ORDINANGE NO.
AN ORDINANCE PROVIDING THAT NOTICE BE GIVEN TO THE
QUALIFIED VOTERS OF THE CITY OF FORT ?,.ORTH, TEXAS,
THAT THE CITY COUNCIL ItTILL, AFTEtR. THE EXPIRATION OF
TWENTY (20) DAYS FROM THE FIRST DATE THAT THIS NOTICE
IS PUBLISHED IN SOME NEWSPAPER PUBLISHED IN SAID CITY,
ADOPT AN ORDINANCE IN COMPLIANCE WITH THE PROVISIONS
OF ARTICLES 1166, 1170 AND 1171 OF VERNON'S CIVIL STA-
TUTES OF THE STATE, AND OTHER APPLICABLE LAWS, ORDER-
ING A SPECIAL HOME-RULE ELECTION IN SAID CITY FOR THE
PURPOSE OF SUBUT—WO CERTAIN PROPOSED AMENDMENTS TO
THE CHARTER Or SAID CITY, AMONG THEM BEING AMENDMENTS
PROVIDING FOR LEVYING A TAX ON ALL SALARIES, WAGES,
COMMISSIONS AND OTHER CaelENSATION EARNED BY RESIDENTS
OF THE CITY; ON ALL SALARIES, WAGES, COMMISSIONS AND
OTHER COMPENSATION EARNED BY NON-RESIDENTS FOR WHICH
WORK. IS DONE OR SERVICES PERFORMED OR RENDERED IN THE
CITY; ON NET PROFITS EARNED FROM BUSINESSES, PROFES-
SIONS AND OTHER ACTIVITIES CONDUCTED BY RESIDENTS AND
NON-RESIDENTS; ON NET PROFITS EARNED BY CORPORATIONS
HAVING AN OFFICE OR PLACE'OF BUSINESS IN THE CITY AS
A RESULT OF VIORK DOTE OR SERVICES PERFORMED OR RENDERED
IN THE CITY BY RESIDENTS OR NON-RESIDENTS; AND AN AMEND-
MENT PROVIDING FOR AN INCREASE IN THE TAX LEVY LIMIT
IMPOSED IN SECTION 23, CHAPTER XXVIII OF THE CITY CHAR-
TER AND PROVIDING FOR THE SUBMISSION OF SUCH OTHER AND
ADDITIONAL AMENDMENTS AS MAY BE DEEMED APPROPRIATE AND
NECESSARY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION I.
That in accordance with the provisions of Articles 1166, 1170 and
1171 of Vernon's Civil Statutes of Texas and other applicable laws, the
following notice be given to the "qualified voters of the City of Fort Worth,
Texas:
TO THE LEGALLY QUALIFIED VOTERS OF THE CITY OF FORT WORTH,
TEXAS, AND TO ALL OTHER PERSONS WHOM THESE PRESENTS MAY
CONCERN:
Notice is hereby given that after the expiration of
twenty (20) days from the first date that this notice is pub-
lished in some newspaper of said City, it is the intention of
the City Council to pass an ordinance containing certain pro-
posed amendments to the Charter of the City of Fort Worth,
Texas, which amendments are to be submitted at a special home-
rule election in accordance with the provisions of Articles
1166, 1170 and 1171 of Vernon's Civil Statutes of Texas and
other applicable laws.
SECTION II.
That at such special home-rule election there shall be submitted the
said proposed amendments to be contained in the ordinance for adoption or
rejection by the qualified voters in said City.
SECTION III.
That .some of the proposed amendments which will be considered by the
said City Council to be incorporated in said ordinance submitting the same
are described as follows:
Shall Chapter XXV of the Charter of the City of Fort Worth
be amended by adding thereto. Section 37, reading as follows:
The City Council is authorized each year, when adopting the
appropriation ordinance, to levy a tax, to provide funds for the
purposes of the retirement of certain debts, general municipal
operations, deferred maintenance and capital improvements, on
all salaries, wages, commissions and other compensation earned
by residents of the City of Fort Worth; on all salaries, wages,
commissions and other compensation earned by nonresidents of
the City of Fort Worth for work done or services performed or
rendered in the City of Fort Worth; on the net profits earned
on all businesses, professions or other activities conducted
by residents of the City of Fort Worth; on the net profits
earned on all businesses, professions or other activities con-
ducted in the City of Fort Worth by nonresidents; and on the
net profits earned by all corporations having an office or place
of business in the City of Fort Worth as the result of work
done or services performed or rendered in the City of Fort Worth;
to require the filing of returns.and the furnishing of informa-
tion by employers and all those subject to said tax; to impose
on employers the duty of collecting the tax at the source and
paying the same to the City of Fort Worth; to provide for the
administration, collection and enforcement of said tax; to
authorize the imposition of penalties for the violation of the
ordinance creating the tax; to provide that said tax shall not
exceed the rate of one per cent (1%); and to provide that not
less than fifty per cent (50%) of the above tax paid by the
property owner shall be allowed as a credit on all ad valorem
taxes paid by the taxpayer on property located in the City of
Fort Worth?
AMENDMENT II.
Shall Section 23, Chapter XXVIII of the existing Charter
of the City of Fort Worth, be amended and, after being amended,
read as follows:
Each year when the City Council adopts the appropriation
ordinance and determines the amount of the tax levy for general
municipal purposes, it shall never levy a tax for all municipal
purposes in excess of Two and 20/100 Dollars ($2.20) on each
One Hundred Dollar (8100.00) valuation of property subject to
taxation situated within the City of Fort Worth?
SECTION IV.
That such other and additional proposed amendments will be considered
and submitted as to the City Council may be deemed appropriate.
SECTION V.
That the City Secretary is directed to publish this notice for ten
(10) days in a newspaper published in the City of Fort Worth, in accordance
with the provisions of Article 1171 of Vernon's Civil Statutes of Texas, the
Charter of the City of Fort Worth and all other applicable laws.
The above and foregoing ordinance was duly passed and adopted by the
City Council on Friday, the day of , 1958.
