ORDINANCE NO. 1 ' / ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF STALCUP ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTHY TEXAS; DECLARING THE CONTRACT WITH W.E. BRITTAIN. INC. FOR THE CONSTRUCTION CF SAID IMPROVIENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAIN3T SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with W_E_ Hrittain� Ina. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: STALCUP ROAD: From East RosedaleAvenue to the West Section of Ramey Avenue, known and designated as Unit No. 1. FiHEREAS,'by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 5161 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5161 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of t he. portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: Ilk. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as _part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort ?North, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. E. Brittain, Inc. Contract Awarded: March 30, 1964 (M&C C-270) Work Order Issued: June 22, 1964 Date of Final Inspection and Approval: November 30, 1964 Working Time Bid: 45 Working Days Working Time Used: 44 Working Days Project Cost and Financing Bid Price: $68,437.02 Final Contract Cost: $68,171.86 Partial Payments Previously Made: 4 Amount: $61,934.07 Final Payment` Due: $6,237.79 Payment to be Made From Project No. : 094-22000-124 "Stalcup Road" Deviation from Bid Price: Bid Price $68,437.02 Contract Prick 68,171.86 Under-run $ 265.16 Variation between estimated and measured quantities account for the difference between contract price and conttact cost. Compliance with Specifications Attached is a tabulation showing the results of test corings to determine paving depth thickness. Some tests revealed marginal compliance to asphalt paving and base depth requirements. At one location where there was a grade differential at an intersecting street, the core test showed no base material. The contractor removed the surface material, lowered the sub-grade, added base, and replaced the 7.5 inch asphalt surface. Surface deficiencies in excess of construction tolerances were corrected as follows. DATE REFERENCE SUBJECT: Final Payment, Widening and PAGE 1-25-65 NUMBER FP-183 Improvements of Stalcup Road from Ramey 2 of 2 to Rosedale, Project No- 094-22000-194- 1) An area 36 feet by 610 feet was overlaid with 1 inch asphalt surface over the entire width of the roadway to minimize bad appearance and roughness which would have been caused by : patchwork to correct deficiencies detected in three out of four adjacent corings.. 2) An area 10 feet by 10 feet was excavated, the base lowered, and 7.5 asphalt surface was replaced. Tests showed that the sub-base, base and pavement material was used in compliance with specifications. Recommendation It is recommended that the above project be accepted by adoption of an ordinance and that final payment of $6,237.79 be authorized to W. E. Brittain, Inc.
