An ordinance granting to the Northern Texas Traction Com- pany, its successors and assigns, the right, license and fran- chise to construct, equip, maintain and operate, along and upon certain streets and public grounds within the corporate limits of the city of Fort Worth certain lines of, single and double street railway track, as branches, extensions and connections of its existing lines of railway in the said city, and the right, license and franchise to construct and maintain all necessary poles, wires and over-head electric equipment and appliances suitable or necessary for maintaining and operating said lines of electric railway over said named streets, alleys and public places within the said city of Fort Worth. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: Section 1.-- That the right, license and franchise is hereby given and granted by the city of Fort Worth to the Northern Texas Traction Co*any, its successors and assigns, to cox&tr=t,. aAW_p, maintain-and operate all tha"' certain lines of single or double track of electric street railway, for the carriage of passengers and freight for hire, as branches, extensions and connections of its present lines of street rail- way in the city of Fort Worth now being operated by said North- ern Texas Traction Company under grants and franchises hereto- fore given and granted to it and its predecessors by the city of Fort Worth along, over and upon the following named streets, alleys and public places in the said city to-wit: Section 1«A. A single track extension and branch of the Street Railway Lines of the grantee on Railroad Avenue in said city. Beginning at the point of intersection of Railroad Ave- nue with Hemphill Street; thence over Railroad Avenue westward to Wheeler Street; thence over Wheeler Street southward to West Daggett Avenue, (a distance of approximately 720 feet), with the right of connection with the present lines of the grantee at the intersection of Wheeler Street and Daggett Avenue; and, at the point of intersection of Hemphill Street and Railroad Avenue. Section 1-B. A single track extension, branch and con- nection of the line of tracks of the grantee on Commerce St., in said city. Beginning at the intersection of Commerce Street with Sixth Street; thence northward over said Commerce Street to East Weatherford Street ( a distance of approximately 1700-ft), with right for connections with present lines of the grantee at the intersection of Sixth and Commerce Streets and Commerce and East Weatherford Streets. Section 1-0. A single track extension and branch of the Street Railway Lines of the grantee on Throckmorton Street in said city. Beginning at the point of intersection of Throckmorton Street with Eighth Street; thence over Throckmorton Street south- ward to Tenth Street, ( a distance of approximately 580-ft) and from point of intersection at Throckmorton and Eighth Streets southerly over and along Monroe Street to Tenth Street ( a distance of approximately 450-ft), with the right of connection at Throckmorton. Street and Eighth Street; Tenth Street and rer - nine Avenue, �d Tenth Street and Monroe Street_, with the right of connections with present lines of track now operated by the grantee on said streets. Section 1-D. A single track extension, branch and con- nection of the lines of tracks of the grantee on Texas Street in said city. Beginning at the intersection of Texas Street with Monroe Street; Thence Eastward on Texas Street to Jennings Avenue ( a. distance of approximately 350-ft), with the right of connections at Texas and Monroe Streets and at Texas Street and Jennings Ave. with the present lines of tracks now operated by the grantee on said streets• Section 1-E. Replace present single track with double j` track on Hemphill Street in said city. I� Beginning at the intersection of Hemphill Street with Magnolia Avenue; thence Southward over said Hemphill Street with double track to Hawthorne Street, ( a distance of approxi- mately 3500-ft). Section 1.F. Replace present single track with double track on Summit Avenue in said city. Beginning at the intersection of Summit Avenue with Texas8treet; thence Southward. over said Summit Avenue to Rail- road Avenue ( a distance of approximately 1800-•ft) Section 1-G. Replace present single track with double track on Vickery Boulevard in said city. Beginning at the intersection of Vickery Boulevard with Tyler's Branch or Ash Crescent Street; thence East-ard over and along Vickery Boulevard to ( Sycamore Creek) city limits, ( a distance of approximately 2100-ft). Section 2. That all the rights, licenses and franchises in this ordinance granted, as set out in Section #1. and sub- divisions thereof, shall run concurrent with, and are hereby made expressly subject to, the conditions, requirements and limitations spefieioally set out in the original ordinances of the city of Fort Worth granting unto the grantee, or its predecessors, the right, licenses and franchises to maintain and operate its certain lines of electric street railway as follows; Rights granted under sub-division "A" shall run con- current with and become a part of, grantee's present franchise on Railroad Avenue in said city. Rights granted under sub-division "B" shall run cork- current with, and become a part of grantee's present franchise on Commerce Street in said city. Rights granted under Sub-division "C" shall run con- current with and become a part of grantee's present franchise on Throokmorton Street in said city. Rights granted under sub-division "D" shall run con- current with and become a part of grantee's present francI.Ase on Jennings Avenue in said city. Rights granted under sub-division "E" shall run con- current with, and become a part of grantee's present franchise on Hemphill Street in said city. Rights granted under sub-division "F" shall run concur- rent with, and become a part of grantee's present franchise on Summit Avenue in said city. Rights granted under sub-division "G" shall run concur- rent with, and become a part of grantee's present franchise on Vickery Boulevard in said city. Section #3. The city of Fort Worth hereby further grants unto the Northern Texas Traction Company, its successors and assigns the rights, license and franchise to construct, main- tain and operate along and upon any or all of the streets here- inbefore named, and in connection with each and all of the branches, extensions and connections• of the said different lines of street railway as set out in Section #1 hereof, all necessary switches, sidings, turnouts and connections, and also all necessary and desirable poles, trolley wires, supports, span wires and other necessary appliances pertaining to the mainte- nance of an overhead trolley system. Section 4. All the track laid under the provisions of this ordinance, except switches, side tracks and turn-outs, except places where turns are made, shall be laid and kept as nearly in the middle of the street as is practical, and the top of each rail of each and every part of said track, and the spaces between the rails shall be kept level with the street alongside; and the tracks wires, poles and all other equipment shall be of standard quality and so constructed and maintained that the travel upon said streets shall not be unnecessarily obstructed or endangered at any place; snd all tracks on portion of streets that are now or shall hereafter be paved shall be of first class rails of such kind as shall be designated by the City Engineer, and shall be laid in such manner as to make the least possible obstruction to vehicles and shall be maintained in that condition. All work done under the terms of this or- dinance shall be done under the supervision and approval of the City Engineer. Section 5. The said Northern Texas Traction Company, or its assigns shall, at its or their own sole cost and ex; pease, pave, repave or otherwise surface and re-surface and keep constantly in good order and condition with the same material with which the street on the outside is paved, and surfaced,all that part of each street occupied by it as named herein or that which lies between the rails of said tracks and r for 18 inches on each side thereof, and the said Northern Texas Traction Company, or its assigns, shall conform its or their tracks or any part thereof to the proper grade of each street and change the level of said tracks as often and whbnever the grade of any such street is changed, so that every part of each track shall always be kept at the duly established grade of the street. Section 6. The said Northern Texas Traction Company, its suecesors or assigns, do hereby agree to indemnify and hold the said city of Fort Worth harmless because of and promptly pay off and discharge, or repay to the said city all damages, claims, judgments, attorney's fees and other costs and expenses rendered against, or incurred or paid out by the said city by reason of injuries either to persons or property occasioned as the proximate result of anything done or permitted, or in any way proximately arising out of the location, construction, operation or maintenance upon the above named streets and thoroughfares of the tracks, poles, wire8 or cars of said company. Section T. The City Engineer shall direct and point r out places at which poles erected under this ordinance shall be set; provided always that no poles shall be set in violation of any city ordinance. Section 8. This ordinance shall take effect and be in force from .and after its passage. I hereby certify that the above and foregoing Ordinance was duly presented, passed and adopted by the Board of Commissioners of the City of Fort Worth, Texas, at a Regular session of said Board held May, 18th, A.
