THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO, RS Z-
COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc., (Engineer) made and
entered into City Secretary Contract No. 33246, (the Contract) which was authorized by the City Council
by M&C 21249 on the 10 h day of January, 2006; and
WHEREAS, the Contract involves engineering services for the following project:
Construction Management for the Eagle Mountain Water Treatment Plant, Raw Water Pump
Station, Raw Water Intake, and Raw Water Transmission Main
WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an
amended scope of work and revised maximum fee.
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:

Article I, Section A; Scope of services is amended as follows
3.02 Eagle Mountain WTP Contract
• Revise resident engineer time from 24 months to 31 months.
• Revise resident representative time from 21 months to 27 months.
3.07 Amendment No. 1
Delete preparation of Record Drawings

Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to
Engineer for all work and services performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall not exceed the sum of $3,134,770.44,
Engineer acknowledges its commitment to obtain an additiona127.92% M/WBE participation for
this amendment. The Engineer's commitment for the Contract remains unchanged.

Attached please find four copies of Amendment No. 2 to the Eagle Mountain Water
Treatment Plant Construction Management Services Contract (City Secretary Contract
t33246) for execution. This amendment will provide additional Construction
Management Services at the Eagle Mountain Water Treatment Plant required due to the
extended duration of the construction contract.

Department.

Amendment No. 2 - Eagle Mountain Water Treatment Plant
Construction Management Services Contract
Dear Mr. Harder:
We are pleased to submit this scope of services as Amendment No. 2 to the Eagle Mountain Water Treatment Plant
(EMWTP) Construction Services Contract (City Secretary Contract #33246) to provide additional Construction
Management Services needed to complete the project. Amendment No. 1, no M&C Required, executed by City Manager
November 30, 2007, provided part-time Construction Management Services for the McCart Avenue Pump Station and
Ground Storage Tank. At the time this amendment was negotiated it appeared that the EMWTP Construction
Management project would be completed in January 2008 and adequate funds existed ($308,783) in the EMWTP
construction management budget to provide the McCart Avenue Construction Management services with no increase in
fee. Since this amendment was negotiated several issues have come up that have delayed completion of the EMWTP
project. Amendment No. 2 is based on a cost to complete analysis of the EMWTP (complete by June 2008) and the
McCart Avenue project (complete by July 2008). Deletion of some services at the McCart project was also utilized to
reduce the additional cost to the City.
As discussed, we propose to provide the following services:
3.02 Eagle Mountain WTP Contract
• Revise resident engineer time from 24 months to 31 months.
• Revise resident representative time from 21 months to 27 months.
3.07 Amendment No. 1
• Delete preparation of Record Drawings.
The proposed increase in the not -to -exceed ceiling is $250,038. The amendment's proposed M/WBE's participation is
$69,800 or 27.92%. The M/WBE participation includes additional services required for Amendment No. 1 (McCart
Avenue) and Amendment No. 2 (Eagle Mountain WTP additional time).

HEARING:
SUBJECT: Authorize Execution of Amendment No. 2 to City Secretary Contract No. 33249, an
Engineering Agreement with Freese and Nichols, Inc., in the Amount of $250,038.00 for the
Construction Management of the Eagle Mountain Water Treatment Plant Expansion, Raw
Water Pump Station, Raw Water Intake, and Raw Water Transmission Pipeline, Located
Between Eagle Mountain Lake and the Intersection of Boat Club Road and Robertson Road
Including the McCart Street Pump Station
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the
amount of $250,038.00 to an engineering agreement with Freese and Nichols, Inc., City Secretary
Contract No. 33249, for the construction management of the Eagle Mountain Water Treatment Plant
Expansion, Raw Water Pump Station, Raw Water Intake and Raw Water Transmission Pipeline located
between Eagle Mountain Lake and the intersection of Boat Club Road and Robertson Road including
the McCart Street pump station thereby increasing the amount of the contract from $2,884,732.44 to
$3,134,770.44.
DISCUSSION:
On January 10, 2006, (M&C C-21249) City Council authorized the City Manager to execute an
engineering agreement with Freese and Nichols, Inc. (Freese and Nichols), in the amount of
$2,884,732.44 for the Eagle Mountain Water Treatment Plant (EMWTP) Expansion, Raw Water Pump
Station, Raw Water Intake, and Raw Water Transmission Main construction management.
Construction management responsibilities include construction contract administration, inspection, and
testing services for the Eagle Mountain Water Treatment Plant Expansion, Raw Water Pump Station,
Raw Water Intake Improvements, and Raw Water Transmission Pipeline. These construction contracts,
taken together, total approximately $60 million. Final completion has been reached on the Raw Water
Pump Station, Intake, and Pipeline projects. Construction has reached substantial completion on the
Eagle Mountain Plant Expansion, with final completion expected in late May 2008.
On November 30, 2007, the City Manager authorized administrative (no -cost) Amendment No. 1, which
added part time construction management of the McCart Pump Station and Ground Storage Tank to
the Freese and Nichols engineering agreement. At the time of execution of this amendment, it was
anticipated that the Eagle Mountain Water Treatment Plant expansion project would be completed by
February 2008, with unexpended funds available for the part time construction management of the
McCart Pump Station and Ground Storage Tank project. However, due to the delays in completing the
Eagle Mountain Water Treatment Plant project, funding is no longer sufficient to see these two projects
through to final completion.
Amendment No. 2 increases the allowable fee under this engineering agreement as necessary to
provide construction management and inspection through completion for both the Eagle Mountain Plant

and the McCart Pump Station and Ground Storage Tank projects.
This project is located in COUNCIL DISTRICT 7.
Freese and Nichols, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional 30 percent M/WBE participation on this Amendment No. 2. The City's goal on this
amendment is 28 percent.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of
the Water Capital Projects Fund.
