AN ORDINANCE GRANTING TO THE MAGNOLIA PETROLEUM
COMPANY, A TEXAS CORPORATION, SUCCESSOR TO THE ASSETS OF
THE MAGNOLIA PETROLEUM C011PANY, A JOINT STOCK ASSOCIATION,
ALL OF THE RIGHTS, LICENSES AND FRANCHISES TO INSTALL,
EQUIP, MAINTAIN,REPAIR AND OPERATE FUEL DISTRIBUTING LINES
THROUGH CERTAIN NAMED STEEETS OF THE CITY OF FORT WORTH,
AS HERETOFORE GRANTED BY SAID CITY TO THE SAID MAGNOLIA
PETROLEUM COMPANY, A JOINT STOCK ASSOCIATION, AS SET OUT
IN AND LIMITED BY SUCCESSIVE ORDINANCES OF THE CITY OF
FORT WOP,TH NUMBM 417, 433, 440, 461, 527 and 537; AND
RECOGNIZING IN THE SAID MAGNOLIA PETROLEUM COMPANY, IN-
CORPORATED, AS THE SUCCESSOR TO AND HOLDER OF THE RIGHTS,
PRIVILEGES AND FRANCHISES ENUMERATED IN SUCH ORDINANCES,
SUBJECT TO AND LIMITED BY THE TERMS OF THE ORDINANCES
REFERRED TO.
WHEREAS, the Magnolia, Petroleum Company, a joint
stock association, organ1z.4d under a Declaration of Trust
recorded in the Deed Records of Jefferson County, Texas,
Book 120, Page 347 et seq. , has been heretofore, by
original Ordinances No. 417, dated January 23rd, A. D. 1914,
and Supplemental Ordinances No. 433, 440, 461, 527 and 537,
granted by the City of Fort Worth the right, license and
franchise to install, equip, maintain, repair and operate
a line or lines for fuel distribution through oeirtain named
streets of the City of Fort Worth, according to the terms
and limitations oontained in such respective ordinances,
to which reference is hereby made; and
WHEREAS, it has been made to appear that the
Magnolia Petroleum Company, Incorporated, a private oor-
poration duly organized under the laws of the State of
Texas, has, within the sixty days prior to January 2nd,
A. D. 1926, succeeded to all of the assets of the said
Magnolia Petroleum Company, a joint stock association,
and, among other things, the rights and privileges as set
out in such named franohises and ordinances, and is de-
sirous of obtaining official recognition by the City of
Fort North of its succession to the rights, privileges
and franchises aforesaid;
NOW THEREFOF,E,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH:
SECTION I
That all of the rights, licenses and franchises
heretofore granted to the Magnolia Petroleum Company, a
joint stook association, to install, equip, maintain, re-
pair and operate fuel distribution lines through said named
streets of the City of Fort Worth, as heretofore granted
in and limited by the terms of Ordinances No. 417, 433, 440,
461, 527 and 537, of the City of Fort Worth, be and the
same are hereby recognized to be in and extended to the
Magnolia Petroleum Company, Incorporated, a private cor-
poration of Texas, as the successor to said joint stock
association; and the said Magnolia Petroleum Company, In-
corporated, may hereafter exercise any and all of the
rights, licenses and franchises described in the afore-
named ordinances, subject, however, to the terms and oon-
ditions as contained therein and for the length of time
therein provided.
SECTION II
This ordinance grant and recognition of fran-
chise is made subject to all of the terms and conditions
as heretofore set out in the ordinances enumerated in the
preceding section and without waiving any of the clauses
therein contained, or any rights of the City of Fort Worth,
and without waiving any violations, if any, of the pro-
visions of such previous franchises and ordinances or the
right of the City of Fort Worth to declare and exercise a
forfeiture thereof, in accordance with the provisions
therein, or to assert any of the rights hereinbefore named
and without assuming any responsibility for such transfer
of assets or in anyway warranting the validity of such
represented transfer.
SECTION III
This ordinance is made cumulative of all of the
provisions and terms of the foregoing enumerated ordinances
and is not intended to repeal the same, but only to amend
the same in recognition of the succession of the Magnolia
Petroleum Company, Incorporated, to the Magnolia Petroleum
Company, a joint stock association.
SECTION IV
This ordinance shall take effect and be in full
force and effect from and after the date of its passage,
and the filing of written acceptance thereof by the Magnolia
Petroleum Company, Incorporated, acting through its proper
officers, agreeing to be bound by and to fully and faith-
fully perform the terms and conditions of this ordinance
and the original and supplemental ordinances hereinbefore
enumerated, granting the rights, licenses and franchises
to its predecessor the Magnolia Petroleum Company, a joint
stock association.

At a regular meeting of the City Council of the
City of Fort Worth, held at the City Hall on Tuesday the
11�/ dray of January, A. D. 1926, the Mayor, Secretary-
Treasurer and a quorum of the City Council of the City of
Fort Worth, being present; thereupon the above and fore-
going ordinance, NO. / / /Y, was read, its passage and
adoption was thereupon approved by Councilmen
