WHEREAS, the City of Fort Worth (City) and Alan Plummer Associates, Inc. (Engineer)
made and entered into City Secretary Contract No. 37547 (the Contract) which was authorized
by the City Council by M&C C-22998 on the 26th day of August, 2008; and
WHEREAS, the Contract involves engineering services for the following project:
Village Creek Reclaimed Water Deliver�ystem Design
WHEREAS, it has become necessary to execute Amendment No. 5 to said Contract to
include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the Contract:

Article I of the Contract is amended to include the additional engineering services and
costs in the amount of $219,813.00 as specified in "Attachment A" dated January 10, 2012 and
'Attachment B", both attached hereto and incorporated herein.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not exceed the sum of $3,228,712.00.
3.
All other provisions of the contract, which are not expressly amended herein, shall
remain in full force and effect.

ADDITIONAL CONSTRUCTION ADMINISTRATION PHASE SERVICES
SCOPE OF SERVICES
JANUARY 10, 2012
The following is a clarification of the tasks that the ENGINEER will perform under ATTACHMENT A. The
project includes additional construction administration phase services related to five construction
contracts as follows: Pump Station No, 1, Pipeline Sections I and IV, Pipeline Section II, Pipeline Section
111, and the Water Quality Improvements Projects.
BASIC ENGINEERING SERVICES
A. CONSTRUCTION PHASE SERVICES
1. Provide an additional nine (9) months Field Administration Services. These additional
services are needed to construction delays and additional documentation work required to
comply with TWDB requests. Additional work included in this task includes the following.
a. Additional meetings with TWDB staff.
b. Coordination with the contractors on contracts for Parts 14 and the Pump Station to
address issues related to project documentation required by the TWDB.
c. Re -organization of the documentation after construction move of the documentation.
d. Confirmation of State required documentation, in order to comply with changes
requested by the TWDB inspector.
e. Modifications to the Buy -American documentation as requested by the TWDB
inspector, including requests for additional documentation, contacting supply vendors
for product specification, cross referencing with submittals and schedule of values
and reformatting of Buy American logs.
f. Modification of the Davis Bacon documentation and re -organization to comply with
changes requested by TWDB inspector.
g. Additional work related to closing -out the contracts. This work includes coordinating
with the TWDB, prime consultant, contractors and City staff.
2. Provide additional construction engineering services related to the Reclaimed Water Pump
Station and Water Quality Improvements Projects. These additional services are needed due
to construction delays and additional assistance needed during start-up of the system.
Additional work included in this task includes the following.
a. Review additional shop drawings including coordination meetings with Trojan on
design of the UV tank.
b. Attend additional construction coordination meetings, address questions and general
administration during the extended construction time.
c. Coordination of passivation of the UV tank.
d. Additional project management related to extended ARRA requirements and
9 months of project extensions,

e. Attend additional monthly engineering coordination meetings.
f. Assist the Contractor with start-up operations and troubleshooting of pumps and
meters.
g. Assist the plant operators with start-up operations and troubleshooting of the
reclaimed water system.
h. Assist the Contractor with start-up operations and troubleshooting of the controls and
chlorination system.
i. Visit the site monthly during the extended construction period and update the
punchlist.
j. Assist the Contractor with organizing and assembling the O&M manuals to help close
out the project. Provide additional reviews of the O&M manuals as needed to
complete the documents.
k. Design new power metering systems at the pump station and UV system.
I. Design modifications to the buried portion of the 3&inch UV discharge pipe to
accommodate an electrical ductbank located in a different location than shown on the
record drawings.
m. Evaluate moving the UV system VFDs to a secondary location.
n. Design structural modification to the pipeline support needed to accommodate
differing wall elevations than shown on the record drawings.
o. Revise the UV pumps controls narrative to accommodate updated UV system
operations.
p. Additional site visits and meetings and correspondence for the additional construction
duration of 9 months.
q. Review pay=apps and assist with close out documents during the extended
construction period.
r. Additional services related to multiple updates to the pump station operations
manual.
3. Provide additional construction management services related to the Reclaimed Water
Pump Station and Water Quality Improvements Projects. These additional services are
needed due to construction delays.
a. Provide field visits and labor interviews needed for the Davis -Bacon documentation
required by the TWDB.
b. Provide site visits as needed during the extended construction period.
c. Provide construction management services during the extended construction period.
4. Provide additional assistance for pipeline construction administration due to design and
coordination for multiple PCMs on four construction contracts.
ADDITIONAL SERVICES
Additional Services to be formed by the ENGINEER, if authorized by the CITY, which are not included in
the above -described Basic Services, may include, but are not limited by the following. No allowance has
been set aside for Additional Services,

COMPENSATION
JANUARY 10, 2012
Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $219,813 as summarized
in Exhibit B-1 — Engineer Invoice. The total lump sum fee shall be considered full
compensation for the services described Attachment A, including all labor materials,
supplies, and equipment necessary to deliver the services.
B. The ENGINEER shall be paid monthly payments as described in Section II —Method of
Payment.
IL Method of Payment
A. Partial payment shall be made to the ENGINEER monthly upon City's approval of an
invoice prepared and submitted by the ENGINEER,
B. The estimated current physical percent complete as required on the invoice shall be
calculated from the progress schedule.
C. The cumulative sum of such monthly partial fee payments shall not exceed the total
current project budget including all approved Amendments.
D. Each invoice shall be verified as to its accuracy and compliance with the terms of this
Agreement by an officer of the ENGINEER.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the Water
Department monthly progress reports in the format required by the City.

SUBJECT: Authorize Execution of Amendment No. 5 to City Secretary Contract No. 37547 with Alan

Creek Reclaimed Water Delivery System for a Total Contract in the Amount of
$3,228,712.00 (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 5 to City
Secretary Contract No. 37547, an engineering Agreement with Alan Plummer Associates, Inc., for the
Village Creek Reclaimed Water Delivery System Design, in the amount of $219,813.00, thereby
increasing the contract cost to $3,228,712.00.
DISCUSSION:
On August 26, 2008, (M&C C-22998) the City Council authorized the execution of an Engineering
Agreement with Alan Plummer Associates, Inc., for the design of the Village Creek Reclaimed Water
Delivery System consisting of a reclaimed water pump station at the Village Creek Wastewater
Treatment Plant (VCWWTP) and a reclaimed water main from the VCWWTP site to the DFW Airport
and a connecting reclaimed water main to the City of Arlington. Also included was assistance in
easement preparation and acquisition and preparation of a reclaimed water rate analysis to establish
reclaimed water rates, assist in development of Reclaimed Water Contract, and assist in permitting
and regulatory compliance.
Amendment No.1, (M&C C-24046) approved on January 26, 2010, included additional design work
for the reclaim pump station, assistance in the Texas Water Development Board (TWDB) Drinking
Water State Revolving Fund -American Reinvestment and Recovery Act of 2009 (DWSRF/ARRA)
application process, and construction phase services, including submittal review and technical
support, for all four construction projects (Reclaim Pump Station, Water Distribution Main Part 1 and
4, Part 2, and Part 3) and construction administration and part-time resident inspection for the pump
station project.
Amendment No. 2, (M&C C-24218) approved on May 11, 2010, included additional submittal review
for all four construction projects (Reclaim Pump Station, Water Distribution Main Part 1 and 4, Part 2,
and Part 3) not anticipated before start of construction. In addition, afull-time field Administrative
Technician was added to provide support for all four contracts to meet TWDB DWSRF/ARRA
documentation and certification requirements and prevent the City from losing a part or all of its
DWSRF-ARRA funding.
Amendment No. 3, (M&C C-24365) approved on July 27, 2010, included the design of the in -plant
water system pump station, an in -channel type ultraviolet (UV) disinfection system and associated
piping to the reclaimed water pump station with associated modifications to the reclaimed water pump
station.
Amendment No. 4, (M&C C-24676) approved on January 4, 2011, covered the additional design

engineering and construction administration and management services related to all five contracts
and additional bid phase requirements for construction administration and management services
related to UV system contract, and reclaimed water program operation assistance.
This proposed Amendment No. 5 includes an additional nine months of construction administration to
meet TWDB DWSRF/ARRA documentation and certification requirements and TWDB Inspection
Reviews as the Part 2 Contractor (WR Hodgson) went bankrupt requiring coordination with the
Bonding Company to hire a second contractor which extended completion of the over-all
project. Also, additional design is required for the UV System during construction and additional
assistance to the plant staff is required in starting up new UV system and getting into operation.
Alan Plummer Associates, Inc., agrees to maintain its initial M/WBE commitment of 38 percent that it
made on the original Agreement and extend and maintain that same M/WBE commitment of 38
percent to all prior amendments up to and inclusive of this Amendment No. 5. Therefore, Alan
Plummer Associates, Inc., remains in compliance with the City's M/WBE Ordinance and attests to its
commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by
an authorized representative of its company.
This project is located in COUNCIL DISTRICT 5.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, in the Sewer Capital Projects Fund.
