AND ALLOWED AGAINST SOME' OF SAID ASSESSMITNTS; DIRLCTING THE CI ' SECR TAR Y TO ENGROSS AND MIROLL THIS OFFDI7ANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOB OF THr, CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AND EFFECTIVE DATE. WMEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with S. R. 0. Asphalt, Inc. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit; 1. GYPSY GULCH- From Timberline Drive to Fairway Drive, known and designated as Unit No. 1, a one and one-half inch hot-mix asphalt concrete surface on a seven inch cement stabilized gravel base on a thirty-foot roadway. 2. EASTLAND AVENUE: From Edgewood Terrace to Village Creek Road, known and designated as Unit No. 2, a one and one-half inch hot-mix asphalt concrete surface on a seven inch cement stabilized gravel base on a forty-foot roadway. 3. KNOX S From Erath Street to Shackleford Street, known and designated as Unit No. 3, a one and one-half inch hot-mix asphalt concrete surface on a seven Inch cement stabilized gravel base, on a thirty- foot roadway. 4. CHILDRESS STREET- From Prath Street to Shackleford Street, known and designated as Unit No. 4. a one and one- half inch hot-mix asphalt concrete surface on a seven-inch cement stabilized gravel base on a thirty-foot roadway. 5. ALGERITA STREET: From Shackleford Street to Brookline Avenue, known and designated as Unit No. 6, a one and one-half inch hot-mix asphalt concrete surface on a seven inch cement stabilized gravel base on a thirty-foot roadway. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 5086 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEILZAS, the City Council of the City of Fort Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5086 , and 'A MEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TH—E-FORE, BE IT ORDAI77-34D BY Tli.: CITY COUNCIL OF TH1 CITY OF FORT WORTH, TVXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, toEether with the names of the owners of ss.id property, the principal amou t of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: Ilk. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the dete of its passage. Council action on the project described below is requested: Project Description: Name: Assessment Paving on the Southeast Side Contractor: S.R.O. Asphalt, Inc. Contract Awarded: December 5, 1963 (M&C C-197) Work Order Issued: January 31 , 1964 Date of Final Inspection and Approval : July 2, 1964 Working Time Bid: 69 Working Days Working Time Used: 46 Working Days Project Cost and Financing: Bid Price: $54,282.30 Final Contract Cost: $49,251 .58 Partial Payments Previously Made: 4 Amount: $39, 133.71 Final Payment Due: $10, 117.87 Payment to be Made from Project No. : 097-24000-117 Deviation from Bid Price: Variation between estimated and measured quantities of asphalt surface and base, installation of curb and gutter, and road gravel primarily accounts for the difference between contract price and contract cost. Compliance With Specifications: Attached is a tabulation of paving test cores showing results of depth thickness. Test cores were made of the cement stabilized base and asphalt surface after construction. As shown on the core test report, some depth thickness of the asphalt showed marginal compliance to surface depth requirements. Based on additional cores taken, areas where the hot-mix asphaltic concrete surface were found dificierit in excess of 1/4 inch in thickness were removed and replaced to specified plan thickness as shown on the core tabulations. Tests showed that the sub-base, base,- and pavement material used was in compliance with specifications. Recommended Council Action: 1) That the above project be accepted by adoption of an ordinance. 2) That final payment of $10, 117.87 be authorized to S.R.O. Asphalt, Inc.
