HomeMy WebLinkAboutContract 37391-A2AIvIIENDMENT N0.2 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. � AA (M&C Needed) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Freese &Nichols, Inc., (Engineer) made and entered into City Secretary Contract No. 37391, (the Contract) which was authorized by the City Council by M&C C=22925 on the 15t`' day of July 2008; and WHEREAS, the Contract involves engineering services for the following project: Storm Water Utility Project — East Harvey Avenue Storm Drain System and Burchill Channel, Project No. 00477, DOE No. 5417 WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee, NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in a proposal letter dated April 15, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $55,958.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $26%023.00. 3. These alternatives will be designed on a conceptual level and will require additional analysis for construction. Several modifications will be required to our scope in order to meet the City requests and include the following: l . Develop Infoworks SD model of 500 ft upstream of Beach Street Culvert at file downstream end of Burchill Channel. a. Obtain topographic survey and build a digital ground model (TIN format) for the study area. (See Attached Proposal from GAI) b. The dovr�lstrearn limits of the study will be Rosedale Street to the north and Sycamore Creek to the west. c. Delineate drainage areas and develop ultimate conditions hydrology for additional drainage areas that flow into the study area that were not included in the original Burchill Channel Study. This includes the areas east of Beach Street, south along Mitchell, and west along Maddox. Document methodology with supporting exhibits to be included in the Open Channel Study report format. d. The input hydrograph for the upstream limits of the project will betaken from the hydrology developed for the Burchill Channel Study. e. Develop an Infoworks SD dynamic hydraulic model including approximately 500 ft ofBurchill Channel, the Beach Street Culvert, the storm sewer lateral running south along Beach Street, and a tvo-dimensional (2D) surface for overflow in the project vicinity. f. Obtain the effective hydraulic model of Sycamore Creek and perform a coincidental occurrence analysis to develop asteady-state tailwater condition for the outfall. 'The analysis will be performed according to the City of Fort Worth Storm Water Design Manual (2006) guidelines. g. Provide two (2) proposed alternatives to convey existing floodwaters at the intersection of Mitchell and Maddox. h. Perform a geomorphic field assessment of Burchill Channel at 200 foot intervals including: a. Sampling of bed and bank material for a sieve analysis. Perform sieve and weight analysis based on samples collected. b. Geology of the reach assessed including rock type, bedding, degree of weathering and thickness of alluvial soils. Bank stability and degree of existing erosion will be determined. c. Bed and bank material evaluation and calculation, equilibrium slope calculation and reach survey channel geometry calculations. These calculations allows for data plots to best indicate the trends for material moving average. This will analyze the channel bottom width, channel top width and active channel depth versus the moving average. d. Recommendations for improvements as well as possible adverse channel effects of proposed alternatives 3. Perform a Level "A" SUE in two (2) alleys located along the proposed storm sewer at E. Davis Avenue. This proposal is based on information obtained from your email exhibit dated 4/14/09. Introduction G&AI will perform the SUE work required for this project in general accordance with the recommended practices and procedures described in ASCE Publication C/ASCE 3&02 (Standard Guidelines for the Collection and Depiction of Existing Subsurface Utility Data). As described in the publication, four levels have been established to describe the quality of utility location and attribute information used on plans. The four quality levels are as follows: • Quality Level D (QL"D") —Information derived from existing utility records; • Quality Level C (QL"C") - QL"D" informatian supplemented with information obtained by surveying visible above -ground utility features such as valves, hydrants, meters, manhole covers, etc. • Quality Level B (QL"B") — Two-dimensional (x,y) information obtained through the application and interpretation of non-destructive surface geophysical methods. Also known as "designating" this quality level provides the horizontal position of subsurface utilities within approximately one foot. • Quality Level A (QL"A") — Three dimensional (x,y,z) utility information obtained utilizing non-destructive vacuum excavation equipment to expose utilities at critical points which are then tied down by surveying. Also known as "locating", this quality level provides precise horizontal and vertical positioning of utilities within approximately 0.05 feet. It is the responsibility of the SUE provider to perform duediligence with regard to records research (QL "D") and acquisition of available utility records. The due -diligence provided for this project will consist of visually inspecting the work area for evidence of utilities and reviewing the available utility record information. Utilities that are not identified through these efforts will be here forth referred to as "unknown" utilities. However, G&AI is not responsible for designating and locating these "unknown" utilities. Scoot= of Work Based on information provided by Freese and Nichols, Inc. (F&N), G&AI has developed a preliminary scope for the SUE work required for this project. The scope of work may be modified, with F&N's concurrence, during the performance of the SUE fieldwork if warranted by actual field findings. The scope of this proposal includes Quality Level "A" test holes located where the proposed storm drain line "A" will cross the existing sanitary sewer lines (line "A" stationing is 1+78 and 5+10). As requested, the test holes for this projecE will be surveyed. Locatins Procedures G&AI will utilize its utility designating marks and the proposed utility alignments to layout the test hole locations. GAI will establish routine/ordinary traffic control (signs, cones) whenever required as part of our standard pricing. If non -routine traffic control measures are required (flagman, arrowboard, barricades, etc.), these services will be considered extra and will be invoiced at our cost. G&AI will attempt to place the test holes outside of paved areas wherever possible. G&AI will utilize non-destructive vacuum excavation equipment to excavate test holes at the required locations. Once each utility is located, GAI will record the utility type, size, material, depth to top, and general direction. Each test hole will be assigned a unique ID number and will be marked with rebar/cap, nail/disk, or chiseled X, as appropriate. The test hole ID number and other pertinent utility information will be placed at each test hole location. If agreed upon, a 44nch diameter PVC pipe will be placed in each test hole for safety. If not, the excavation will be backf lied with appropriate material and the original surface will be restored. The backfill will be compacted in lifts by mechanical means to prevent future settlement. Deliverables G&AI will prepare a test holes summary sheet along with the horizontal and vertical survey data. G&AI estimates that the locating, can be completed in one (1) day. Test hole summary sheet along with the survey data can be prepared and delivered within three (3) days after completion of the field work. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. On October 16, 2007, (Ordinance No. 17840-10-2007) City Council authorized the issuance and sale of $25,000,000.00 in Storm Water (Drainage) Revenue Bonds, Series 2007, to fund a two year Storm Water Capital project program. Home flooding has been reported in the area of East Harvey Avenue and early investigations have identified a collapsed and under -sized storm drain running between properties. In addition, the City also has identified the need to perform a comprehensive study of the Burchill Channel. A request for qualifications to provide drainage design was issued by the City in January of 2006. Twenty- fourdesign consultants submitted statements of qualifications, including Freese &Nichols, Inc. Freese &Nichols, Inc., was selected to study the drainage in the subject area and provide subsequent design services for drainage improvements. On July 15, 2008, the City Council authorized the City Manager to execute an engineering agreement with Freese &Nichols, Inc. (City Secretary Contract No. 37391) in the amount of $197,077.00 for the design of the East Harvey Avenue storm drain improvements and a study of the Burchill Channel. On January 12, 2009, the City Manager administratively executed Amendment No. 1 to expand the scope to include the now standard Open Channel Study scope of services. The amount of amendment No. 1 was $15,988.00. During the development of the preliminary plans for East Harvey Avenue Storm Drain Improvement Logname: 20AMEND2EASTHARVEY Page 1 of 2 Design and the Burchill Channel Study, it was identified that additional scope was required. Amendment No. 2 will provide for Level A Subsurface Utility Engineering (SUE) in the existing alleys for the East Harvey Avenue Storm Drain and additional modeling upstream and downstream of the originally identified section of the Burchill Channel, requiring more survey, hydrological and hydraulic calculations, and a geomorphic field assessment of the channel. Freese &Nichols, Inc., proposes to perform the additional services included in Amendment No. 2 for a lump sum fee of $55,958.00. City staff considers the fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $5,596.00 is required for project management by the Transportation and Public Works Department. Freese &Nichols, Inc., is in compliance with the City's M/UVBE Ordinance by committing to 32 percent M/WBE participation. The City's goal on the project is 16 percent. This project is located in COUNCIL DISTRICT 8, Mapsco 77P and 78N.
