AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $442,370 FROM A
WATER AND SEWER FUND TRANSFER, FOR THE PURPOSE OF EXECUTING
AMENDMENT NO. 1 TO CITY CONTRACT NO. 33944, A COMMUNITY FACILITIES
AGREEMENT WITH ONE SR, L.P., SENDERA RANCH, LTD., AND TWO SR, L. P., FOR
THE INSTALLATION OF THE NORTHSIDE II 42-INCH APPROACH WATER MAIN;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 and
in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in
the Water Capital Projects Fund in the amount of $442,370 from a Water and Sewer Fund transfer, for
the purpose of executing Amendment No. 1 to City Contract No. 33944, A Community Facilities
Agreement with One SR, L.P., Sendera Ranch, LTD., and Two SR, L. P., for the installation of the
Northside II 42-inch Approach Water Main.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Amendment No. 1 to City Contract No. 33944, a Community Facilities
Agreement With One SR, L.P., Senders Ranch, LTD., and Two SR, L.P., for the Installation of the
Northside II 42-inch Approach Water Main and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $442,370 from the Water and Sewer Operating Fund to the Water Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $442,370, from available funds; and
3. Authorize the City Manager to execute Amendment No. 1 to City Contract No. 33944, a Community
Facilities Agreement with One SR, L.P., Sendera Ranch, LTD., and Two SR, L.P., in the amount of
$442,370 for the installation of the Northside II 42-inch Approach Water Main.
DISCUSSION:
On September 15, 1998, (M&C C-16994) the City Council authorized the execution of a Developer's
Agreement (City Secretary No, 24319) to provide adequate water around the Alliance Airport area
including areas to the west of Alliance Airport. On December 11, 2001, (M&C C-18878) the City Council
authorized the execution of a Development Agreement for Sendera Ranch, which provided for the
construction of a 36-inch water main to the proposed Sendera Ranch development for water
service. Current water studies are showing that the rapid growth in this area could result in water
shortages as early as the summer of 2007, if additional water supply facilities are not installed as identified
in the current Water Master Plan (2004). On November 15, 2005, (M&C C-21159) the City Council
authorized the execution of a Community Facilities Agreement for the design of the Sendera Ranch Pump
Station and Ground Storage Tank, the Northside II 42-inch Approach Water Main and the Northside III
Water Main.
The proposed 42-inch Northside II approach water main will connect the existing 48-inch water line in the
Alliance Airport area to a proposed Sendera Ranch Pump Station -and five million gallon (MG) ground
storage tank in the Sendera Ranch development.
On September 5, 2006, (M&C C-21659) the City Council authorized the City Manager to execute a
Community Facilities Agreement with One SR, L. P., Sendera Ranch, LTD., and Two SR, L.P., for the
installation of the Northside II 42-inch Approach Water Main. This Community Facilities Agreement
represents the collective effort of the Water Department and the Developers (Sendera Ranch, Senders
East) and Hillwood Development under separate CFA, to address the future water demand.

During construction, staff determined that it was necessary to replace a section of existing 30-inch pipe
with 42-inch pipe and a conflict was discovered between the proposed 42-inch water main and a previously
unknown electric duct bank. Change Order No. 1 to the developer's construction contract will allow for the
replacement of a segment of an existing 30-inch water main on Westport Parkway with a 42-inch pipe to
help reduce water velocities in this portion of the water main system. This change order will also provide
for the construction of a temporary pavement for high volume truck traffic on Westport Parkway during
construction.
Change Order No. 2 to the developer's construction contract will allow the pipe elevation to be lowered 4
feet for a distance of 600 linear feet in rock because during the bore process under Intermodel Parkway,
an underground communication conduit was encountered at a depth well over the anticipated depth.
The Developer's contractor, S.J. Louis Construction of Texas, LTD., LLP, (S.J. Louis) proposes to perform
the additional construction work for $202,967. Staff considers this amount to be fair and reasonable and
after approval of this amendment; two change orders will be executed between the City, Developer and
S.J. Louis for the additional improvements.
The Developer's Agreement (City Secretary No. 24319) for water service around Alliance Airport and areas
to the west included the area between the BNSF Intermodel yard and proposed FM-156 as part of the
Northside II pressure plane with service from a proposed 42-inch water main. Recent detailed studies
show that this area is actually within the Northside III pressure plane and should be served from a water
main within that pressure plane. In light of this information, staff proposes to adjust the participation
amounts to reflect a decrease in the Northside II participation for the Developer (Hillwood). The change
more specifically involves providing an 8-inch water main rather than the 12-inch that was previously
approved to provide fire protection. A future CFA will address Hillwood's participation in Northside III water
mains to serve the area between BNSF and proposed FM-156.
The cost differences for the Northside II 42-inch Approach Water Main between the approved CFA and the
amended CFA for the developer and the City are shown below.

*Hillwood participation is by reimbursement (separate agreement) to the City of Fort Worth and is part of
the overall City cost within this CFA in accordance with Community Facilities Agreement C-16994 between
Hillwood Development Company and the City of Fort Worth. Under this agreement Hillwood agreed to pay

40 percent of a Northside II water main for 30-inch size east of proposed FM 156 and the cost of a 8-inch
(reduced from 12-inch) west of the proposed FM 156 to the BNSF Intermodel yard. The revised amount
will be $1,084,207.
The development is located in COUNCIL DISTRICTS 2 and 7.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water Capital Projects Fund.
