HomeMy WebLinkAboutContract 37433AMENDMENT NO. 2 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. 433 (M&C Required) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and FCimley-Horn and Associates, Inc., (Engineer) made and entered into City Secretary Contract No. 31878, (the Contract) which was authorized by the City Council by M&C C-20699 on the 3rd day of May 2005 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Water and Sanitary Sewer Extensions for Stonegate and Arborlawn. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the addition- al engineering services specified in MNC C-22971, adopted by the City Council on the 5th day of August 5, 2008, and further amplified in a proposal letter dated May 8, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $248,180.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $740,200.000 t OFFICIAL RECORD CITY SECRETARY FT. Due to the change in the project schedule, the City has requested that Kimley-Horn attend additional coordination meetings for this project. This amendment will add an additional thirty-five coordination meetings for this project. Item 2 (Additional Water and Sanitary Analysis and Design) Due to the coordination with the City and developer, the City requested Kimley- Horn provide additional analysis and design for this project. Kimley-Horn prepared additional updates to the hydraulic model and alternatives to the developer and City participation calculations and exhibits. The City has also requested Kimley-Horn redesign the water and sanitary sewer lines due to the changes in the street alignments. The original sanitary sewer alignment connected into the sanitary sewer line within the Union Pacific Railroad (UPRR) properly. Due to coordination with the UPRR, Tarrant Regional Water District (TRWD), and US Army Corps of Engineers (COE), Kimley-Horn prepared additional alignments within the UPRR property and prepared easements within the TRWD property. This totals a credit of three (3) easements to this contract. Item 4 (Geotechnical Services) Due to the changes in the alignment, Kimley-Horn will provide an additional five (5) bores for this project. Item 5 (Additional Bidding and Construction Phase Services) The original scope of services included preparing one (1) bid package for this project. Based on the revised schedule, Kimley-Horn will provide three separate bid packages for this project. Kimley-Horn will provide the work for the following in accordance with the scope of services in the original contract: ® Preparation of a bidding package as required by the City. ® Reproduction costs for the additional unit and set of bidding documents required by the City. ® Pre -construction assistance for the additional unit and set of bidding documents required by the City. ® Construction phase services for the additional unit and set of bidding documents required by the City. Scope of Services The scope of services for this amendment is divided into the following tasks: Item 1 (Coordination Meetings): $21,700 (Water $9,700 Sewer $12,000) ® Task 1—Kimley-Horn has attended twenty coordination meetings from April 3, 2006 through January 30, 2008. Kimley-Horn was responsible for preparing the meeting agenda and meeting notes. $12,400 ® Task 2 —Upon request of the City, Kimley-Horn will attend fifteen additional coordination meetings for this project. Kimley-Horn will be responsible for preparing the meeting agenda and meeting notes. Projected Fee $9,300 Mr. Liam Conlon, May 8, 2008, Page 3 Item 2 (Additional Water and Sewer Analysis and Design): $183,000 Kimley-Horn (Water $31,500 Sewer $151,500) ® Task 1—Kimley-HoIII has provided two (2) updates to the hydraulic model due to changes in the water line alignments and sizes. $17,700 ® Task 2 —Kimley-Horn has provided the City and Developer with five (5) Developer participation calculations and alignment alternatives and is anticipating preparing one additional set of calculation and alignments for the final agreement. $33,800 ® Task 3 —Kimley-Horn has prepared two (2) alignments of the proposed water and sanitary sewer line at the Stonegate Blvd. crossing of SH- 121 T. The City has requested Kimley-Horn to prepare an additional alignment to determine the impacts of two Oncor transmission lines on the proposed and future water and sanitary sewer alignments. $11,500 ® Task 4 —The City has requested Kimley-Horn redesign 7,600 LF of sanitary sewer line along Stonegate Blvd. $68,400 ® Task 5 —The original design did not include the design of a sanitary sewer siphon. Due to the final alignment, Kimley-Horn will design a three pipe siphon and manhole structures. $13,900 ® Task 6 — To obtain the UPRR conceptual approval of the water and sanitary sewer alignments with the UPRR property, Kimley-Horn prepared three (3) additional alignments of the sanitary sewer line. $129200 ® Task 7 —The original sanitary sewer alignment did not have the proposed sanitary sewer line located within the Tarrant Regional Water Districts (TRWD) property. Kimley-Horn prepared the required easements and coordinated with the TRWD and COE concerning this sanitary sewer line. $12,900 ® Task 8 —The TRWD and COE are planning to install a future levee along the Clearfork Trinity River. Kimley-Horn coordinated with the TRWD, COE, and their consultant concerning the future levee. $5,500 ® Task 9 —Upon the request of the City, Kimley-Horn will prepare Future Sanitary Sewer Alignment Study for the Stonegate area. $7,100 Mr. Liam Conlon, May 8, 2008, Page 4 Item 3 (Survey and Easements): ($21700) Survey ($ 270) 10% Sub Fee ($2,970) Total (Water ($4,600) Sewer $1,630) • Task 1—Credit survey for 1,000 LF along SH-121Trfght-of--wa07 from Arborlawn south to the existing 24-inch water line. Survey for 1,000 LF from the Stonegate Bridge through the proposed development to Clearfork Main Street. All survey will be provided in accordance with the current scope of services for this contract. $0 • Task 2 —Credit of three easements from within the Edwards Geren property. ($2,700) Item 4 (Geotechnical Services): $8,500 Geotechnical $ 85010% Sub Fee $9,350 Total (Water $0 Sewer $9,350) • Task 1—Perform geotechnical services for five (5) bores for the revised alignment. All geotechnical services will be provided in accordance with the current scope of services for this contract. $8,500 Item 5 (Additional Bidding and Construction Phase Services): $46,000 KI�A $ 1,000 Reproduction Expenses $ 10010% Sub Fee $37,100 Total (Water $18,100 Sewer $19,000) • Task 1—Preparation of two (2) additional bidding packages for Stonegate Phase IIB and Clearfork. $5,900 o Included in this task is the design work required for preparing an additional bidding package, including: preparing an additional set of construction plans and specifications, quality assurance and quality control, preparing engineer's opinion of probable construction cost, as well as additional submittal and approval time with City staff. • Task 2 —Reproduction costs for the additional units and set of bidding documents required by the City. $1,000 o The City has instructed Kimley-Horn to prepare bidding and construction contract documents. Bidding and contract documents will be prepared in accordance with the current scope of services with the exception of conceptual plans. Mr. Liam Conlon, May 8, 2008, Page 5 ® Task 3 — Pre -construction assistance for the additional sets of bidding documents required by the City. $6,700 o This task includes preparation and delivery of addenda to plan holders and responses to questions submitted to the DOE by prospective bidders. Also included is attending the scheduled pre -bid conference, assisting in reviewing the bids for completeness and accuracy, attending the project bid opening, developing bid tabulations in hard copy and electronic format, and submitting four (4) copies of the bid tabulation. ® Task 4 —Construction phase services for the additional sets of bidding documents required by the City. $23,400 o The additional set of bidding documents will require additional construction services. Kimley-Horn will perform the shop drawing reviews and construction period observations. We recommend that the City increase the budget by $248,180 for these additional services. The amount we will be subcontracting is $32,800. This represents an M/WBE participation percentage of 13.2% for these additional services. With these Additional Services, our revised contract amount will be $740,200. This will revise our total contract M/WBE participation from $70,355 (14.3%) to $103,155 (13.9%). The water and sewer design fees for this amendment are $54,700 and $193,480 respectively. Our revised project water and sewer design fees will be $276,340 and $463,860 respectively. The City has also directed Kimley-Horn to determine the additional services that were caused by the developer changing the alignments of Clearfork Main Street and Edwards Ranch Road. Attached is a fee breakdown that shows the developer's responsibility for each task. This breakdown is based on the additional services after the developer notified the City of the alignment changes on September 28, 2007 and is for $119,800, The developer's changes also cause additional services to Kimley-Horn's Hulen to Como project. The additional services include the redesign of 1,000 LF of 36- inch water line and determining the alignment of the future 36-inch water line through the development totaling $21,100 for the Hulen to Como project. The total developer participation for the Stonegate and Hulen to Como projects is $1409900. We appreciate the opportunity to be of continued service to the City. DISCUSSION: 9n May 3, 2905, (M&C C-20899) the City Council authorized an engineering agreement with Kimley-Horn and Associates, Inc., in the amount of $397,580.00 for the design of water and sanitary sewer extensions for Stonegate and Arborlawn. The agreement was subsequently revised by one previous amendment (M&C C-21209, December 20, 2005) in the amount of $94,440.00 that provided for an hydraulic analysis of the water and sanitary sewer improvements necessary to accommodate projected development within the Stonegate and Arborlawn areas. In addition, the amendment provided for an alignment study for a future sanitary sewer main interceptor through Stonegate and Arborlawn area to serve the western sector of the City. Amendment No. 2 will provide compensation for the following: . Design of a public sewer line along Stonegate Boulevard; . The preparation of two alternate water and sanitary sewer alignments of the Stonegate Boulevard crossing of State Highway 121T; . Revisions to the hydraulic model as requested by the Water Department due to changes in the water line alignment and sizes; . The preparation of several alternate water and sanitary sewer alignments across Union Pacific Railroad property and private property adjacent to the State Highway 121 Tright-of--way; . The preparation of additional easements for the installation of a sanitary sewer main on Tarrant Regional Water District property; . KiIII ley -Horn and Associates, Inc., proposes to provide the necessary additional engineering services for a lump sum fee of $248,180,00, City staff considers this amount to be fair and reasonable. Kimley-Horn and Associates, Inc., is in compliance with the City's M/V1/BE Ordinance by committing to 13 percent M/WBE participation on this amendment No. 2. The City's goal on this amendment is 13 percent. This project is located in COUNCIL DISTRICTS 3 and 9, Mapsco 74, 75, 88 and 89.
