HomeMy WebLinkAboutOrdinance 1119 At a regular meeting of the City Council of the City of Fort .iortb, Texas, held in the Council Chamber at the City Hall in said City on Tuesday, the 19th day of January, A. D. 1926, at which meeting were present Vim. Bryce, Mayor Pro Tea, Willard Burton, A, N, Thomas, E. T. Renfro, Was Nonnig, W. E. Austin and L. P. Card, Councilmen, constituting a majority and quorum of said Council and I. L. Van Zandt, Jr., City Secretary- Treasurer, was in attendance at said meeting, and the fol- lowing proceedings, among other things, were had and done: Councilman,�w seconded by Councilman e�Z ov d the adoption of the following resolution: RESOLUTION WHEREAS, the general scheme, plan, design and pur- pose of the water and sanitary sewer system of the City of Dort Worth ,for many years has been to give its inhabitants one system to the end that its citizens would be given facilities to furnish them with water and, at the same tints, they would be furnished with facilities to carry-off waste water and other refuse matter in liquid forms and ?'IiP=S, it appearing to the City Council that the City of Fort Worth has owned and operated its own water and sanitary sewer facilities for many years, and that the mains, laterals, pipes, conduits, taps, air valves, blow-offs and other fixtures and connections used in carry- ing off waste water and refuse matter in liquid form, from buildings and other places in this city, would be worthless and of no use and benefit if the general scheme and plan of their maintenance, installation and construction did not provide for water lines, mains, etc,; and WHEREAS, it appearing to the City Council that the proper afficers of this city have made and have caused to be made a full and complete not of maps, plats, notes and records showing the location and size of all mains, laterals, pipes, hydrants, house-tape, air valves, blow--offs, conduits and other fixtures and connections used in the grater and sanitary sewer system of the City of Fort 'forth and have made and caused to be made plans, de „specifications and maps for extensions, additions, improvements, altera- tions and changes in said system; and ARRAS, the experience of the City of Dort Worth of regarding the water and sanitary sewer system as one and the same system has demonstrated the fact that the prao- tical operation and the economioal construction of water and sanitary sewer lines and facilities requires that they be treated as one and the same system; and WhEREAS, the objects to be attained by the con- struction, operation, maintenance and installation of such improvements are not separate and distinct, but the pur- pose in view is a single one, since the sewer lines and facilities would be worthless without the water facilities and the water facilities would be incomplete without the sanitary sewer connections, consequently the lines, taken together, constitute a single unit and put into effect a single purpose; and ,NHMAS, the lines, mains, faucets, connections and other fixtures of the City of Fort Worth used in the water and sanitary sewer system all go to make up one well considered plan and scheme of said City to furnish water and, at the same time, to provide facilities to carry off waste water and refuse matter in liquid form, and that each part of the plan and programme is necessary to make the whole, and the system as outlined is incomplete without either the water facilities or the sanitary sewer facili- ties; and WHIUSAS, prior to the 24th day of November, 1925, on which date the proposition for the issuance of negotiable coupon bonds of the City of Fort Worth was submitted to the resident qualified tax-paying voters of whether or not Three Million Three Hundred Thousand Dollars 33,300,000.00) worth of bonds should be issued for the purpose of improving and extending the water and sanitary sewer system of said city, the proper officers of said City prepared and caused to be prepared maps, plats, plant and specifications showing the location of the proposed extensions and improvements of the water and sanitary sewer system. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THX CITY OF FORT WORTH: That the doctrine and policy established by the government of the City of Fort North of regarding t7W tea'ter and sanitary sewer lines, mains, laterals, conduits, con- nections and all other property and facilities connected therewith as constituting one functional unit and a single system, is hereby re-affirmed; that since the object to be attained is interdependent and that the purpose of the whole scheme and plan is to provide facilities for furnish- ing water and, at the same time, to provide facilities to carry all waste water and other refuse matter in liquid form and that the experience of this city has conclusively demonstrated the fact that the economical and practical operations maintenance and construction of its water and sanitary sewer system requires that that system be treated as a single one. That the monies realised from the sale of bonds authorized by a vote of the resident dualitUA tax-paying voters of the City of Port Worth on the 24th day of November, 1925, for the purpose of improving and extending the water and sanitary sewer system of thin city, and which bonds shall be known as series 45, shall consti- tute a sacred fund and no part of same shall be used ex- cept for the specific purpose of making extensions and improvements in the water and sanitary sewer system, and the same shall continue to be regarded as one system and no part of said fonds shall be used or applied except to carry out one general scheme and plan of extending and im- proving a single system, in accordance with plans hereto- fore made. That,as the work proceeds on the aforesaid ex- tensions and improvements, the proper officers shall make and cause to be made a full and complete not of records, consisting of maps, plats and notes showing and giving the location and size of all conduits, mains, laterals, pipes, hydrants, valves, house-taps, blow--offs and other fixtures and connections, and such information shall be available to all persons interested in the location of the water and sanitary sewer facilities. And the Mayor Pro Tom, am. Bryce, presiding at said meeting, submitted the motion to adopt said resolution to the Council and then and thereupon all of the Councilmen, Including the Mayor Pro Toms voted "Aye" thereon and none voted "No", whereupon the said resolution was declared to be unanimously passed and adopted. Immedi a tely following adoption of said Resolution, Councilman `�/L .� , seconded by Coun- cilman moved the adoption of the following ordinances ORDINANCE NO. AN ORDINANCE RE-AFFIRMING THE DOCTRINE AND PQLICY HERETOFORE ESTABLISHED BY THE GOVERNMENT OF THE CITY OF FORT WORTH (F REGARDING THE COMBINATION OF ALL OF THS FACILI- TIES OF THE WATER AND SANITARY SEMM SYSTEM AS CONSTITUTING A SINGLE FUNCTIONAL UNIT AND, ALL TAKEN TOOTH ER, AS BEING A WHOLE, AND EACH PORTION THEREOF BEING A PART OF A GENERAL SCHEME AND PLAN TO PERFORM A SINGLE OBJECT, AND PROVIDING THAT THE MONEY REALIZED FROM THE SALE OF THE BONDS OF SERIES 45 SHALL CONSTITUTE A SACRED FUND AND NO FART OF SAID FUNDS SHALL BE EXPENDED EXCEPT IN THE EXTENSION AND IMPROVEMENT OF THE WATER AND SANITARY SEWER SYSTEM AS ONE UNIT, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTHz SECTION I That the doctrine and policy heretofore establish- ed by the government of the City of Fort "orth of regard- ing the water and sanitary sewer lines, mains, laterals, conduits, connections and all other property and facilities connected therewith as constituting one functional unit and a single system, is hereby re-affirmed. SECTION VI That this ordinance shall be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM: .
