An ordinance providing that persons shall secure a permit
-before opening or cutting into any street,, alley, sidewalkp or public
ground and requiring a cash deposit to insure refilling of same and
prescribing how the same shall be fefilled and providing for plac-
ing of lights at night on same and presecribing penalty and re-
pealing Sections, 1001, 1002, 1003,1004, 1005, 1006, 1007, 1012, 1013,
1014 of Chapter 5,Title 7,of the Revised ordinances of the City
of 'Port worth-.
Be it ordained by the Board of Commissioners of the
City, of Vort Worth.
Sec. 1. Any plumber or other person, company, association
or corporation desiring to cut in o r in any manner open any public
street or alley, or sidewalk, or public ground din the city of Fort'
Worth for any purpose whatever, shall first obtain a permit' from the
City Engineer, to cut into or open such street, alley sidewalk or
public Bound.
S". 2. That prior to the issuance of the permit for such
work as mentioned in Section 1, of this ordinance,the City Engineer
shall require a cash or equitalent deposit of a sum of money suffi-
cient to refill any cut or cuts, opening or openings about to be made

into any of said streets, alleys, sidewalke or public grounds and to
replace any paving that may exist thereon. Such monies shall. be deposi-
ted by the City Engineer with the City Treasurer who shall hold the
same as a special fund until such time as the City Engineer shall
make certificate that the work for which said deposit was made has
been properly done and the properly refilled and
replaced. As soon as said � 'land replacing a been spade•

writing the City Treasurer shall refund the full amQunt of said de-
posit to the person depositing the same. In case the en on, firm,
association or corporation cutting irvokhe surface of said street
shall fail to do properly the thing-s herein prokvided for and obtain
the said certificate of the said City Engineer then the said6 `
Engineer shall do the s,me and chargq the cost against the deposit

and the person shall only be allowed to receive the balance of his
deposit after deducting the amount charged against the same as afore-
all
said, provided that in^cases of cutting into or opening sheets paved
with brick, asphalt or similar material the said cut or opening shall
be filled with . cement or other material ely satisfactory and
substantial and all dirt taken from the excavation shall be hauled
away by the party opening the street and deposited according to the
provisions of Section 1009 Chapter 5, Title 7 of the Revised Ordinan-
ces as codified by Wm. D. Williams and T. J. Powell.
Sec. 3. When any street, alley, sidewalk or public ground has
been cut into or opened asaforesaid for the purpose of laying gas,
water or serer pipes or for any other purpose the party or parties
doing the same shall puddle and ram the back fillingso as to pre-.
vent the settling of the place cut and the streak shall be re-
stored with similar material and workmanship to that existing in the
street, alley, sidewalk or public ground before the same was torte
up and all work shall be done to the s atisfaction of the City
�:. Engineer whose duty it shall be to inspect the same after it has
been done and the said work shall be completed and the cut or
opening refilled and replaced as herein provided within the time
ppecified in the permit.
Sec. 4. In all cases where the surface of the street, alley,
sidewalk or public ground is disturbed the party or parties so cut-

Sec. 5 . Any person violating provisions and requirements of
the preceding. Sections of this ordinance or any of them shall be
deemed guilty of a misdemeanor and upon conviction shall be ' fined
in any stun not less than Ofle dollar nnt more than One hundred dol-
lars.
See. 6 . That Sections 1001, 1002, 1003, 1004, 1005, 1006,
1007, 1012, 1013, 1014 of Chapter 5, Title 7, of the Revised Ordina-

noes bf the city of Fort Worth, as codified by Wn. D. Williams and
T. J. Powell be and the same are hereby repealed.
Sec. 7. That all Nrdinances and parts of ordin ances in
conflict herewith be and the same are hereby repealed provided
that this' ordinance shall not be construed as repealing or affecting
Sections, 1008,1009,1010, 1011, 1015,1016,1017, Chapter 5, Title 7, of
the said Revised Ordinances of the city of Fort Worth.
