AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $694,175.50 AND THE
SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $74,492.58 FROM A WATER
AND SEWER OPERATING FUND TRANSFER, FOR THE PURPOSE OF EXECUTING A
CONTRACT WITH STABILE & WINN, INC. FOR PAVEMENT RECONSTRUCTION AND
WATER AND SANITARY SEWER MAIN AND REPLACEMENT ON PORTIONS OF
BOMAR AVENUE, CARTER, AVENUE, HARWOOD STREET AND WILKINSON AVENUE
(CITY PROJECT NO. 00300); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $694,175.50 and the Sewer Capital Projects Fund in the
amount of $74,492.58 from a Water and Sewer Operating Fund transfer, for the purpose of executing a
contract with Stabile & Winn, Inc. for pavement reconstruction and water and sanitary sewer main
replacement on portions of Bomar Avenue, Carter Avenue, Harwood Street, and Wilkinson Avenue (City
Project No. 00300).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Contract with Stabile & Winn, Inc., for Pavement Reconstruction and Water
and Sanitary Sewer Main Replacement on Portions of Bomar Avenue, Carter Avenue, Harwood
Street and Wilkinson Avenue (Project No. 00300) and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $ 768,668.08 from the Water and Sewer Operating Fund to the Water Capital
Project Fund in the amount of $694,175.50 and Sewer Capital Project Fund in the amount of $74,492.58;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $ 694,175.50 and the Sewer Capital Project Fund in the
amount of $74,492.58, from available funds; and
3. Authorize the City Manager to execute a contract with Stabile & Winn, Inc., in the amount of
$2,056,146.50 for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Bomar
Avenue (Beach Street to Harwood Street and Harwood Street to Barron Street), Carter Avenue (Beach
Street to Harwood Street and Harwood Street to Sanborn Street), Harwood Street (Scott Avenue to
Meadowbrook Drive and Meadowbrook Drive to Purington Avenue and Wilkinson Avenue (Beach Street to
Harwood Street).
DISCUSSION:
On January 10, 2006, (M&C C-21242) the City Council authorized the City Manager to execute an
engineering agreement with A.N.A. Consultants, L.L.C., for pavement reconstruction and water and
sanitary sewer main replacement on portions of Bomar Avenue, Carter Avenue, Harwood Street and
Wilkinson Avenue (DOE - 5139).
The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on all streets
mentioned above. Street improvements include pavement reconstruction, construction of standard
concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans.
The Water Department has determined that severely deteriorated water and sanitary sewer lines should be
replaced prior to street reconstruction.
The project was advertised on December 14, 2006, and December 21, 2006. On January 11, 2007, the
following bids were received:

The new pavement will consist of 7-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete
curb.
Funding in the amount of $65,412.08 is included for associated water and sewer construction survey,
project management, pre-construction, material testing, inspection and project close out (water $58,624.50
and sewer $6,787.58). The contingency funds to cover change orders total $31,000.00 (water $25,000.00
and sewer $6,000.00).
Funding in the amount of $181,924.48 is required for associated paving and drainage construction survey,
project management, pre-construction, material testing, inspection and project close out. Contingency for
pavement reconstruction is $41,516.72.
Stabile & Winn, Inc., is in compliance with the City's M/WBE Ordinance by committing to 4 percent M/WBE
participation and documenting good faith effort on this combined project. Stabile & Winn, Inc., identified
several subcontracting opportunities. However, the M/WBEs contacted in the areas identified did not
respond or did not submit the lowest bids. The City's goal on this combined project is 25 percent.
This project is located in COUNCIL DISTRICT 8, Mapsco 77A, 78A, B and 78E.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of
the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
