COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Alan Plummer Associates, Inc.
(Engineer) made and entered into City Secretary Contract No. 37547 (the Contract)
which was authorized by the City Council by M&C C-22998 on the 26th day of August,
2008; and
WHEREAS, the Contract involves engineering services for the following project:
Village Creek Reclaimed Water Deliver�ystem Design
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
specified in a proposal letter dated December 2, 2009, a copy of which is attached hereto
and incorporated herein. The cost to City for the additional services to be performed by
Engineer total $570,000.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed
the sum of $2,375,486. oe
3.
All other provisions of the contract, which are not expressly amended herein, shall
remain in full force and effect.

The following is a clarification of the tasks that the ENGINEER will perform under Bid and Construction
Administration phase services. Four projects are planned, one pump station and three pipeline projects.
The original contract did not include Bid or Construction Administration phase services.
Upon receipt of Notice to Proceed, the ENGINEER will perform the following tasks:
A. BID PHASE ASSISTANCE — PIl'ELINES PROJECTS !TOTAL OF THREE)
1. Deliver Bid Documents —The ENGINEER will make available for bidding, upon request
by the CITY, up to forty (40) full size sets (per project) of the final approved and dated
plans and specifications and contract documents for distribution to potential bidders. The
nonrefundable deposit received from prospective bidders for receipt of plans, specifications
and contract documents will be retained by the ENGINEER to offset the ENGINEER'S
cost of printing, distributing and handling said documents. Plans will be distributed by and
picked up at engineer's office. Electronic (PDF) format CD's will be available upon
request. Up to eight (8) full size sets will be delivered to plan rooms to be identified by the
CITY. The bid proposal will be delivered to the CITY in electronic format. Assist the
OWNER in securing bids, issuing notice to bidders and notifying construction news
publications for the reclaimed water delivery projects. The notice to bidders will be sent to
local news media for publication and shall be paid for by the OWNER.
2. Bidding Assistance
a. The ENGINEER shall assist the CITY during the bid phase including preparation and
delivery of addenda to planholders and responses to questions by prospective bidders.
b. ENGINEER :shall attend and assist in conducting the scheduled one pre -bid
conference per project.
c. The ENGINEER shall attend the project bid opening and assist in reviewing the bids
for completeness and accuracy.
d. The ENGINEER shall develop and submit bid tabulations in hard copy and electronic
format, and make a recommendation for award.
e. The ENGINEER will conform the construction contracts and bind all addendums
including contractor supplied signature documents incorporating all changes.
f. The above described bidding assistance will be provided for three separate pipeline
construction projects.

B. BID PHASE ASSISTANCE -PUMP STATION PROJECT
1. Deliver Bid Documents — The ENGINEER will make available for bidding, upon request by

C. CONSTRUCTION PHASE ASSISTANCF, —PIPELINES. PROJECTS (TOTAL OF THREE)
1. Assist the CITY in conducting a preconstnaction conference.
2. The ENGINEER will make available for construction, upon request by the CITY, up to
twenty (20) sets of final approved and dated plans and specifications and contract
documents for each pipeline project to the CITY for distribution to the contractor and City
personnel. This will be performed at the request of the CITY.
3. Respond to Request for Information — The ENGINEER will provide necessary
interpretations and clarifications of contract documents and respond to Requests For
Information (RFI) specifically related to those portions of the Contract Documents
designed by the ENGINEER. ENGINEER will respond to up to five (5) RFIs.
4. Evaluations of Contract Modifications —The ENGINEER will review and evaluate up to
four (4) Contract Modification Requests (CMRs), Field Orders, and/or Change Orders
(COs) as prepared and requested by the CONTRACTOR. The ENGINEER shall advise
and consult with CITY, issue instructions to the CITY requested by the CITY, prepare
routine change orders as required, and keep the CITY informed of the progress of the work
as required by the construction contract documents.

5. The CITY will review and approve monthly and final pay estimates submitted by the
contractor.
6. The ENGINEER will make a total of four (4) visits to the construction site if requested by
the City to become familiar with the progress and quality of the construction work and
determine if the results of the construction work are in accordance with the drawings and
the specifications. If the ENGINEER is asked to visit the site more frequently, the
ENGINEER shall be entitled to additional compensation based on personnel time plus
expenses as a part of additional services. The ENGINEER shall not be required to make
continuous daily on -site observations to check the quality or quantity of the construction
work. The ENGINEER shall not be responsible for the construction performance,
programs, or for any safety precautions utilized in connection with the construction work.
The ENGINEER shall not be responsible for the CONTRACTOR's failure to execute the
work in accordance with the construction contract. However, if the ENGINEER observes
construction conditions not in conformance with construction contract documents,
ENGINEER shall have authority to recommend rejection of work which does not conform
to the construction contract documents whenever, in his opinion, ENGINEER considers it
necessary or advisable to insure the proper implementation of the intent of the construction
contract documents in accordance with generally accepted engineering practices. The
ENGINEER shall have the authority to require special inspection or testing of any work in
accordance with the provisions of construction contract documents whether or not such
work is then fabricated, installed, or completed. The ENGINEER shall notify the CITY, in
writing, of any actions taken under this paragraph.
7. Review samples, catalog data, schedules, shop 'drawings; laboratory, shop and mill test
reports or material and equipment and other data which the CONTRACTOR submits. The
ENGINEER will review up to 10 shop drawings and other submittals. This review is for
the benefit of the CITY and covers only general compliance with the information given by
the construction contract documents. It does not relieve the CONTRACTOR of any
responsibility such as dimensions to be confirmed and correlated at the job site, appropriate
safety measures to protect workers and the public, or the necessity to construct a complete
and workable facility in accordance with the construction contract documents.
8. The ENGINEER shall be, in the first instance, the interpreter of the requirements of the
construction contract documents and the impartial judge of the performance thereunder by
both the CITY and the CONTRACTOR. At the written request of the CITY, the
,ENGINEER will be required to make certain interpretations of the contract documents.
These interpretations shall be in the form of written recommendations and conclusions sent
to the appointed representative of the CITY.
9. The ENGINEER shall not be responsible for the acts or omissions of the CONTRACTOR,
or any Subcontractors, or any of the CONTRACTOR's or Subcontractor's agents or
employees, or any other persons performing any of the work on the PROJECT, except
those employees, agents, and Sub Consultants of the ENGINEER.
10. The ENGINEER will attend the final construction wallcthrough and will assist in itemizing
deficiency items and making recommendation of final acceptance. Assist representatives
of the CITY with final inspection of the PROJECT for conformance with the design
concept of the PROJECT and compliance with the construction contract documents, and
approve, in writing, final payment to the CONTRACTOR.

11. The ENGINEER will prepare record data drawings. Drawings will be delivered on a CD in
PDF format as well as one set of 22" x 34" Mylars. One "redline" set will be received from
CONTRACTOR by CITY, reviewed by CITY for completeness, provided to the
ENGINEER, and will provide basis for ENGINEER's preparation of record drawing set.
12. The above scope will be performed for each of three separate construction projects.
13. The ENGINEER will provide up to 60 man-hours of on -site startup assistance.
ENGINEER will visit the site during startup testing to verify the system is operating as
intended and to discuss any operating issues with the City and Contractor.
D. CONSTRUCTION PHASE ASSISTANCE —ENGINEERING SERVICES FOR THE PUMP
STATION PROJECT
1. Assist the CITY in conducting a preconstruction conference.
2. .The ENGINEER will make available for construction, upon request by the CITY, up to
twenty (20) sets of final approved and dated plans and specifications and contract
documents for this project to the CITY for distribution to the contractor and City personnel.
This will be performed at the request of the CITY.
3. The ENGINEER shall make monthly visits (maximum of 12) to the construction site to
become familiar with the progress and quality of the construction work and determine if the
results of the construction work are in accordance with the drawings and the specifications.
If the ENGINEER is asked to visit the site more frequently, the ENGINEER shall be
entitled to additional compensation based on personnel time plus expenses as a part of
Additional Services. The ENGINEER shall not berequired to make full time daily on -site
observations to check the quality or quantity of the construction work. The ENGINEER
shall not be responsible for the construction performance, programs, or for any safety
precautions utilized in connection with the construction work. The ENGINEER shall not
be responsible for the CONTRACTOR's failure to execute the work in accordance with the
construction contract. However, if the ENGINEER observes construction conditions not in

ENGINEER will review up to 45 shop drawings and other submittals. This review is for
the benefit of the CITY and covers only general compliance with the information given by

safety measures to protect workers and the public, or the necessity to construct a complete
and workable facility in accordance with the construction contract documents.

12. Preparation of Operations Manual
The ENGINEER will prepare an Operations Manual for the pump station in electronic
format delivered on CDROM. Specific services to be performed by the ENGINEER will
be to prepare the manual in the format that follows:
a. Prepare and submit to CITY for review a draft of the system Operations Manual.
The following topics will be included:
1) Introduction - Brief statement of manual purpose; description of units and flow
path; summary of permits and standards which must be met; table of design
criteria.
2) Operations Considerations -Discussion of operation theory, control variables,
process control and process efficiency for the treatment facilities.
3) Facilities Description, Operation, and Control of Facilities - Discussion of the
operation and purpose of each treatment unit or facility with a description of
design criteria and control strategy.
4) Description and Operation of the Auxiliary Facilities - Discussion of auxiliary
systems.
5) Electrical System and Control Systems - Overview and detailed description of
the electrical and control systems.
b. ENGINEER will produce and deliver Operations Manuals for the project in
electronic format. The electronic Operations Manual will feature text with data
tables and process schematics. The image database shall include final equipment
Operations Manuals provided by the manufacturer in PDF format and Microsoft
Office Word.
13. The ENGINEER will provide a maximum of 60 man-hours of on -site startup assistance.
ENGINEER will visit the site during startup testing to verify the system is operating as
intended and to discuss any operating issues with the City and Contractor.
14. The pipeline ENGINEER will provide assistance on the construction phase of the pump
station limited pre -construction conference, respond to up to two RFI's, one CMR, four (4)
submittals, pre and final walkthroughs and prepare record drawings.
15. The pipeline ENGINEER will make a total of two (2) site visits to the construction site to
become familiar with the progress and quality of the construction work and determine if the
results of the construction work are in accordance with the drawings and the specifications.
If the ENGINEER is asked to visit the site more frequently, the ENGINEER shall be
entitled to additional compensation based on personnel time plus expenses as a part of

The Construction Manager assigned by the ENGINEER will request necessary interpretations and
clarifications of Contract Documents in the form of RFIs. The Construction Manager will 1)
review change order requests and request necessary clarifications to evaluate and reasonability of
cost; 2) transmit RFIs; 3) maintain RFI and Change Order logs; and 4) make recommendations to
the Owner as to acceptability of the work.
2. Construction Management will consist of activities related to the observation of
construction progl•ess. Inspection activities will be performed by the ENGINEER to assist
the Owner in determining that construction is proceeding in accordance with the Contract
Documents. Construction observation will be on a part-time basis involving a pre.
determined maximum number of site trips, with observations occurring during specific
construction phases or after specific portions of the work are complete.

Construction inspection for surveyor layout staking, clearing and grubbing, and buried
pipe installation will be performed by the CITY. Construction inspection of ballard
installation, walkways, final grading and seeding, painting and coating, and witness base
density test will be by the CITY. Testing services for in -place density, cylinder, slump,
temperature, air entrainment, grout testing, torque testing on structural steel, and NDT
services will be subcontracted separately by the CITY.
A. DESIGN OF PIPELINE THROUGH SLUDGE DRYING BEDS (SDB)
1. The ENGINEER shall perform a Route analysis and evaluation of the proposed 10,390 LF of
pipe from Village Creek Wastewater Treatment Plant (VCWWTP) to south property
boundary thru the southeast corner of the sludge drying beds. The ENGINEER shall conduct
a utility conflict investigation and provide preliminary layout and design Memorandum to the
City.
2. The ENGINEER shall provide the proposed alignment and shall meet with the CITY staff
once to discuss and receive approval on the proposed alignment.
3. The ENGINEER shall provide a detail design of approximate 9,600 LF 16h pipeline from
VCWWTP to South East corner of sludge drying beds, and 790 LF of 6-inch pipeline to the
south property boundary and provide construction drawings for the pipeline.
4. The ENGINEER shall update the Storm Water Pollution Prevention Plan to include the
additional 10,390 LF of pipeline from VCWWTP to southeast corner at sludge drying beds
described above. T
B. REDESIGN PIPELINE TO AVOID CONDEMNATION
1. In order to avoid condemnation approximately 1,600 LF of pipeline must be redesigned to be
in the public right of way. One meeting with the Transportation department is included.
C. REDESIGN AT PIPELINE ROAD CULVERT
1. A design is underway by another firm for amulti-culvert creek crossing on Pipeline Road.
The reclaimed water pipeline was designed to cross on top of the culvert with the
understanding that the culverts would be constructed first. The ENGINEER will redesign the
reclaimed water pipeline to be constructed under the future culverts. Additional two

meetings are included one with the Public Works department and the other with the culvert
design firm.
1. Design the main header to be located above ground.
2. Design structural supports for the header.
3. Design grating to provide access between the pump headers.
E. SURGE TANK DESIGN
1. Change the bidding documents to replace the surge anticipation valve with a surge
tank.
2. Develop a specification for the surge tank and control system.
3. Design structural foundations for the surge tank
4. Modify electrical and mechanical drawings to accommodate the surge tank.
F. ADDITIONAL STORM WATER POLLUTION PREVENTION PLAN (SWPPP)
1. Update the SWPPP to be applicable to the redesign of the pipeline through the Sludge Drying
beds. This includes 10,390 LF of pollution prevention measures.
G. OPERATIONS, MAINTENANCE AND TRAINING PROGRAM DEVELOP_NTFNT
1. Facilitate up to three workshops with City staff to discuss operations and maintenance
procedures for the reclaimed water system. Prepare an operations and maintenance plan for
the system.
2. Assist the City in identifying training requirements for City staff and users of the reclaimed
water system. Assist the City in the development of printed materials or PowerPoint
presentations for use in training City staff and users of the reclaimed water system.
1. Support the City in review and finalization of the reclaimed water ordinance.
2. Assist the City with facilitation of meetings with wholesale customers and/or addressing
questions and concerns from wholesale customers related to operations of the reclaimed
water system.
3. Assist the City in further development of public awareness materials related to the reclaimed
water system.
I. ASSISTANCE FOR ARRA FUNDING APPLICATION
1. For research and meetings with TWDB, filling out applications, copying, and distribution
assistance for ARRA funding for the project.

Additional Services to be performed by the ENGINEER, if authorized by the CITE', which are not
included in the above -described BASIC ENGINEERING SERVICES, may include, but are not limited by
the following. No allowance has been set aside for ADDITIONAL SERVICES.
1. Design or Construction Administration for implementation of USACE Section 404 Permit
Mitigation Plan (individual permit). Preparation of annual compliance monitoring reports
documenting survivability of plantings required for mitigation for five years after
construction completion.
2. Provide expert witness testimony as required for condemnation hearings, including the
preparation of engineering data and reports. Appearing before regulatory agencies or courts
as an expert witness in any litigation with third parties other than condemnation proceedings
arising from the development or construction of the project, including the preparation of
engineering data and reports for assistance to the OWNER.
3. Investigations involving detailed consideration of expenses and material audits or inventories
required for certification of force account construction performed by the OWNER.
4. Provide shop, mill, field or laboratory inspection of materials and equipment. Sampling,
testing or analysis beyond that specifically included in Basic Services.
5. Furnishing full time resident representation as the OWNER's on -site representative during
the construction phase.
6. Assisting the OWNER in claims disputes with Contractor(s).
7. Performing investigations, studies and analyses of substitutions of equipment and/or materials
WA deviations from the Plans and Specifications. Additional Contract Administration Services
including: Pay Estimate Review,
8. Assisting OWNER or Contractor in the defense or prosecution of litigation in connection
with or in addition to those services contemplated by this Agreement. Such services, if any,
shall be furnished by ENGINEER on a fee basis negotiated by the respective parties outside
of and in addition to this Agreement.

9. Attending additional meetings not detailed in the Basic Engineering Services as requested by
OWNER.
10. Providing additional copies of Plans and Specifications.
11.. Any additional services, which may be required by the OWNER for completion of the project
that are not included in the Basic Services or Special Services.
12. Additional Factory test witnessing including pumps and motor. Retesting of any equipment
that fails the factory test. Additional time on -site for startup. Programming of the PLCs or
DCS.
13. Preparation of pre -purchase documents in addition to the technical specifications.

14. Construction management services for the pump station including the following, unless
otherwise identified in Basic Services:
a. Site visits and trip reports during construction,
b. Attending and/or conducting and documenting monthly progress meetings.
c. Monitoring of the schedule.
d. Managing, tracking, and independent review or documentation for additional RFIs,
requests for change orders, shop drawings, and payment requests, beyond what is listed
in basic services.
e. Weekly progress reports to the City.
f. Witness of concrete, soils and hydrostatic testing.
g. Witness startup testing and document results.
15. Factory witness testing of the pumps and motor by the Engineer.
16. SCADA programming by Engineer for the pump station controls. Program the Temporary
PLC and operator interface terminal for complete operation of the pump station. Provide
coordination with the remote monitoring site. Assist in startup of the pump station and the
remote monitoring site.
17. The following Construction Management activities:
a. Additional trips and material testing services beyond the maximum number stipulated in
the Construction Management section of the Scope of Services.
b. Services required beyond the anticipated twelve (12) month project schedule from the
Contractor's Notice to Proceed until Final Inspection,

Authorize Amendment No.1 in the Amount of $570,000.00 to City Secretary Contract No. 37547, an
Engineering Agreement with Alan Plummer Associates, Inc., for the Design of the Village Creek Reclaimed
Water Delivery System (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No.l in the
amount of $570,000.00 to City Secretary Contract No. 37547 an Engineering Agreement with Alan Plummer
Associates, Inc., for the Village Creek Reclaimed Water Delivery System Design, thereby increasing the
Contract cost to $2,375,486.00.
DISCUSSION:
On August 26, 2008, (M&C C-22998) the City Council authorized the execution of an Engineering
Agreement (Agreement) with Alan Plummer Associates, Inc., in the amount of $1,805,486.00, for the design
of the Village Creek Reclaimed Water Delivery System consisting of a reclaimed water pump station at the
Village Creek Wastewater Treatment Plant (VCWWTP) and a reclaimed water main from the VCWWTP site
to the DFW Airport and a connecting reclaimed water main from the proposed Fort Worth reclaimed water
main to the City of Arlington. Also included was assistance in easement preparation and acquisition and
preparation a reclaimed water rate analysis to establish reclaimed water rates, assist in development of
Reclaimed Water Contract and assist in permitting and regulatory compliance.
Amendment No.1 is split into two parts due to funding. The first phase is eligible for Texas Water
Development Board (TWDB) Drinking Water State Revolving Fund —American Reinvestment and Recovery
Act of 2009 (DWSRF—ARRA) Funding, which consists of construction phase services, including submittal
review and technical support, for all four construction projects (Reclaim Pump Station, Water Distribution
Main Parts 1, 2, 3 and 4) and construction administration and part—time resident inspection for the pump
station project. This cost is $285,903.00.
The second phase, which is not eligible for DWSRF—ARRA funding, includes re —design work for
realignment from Green Oaks Boulevard to the Village Creek sludge drying beds, realignment for easement
acquisition, pipeline redesign for Pipeline Road as proposed culvert structure may not be installed before
pipeline installation and a hydraulic analysis which determined that a surge tank was required at the pump
station. In addition, the engineer provided assistance in the DWSRF—ARRA application process. The total
cost for this work is $284,097.00.
Alan Plummer Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional 51 percent M/WBE participation on this Amendment No. 1. The City's goal on this amendment is
39 percent.
This project is located in COUNCIL DISTRICT 5.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds are available in the current capital budgets,
as appropriated, of the Sewer Capital Projects Fund and the ARRA 2009 SFR Reclaim Water Fund,
