HomeMy WebLinkAboutIR 9028INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 9028 To the Mayor and Members of the City Council March 31, 2009 ah° Page 1 of 1 SUBJECT: SPEED LIMIT ORDINANCE In response to recent newspaper articles pertaining to posted speed limits on freeways the following information is provided: The State Transportation Code, Section 545.356 (a) prohibits a city from having a speed limit over 60 mph on a designated state highway (unless the Texas Transportation Commission has set a higher speed). To have a speed limit over 60 mph, TxDOT has to first perform an engineering and traffic investigation study. The city cannot, on its own, increase the speed limit above 60 mph. If the TxDOT speed survey deems it necessary to make changes to the speed limits, TxDOT sends the requested changes to the city. An M &C is then prepared and presented to Council along with the appropriate exhibits. After City Council approval of the M &C and ordinance that reflects the changes requested by TxDOT the City sends TxDOT a certified copy of the approved ordinance before the signage can be updated. TxDOT is the agency that is tasked with making the speed limit sign changes on designated state highways. M &C G -16148 was approved by Council on June 3, 2008. The approved Ordinance No. 18124- 06 -2008 was mailed to TxDOT on February 18, 2009 to make appropriate changes. We normally send a certified copy to TxDOT within a few weeks but unfortunately our process got caught up in other priorities in order for TxDOT to respond in timely manner. TxDOT is currently working to get the speed limit signs changed within the next few weeks. In response to the legality of police enforcement, the city must adopt TxDOT's speed limits so that city police officers can enforce them. Currently the police officers should write citations only if the violator is going over 65 mph. DISCUSSION: Every few years the Transportation and Public Works Department reviews the speed limits in the City Code in order to make corrections, additions, or amendments, where appropriate. The requested changes are due to new speed limits or adjustments resulting from development or school zones for new schools; text corrections; and IIrn tWWock range corrections. In addition there are a few f speed zone changes requested by the Texas rtment of Transportation portatfon (TxDOT) due to speed surveys completed. (The City of Fort Worth must adopt its speed limits so that City police officers can enforce the speed limits) The Texas Motor Vehicle Laws specify that Procedures for Establishing Speed Zones must be followed to post speed limits. This procedure is used by all municipalities within the State of Texas. All the recommendations in the ordinance and exhibit are based on Traffic Engineering Studies, in accordance with the Texas Motor Vehicle Laws, performed by either City staff or TxDOT. The attached proposed ordinance incorporates all the above and amends the City Speed Zone Ordinance, Chapter 22, Motor Vehicles and Traffic, of the City Code, by making certain additions and deletions recommended by TPW. Chapter 378 of the Texas Local Government Code provides that a municipality can offer an abatement of municipal property taxes for properties located in a Neighborhood Empowerment Zone. 4312 Town Center Drive Texas Catholic Community (TCC) Credit Union is the owner of the property located at 4312 Town Center Drive, Fort Worth, TX 76115. The property is located within the Hemphill/Berry NEZ in Council District 9. TCC Credit Union applied for a five -year municipal property tax abatement under the NEZ Tax Abatement Policy and Basic Incentives (Resolution No. 3487, 05- 2007). The Housing & Economic Development Department reviewed the application and certified that the property met the eligibility criteria to receive a NEZ municipal property tax abatement. TCC Credit Union will invest $1,200,000.00 to construct an approximately 3,000 square foot building and drive through with two teller lanes and one ATM lane. There are only two other banking institutions within a 1.5 mile radius from the proposed credit union site to serve nearby neighborhoods. The municipal property tax on the improved value of the commercial building after its construction is estimated at $10,260.00, per year, for a total of $51,300.00 over the five -year period. However, this estimate may differ from the actual tax abatement value, which will be calculated based on the Tarrant Appraisal District appraised value of the property. In the event of a sale of this property, the agreement may be assigned, with City Council approval, to the new owner, so long as the new owner meets all of the eligibility criteria as stated in the NEZ Tax Abatement Policy and Basic Incentives. Staff recommends proceeding with placing the tax abatement on the April 7, 2009, City Council agenda for consideration by City Council. The Purchasing Division surveys the City departments and the vendors to determine if the agreements eligible for extension should be extended and renewed. The agreements that are listed on the attached pages have been deemed to be eligible for extension by the departments due to satisfactory performance based on the survey by the Purchasing Division. Therefore, if sufficient funds have been appropriated by the City Council, a renewal may be accomplished by a written notice to the vendor within 60 days of the expiration date. As provided in the M &Cs awarding the agreements valued over $25,000, "[renewal of these agreements] does not require speck City Council approval."
