AN ORDINANCE AMENDING ORDINANCE NO. 2905 BEING
AN ORDINANCE REGULATING TRAFFIC ON THE EAST-WEST
EXPRESSWAY AND THE NORTH-SOUTH EXPRESSWAY;
AMENDING SECTION 1 OF THAT ORDINANCE BY DESIGNATING
THE THROUGH TRAFFIC LANES OF BOTH EXPRESSWAYS;
AMENDING THE MAXIMUM SPEED LIMIT BY SETTING A
SPEED LIMIT OF FIFTY-FIVE (55) MILES PER HOUR;
PROVIDING A MINIMUM SPEED LIMIT OF FORTY (40) MILES
PER HOUR; PROVIDING A PENALTY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF ALL OTHER ORDINANCES
GOVERNING MOTOR VEHICULAR TRAFFIC; PROVIDING A SAVING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION le
That Section 1 of Ordinance No. 2905 be amended to read
as follows:
Section 1. The through-traffic lanes or ways constructed in
the center of what is commonly known as the East-West Expressway,
which extends in an Easterly direction from Camp Bowie Boulevard
at Horne Street, and the North-South Expressway, which extends in a
Northerly direction from Seminary Drive are.:hereby designated as
freeways or expressways. The Easterly extent of the East-West
Expressway and the Northerly extent of the North-South Expressway
shall be the paved portions of such freeways or expressways when they
are opened to the public upon completion and designation by the
open
Traffic Engineering Department as being/for vehicle use. The terms
"freeway" and "expressway" shall be used interchangeably and shall include the
entrance and exit lanes leading to and from the through-lanes.
SECTION 2.
That Section 5 of Ordinance No. 2905 be amended to read as follows:
Section 5. No person shall drive or operate a motor vehicle
upon any freeway or expressway, as those terms are used herein, within
the corporate limits of the City of Fort Worth at a greater rate of
speed than fifty-five (55) miles per hour.
SECTION 3,
That Ordinance No. 2905 be amended by adding the following
section:
Section 5a. No person shall drive or operate a motor vehicle
upon any freeway or expressway, as those terms are used herein,
within the corporate limits of the City of Fort Worth at a lesser
rate of speed than forty (40) miles per hour.
SECTION 4.
Any person who shall violate any of the provisions of this
ordinance or any rule or regulation made by the City Traffic Engineer
pursuant thereto shall be guilty of a misdemeanor and, upon conviction
thereof, shall be fined not to exceed One Hundred (4100.00) DOLLARS.
SECTION 5.
This ordinance shall be cumulative of all other ordinances concern-
ing highway traffic in the City of Fort Worth except in those instances
where such ordinances are in conflict herewith, in which instances the
terms of this ordinance shall prevail.
SECTION 6.
Should any section, article, provision or part of this ordinance be
declared to be unconstitutional and void by a court of competent juria-
diction, such decision shall in no way affect the validity of any of
the remaining parts of this ordinance unless the part held unconstitutional
or void is inseparable from and indispensable to the operation of the
remaining parts. The City Council hereby declares that it would have
passed those parts of this ordinance which are valid and omitted any
parts which may be unconstitutional if it had known that such parts were
• unconstitutional at the time of the passage of this ordinance.
SECTION' 7.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage and publication as provided by
lay.
