AN ORDINANCE APPROVING THE REPORT OF THE DE-
PARTMENT OF PHBLIC WORKS: AWARDING THE CONTRACT
FOR THE IMPROVEMENT OF A PORTION OF ROSEDALE
STREET IN THE CITY OF FORT WORTH, TEXAS, AND AU-
THORIZING ITS MMCUTION: MAKING APPROPRIATION
FOR THE INDEBTEDNESS INCURRED THEREBY: AND DIRECT-
ING THE CITY ENGINEER TO PREPARE ESTIMATES.
WHEREAS, on the 23rd day of June, 1949, by Ordinance passed
and approved by the City Council of the City of Fort Worth being Ordi-
nance No. 2554, the City determined the necessity for and ordered the
improvement of a portion of Rosedale Street, to-wits
ROSEDALE STREW from the westerly line of South Main Street
to the easterly line of Eighth Avenue, save and except the intersection
of Hemphill Street.
WHEREAS, subsequent to the passage and approval of said ordi-
nance, plans and specifications for said improvements were submitted by
the City Engineer and said plans and specifications were approved and
adopted by the City Council; and,
WHEREAS, notice to bidders was given as required by the City
Charter; and,
WHEREAS, the Bid of Brown and Root, Incorporated, was found
to be the lowest and best Bid for the making and construction of said
Improvements, to-wit, excavating present street, placing thereon a two
inch compacted gravel foundation course, and paving with 6 inches of re-
inforced concrete base and li inches of Asphaltic Concrete Surface with
combined concrete curb and gutter, together with incidentals and appur-
tenances, all as provided by said Plans and Specifications;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the work of making and constructing such improvements and
contract therefor is hereby awarded to Brown & Root, Incorporated, at and
for the prices stated in the proposal of the said company and as reported
and recommended by the Department of Public Works. The Mayor and City Se-
cretary are hereby directed to execute the said contract in the name of
the City of Fort Worth, Texas, and to impress the corporate seal of the
:ity thereon, the said Contract embracing therein, among other things, the
riess for the work.
SECTION 2.
That to provide for the payment of the indebtedness incurred by the City of
Fort Worth by said contract, there is hereby appropriated out of available funds
which have been set aside for said purpose, an amount sufficient to pay said in-
debtedness so incurred.
SECTION 3.
That the City Zngineer of the City of Fort Forth be and he is hereby ordered
and directed to file with the City Council estimates of the coats of such improve-
ments in accordance with the terms of the powers and provisions of Chapter 106 of
the acts of the First called Session of the Fortieth Legislature of the State of
Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas
Annotated, which law has been adopted as an amendment to and made a part of the
Charter of the City of Fort North.
