AN ORDINANCE AMENDING ORDINANCE NO. 3769, AN AMEND- MENT TO THE PLUMBING CODE OF THE CITY OF FORT WORTH, TEXAS, BY AMENDING SECTION 1 THEREOF REGULATING GAS AND LIQUID HEATING UNITS; DECLARING THAT THIS ORDI- NANCE SHAIX BE CUMULATIVE OF ALL OTHER ORDINANCES; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3769, being an ordinance amending Ordinance No. 3271, being the Plumbing Code of the City of Fort Worth, be, and it is hereby amended so that said Ordinance No. 3769 and the final provision of Paragraph 14-3(a) of said Plumbing Code shall read as follows: Suspended radiant gas-fired heaters that have a ceramic mat burner that are approved and installed according to A. G. A. and Underwriters Laboratory as unvented heaters may be used in commercial and industrial buildings not more than one story in height and constructed of steel and covered with corrugated me- tal and reinforced concrete, and in other buildings as approved by, and in conformity with, A. G. A. and Underwriters Labora- tory specifications as to clearance from combustible materials. Such heaters shall be installed in such buildings at a height of not less than eight feet above the floor of the room or rooms in which they are installed and shall have adequate ventilation at least equivalent to a minimum of fifty square inches of roof ventilator area for each 100,000 B. T. U. of gas input to each heater so installed. The ventilator or ventilators for each such heater shall be installed in the highest point of the roof of the building in which such heater is installed. SECTION 2. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth except in those instances where such ordinances are in conflict herewith, in which instances the terms of this ordinance shall prevail. SECTION 3. Any person who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not to exceed Two Hundred Dollars ($200.00). SECTION 4. Should any section, article, provision or part of this ordinance be declared to be unconstitutional and void by a court of competent jurisdic- tion, such decision shall in no way affect the validity of any of the remain- ing parts of this ordinance unless the part held unconstitutional or void is inseparable from and indispensable to the operation of the remaining parts. The City Council hereby declares that it would have passed those parts of this ordinance which are valid and omitted any parts which may be unconstitutional if it had Down that such parts were unconstitutional at the time of the passage of this ordinance. SECTION 5- This ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as provided by law.
