By payment of the services in Attachment A and completion
of the plugging and abandonment of the existing groundwater monitoring wells at the site,

RE: Contract Amendment for Continued Environmental and Engineering Consulting Services
Former Riverside Wastewater Treatment Plant Closure Project
Dear Ms. Walters:
Freese and Nichols, Inc. is pleased to present this proposed contract amendment for
environmental consulting services for the completion of Phase 2 for the former Riverside
Wastewater Treatment Plant Closure Project. Phase 2 included the cleanup of the PCB
contaminated sludge in the digesters and lagoons and the demolition of relic structures for the
Trinity River Vision Oxbow Project at Gateway Park. The completion of Phase 2 of this project is
necessary to meet State and Federal regulatory requirements with the Texas Commission on
Environmental Quality (TCEQ) Voluntary Cleanup Program (VCP) and Environmental Protection
Agency (EPA).
PROPOSED CONTRACT AMENDMENT
During the execution of this project, Freese and Nichols conducted additional services not
enumerated in the contracted Scope of Services to keep the project moving toward completion.
The costs associated with these services will exceed the current contracted amount. Freese and
Nichols is proposing a contract amendment to cover the following scope items that were
necessary to complete the project that were not part of the original scope of services:
• Coordination with the US Army Corps of Engineers and Trinity River Vision Project—
Freese and Nichols coordinated with the US Army Corps of Engineers, Trinity River
Vision/Tarrant Regional Water District and their consultants to coordinate post-
construction field survey information and investigate stormwater drain connections
from Sector 1 (Former Plant Area) prior to the initiation of the USACE Phase 2 Contract
to excavate and move material from oxbow Site H to the former plant area.This resulted
in additional labor costs of$3,500.
• Metes and Bounds Description and Boundary Survey for Final Certificate of
Completion—The TCEQ approved the final Affected Property Assessment Report(APAR)
and Final Closure Report and requested that the City provide a metes and bounds
description of the affected property with boundary survey sealed by a Registered

Professional Land Surveyor (RPLS). Due to the institutional control (HDPE liner and cap
system) in Sector 4 (Soccer and Rugby Fields), the affected property for the Final
Certificate of Completion was limited to Sector 1 (Former Plant Area), Sector 2 (Former
Sludge Lagoons) and Sector 3 (Softball Fields). A new boundary survey and metes and
bounds description was prepared for smaller affected property footprint by
Gorrondona & Associates in December 2019. This resulted in additional subconsultant
cost of$14,180.00.
Total costs from these additional scope items were approximately $17,680. This proposed
contract amendment will cover expenses already incurred by Freese and Nichols to complete
closure of the Riverside Wastewater Treatment Plant Closure Project.
The City also requested that Freese and Nichols provide optional costs for the plugging and
abandonment of the existing groundwater monitoring wells at the site. There are currently
thirteen monitoring wells present at the site. A licensed water well driller is required for the
plugging and abandonment of the monitoring wells in the state of Texas. The cost estimate
received from the licensed water well driller is $4,830.
Freese and Nichols is requesting a contract amendment in the amount of$22,510 to cover the
services provided to the City under this contract, as described above, and to plug and abandon
the 13 monitoring wells present on the site.
