COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Carter &Burgess, Inc. (Engineer)
made and entered into City Secretary Contract No. 34414 (the Contract) which was
authorized by the City Council by M&C C-21662 on the 14th day of November, 20069,
and
WHEREAS, the Contract involves engineering services for the following project:
Senders Ranch Pump Station and Ground Storage Tank Construction
Management
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
specified in a proposal letter dated June 30, zuva, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services to be performed by
Engineer total $32,460.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed
the sum of $353,100.00
3.
All other provisions of the contract, which are not expressly amended herein, shall
remain in full force and effect.

Dear Ms. Goderya:
The purpose of this letter is to summarize our request for Amendment No. 2 for the Senders Ranch
Pump Station and Ground Storage Tank Construction Management project. We are requesting this
amendment for compensation of additional scope activities.
Carter &Burgess, Inc. (C&B) was awarded the Senders Ranch Pump Station and Ground Storage
Tank Construction Management on November 14, 2006. The original contract was awarded for
$258,640. On March 14, 2008 we received Amendment No. 1 for additional services related to
additional geotechnical testing and three additional months of construction administration and part-time
construction representation. The additional cost for Amendment No. 1 was $62,000, bringing the total
contract value to $320,640.
Additional Effort Performed to Date
During the original budgeting effort, costs were calculated for the required geotechnical and materials
testing that would be required for the project. These budget efforts were calculated based on the
number of proposed tests for the construction and on a rate schedule provided by our subconsultant
Mas4ek Engineering (a certified minority business). Due to additional testing required for the pre-
stressed concrete tank, the original proposed budget of $20,340 was modified to a total not4o-exceed
budget of $47,340. All material testing has now been completed and the last invoice has been paid to
Mas4ek. The actual cost for these services was $37,924.50. As a result, there is $9,415.50 remaining
in the overall budget that can be allocated to other areas.
The original scope and fee assumed a 12 month schedule for construction. Amendment No. 1 added 3
months of additional time to the overall schedule for the project, which provided services until
December, 2007. Due to delays in the incoming power, the project is estimated to be complete at the
end of June. As a result, we have 6 additional months of construction administration and coordination.
This was 3 months of additional monthly meetings, 6 additional pay estimates and project coordination
time with both the contractor and City staff including start-up of the pump station. As a result, we are
requesting=ate-a"tionat-$46-�7-QO be added to the contract.

Carter & Burgess, Inc. is also performing on -site construction representation for an average of
approximately 24 hours a week for the duration of the contract, or as required by field activities. Since
we are at the end of the project and field work has been decreasing and our time has been limited to
key activities. For an additional 3 months of construction, we are requesting an additional $10,000 to
cover the cost of on -site construction representation.
Finally, our subconsultant Multatech which consisted of all the architectural, electrical and plumbing
services has also requested additional fees to cover the additional site meetings, site visits, requests for
information and coordination for the extended 9 months of the construction contract. Multatech has
requested $15,175,50 to cover these services. The original contract with Multatech was $40,000. This
request would increase their contract to $55,175.50.
A summary of the additional effort that should be included in this amendment is provided below:
• Completion of geotechnical testing required (MWBE)
• Six months of additional construction administration services $ 16,700.00
• Six months of additional on -site construction representation $ 10,000000
• Additional construction administration services Multatech $ 157175.50
Total Effort Additional Effort Required $ 32,460.00
Our total requested budget for Amendment No. 1 is $32,460.00. This would increase the authorized
budget for the project to $353,100.00. The original MWBE participation goal was 18%. The original
contract for this project was $258,640.00 and the original contract included $60,340.00 for MWBE firms,
meeting the participation goal with 23% participation. For amendment 2, the geotechnical testing
performed by Mas-tek, a MWBE firm, was reduced by <$9,415.50>. However, our MWBE
subconsultant, Multatech requested $15,175.50 in additional compensation for construction
administration services. The MWBE participation represents 18% of the total proposed amendment
and will finalize the total MWBE commitment for the overall contract at 26%. The totals for the contract
and our MWBE participation are outlined in Attachment A.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in
the amount of $32,460.00 to City Secretary Contract No. 34414, an Engineering Agreement with Carter
and Burgess, Inc., for Construction Management of Sendera Ranch Pump Station and Ground Storage
Tank (City Project No. 00376) thereby increasing the contract amount to $353,100.
DISCUSSION:
On November 14, 2006, (M&C C-21846) the City Council authorized execution of an Engineering
Agreement with Carter and Burgess, Inc., for Construction Management services during the
construction of the Sendera Ranch Pump Station and Ground Storage Tank for $258,640.
Amendment No. 1 (M&C C-22622), authorized on January 15, 2008, included additional construction
phase services related to geotechnical testing, three additional months of construction administration
and part time construction representation.
This Amendment No. 2 compensates the Engineer for additional services related to delays in incoming
power and six additional months of construction administration and representation.
This project is located on John Day Road in Sendera Development (zoned MU-2), Denton County,
COUNCIL DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget as appropriated, of
the Water Capital Projects Fund.
