ORDINANCE N0. ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF MARGARET STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH ILW. GIBBINS, INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS— MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAIi3 T SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with R.W. GIBBINS, INC. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. MARGARET STREET: From E1 Campo Avenue to Collinwood Avenue, known and designated as Unit No. 1. 2. LO M AVENUE: From Eldridge Street to Sanguinst Street, known and designated as Unit No. 2. 3. LIBBY AVENUE: From Bourine Street to Hervie Street, known and designated as Unit No. 3. 4. BOURINE STREET: From Blackmore Avenue to Libby Avenue, known and designated as Unit No. 4. 5. GARLAND AVENUE: From Lackland Road to Sappington Place, known and designated as Unit No. 5. 6. GARLAND A.M'ME: From Sappington Place to Olive Place, known and designated as Unit No. 6. 7. GARLAND AVENUE: From Tea Boulevard to Maryls Lane, known and designated as Unit No. 7. 8. MARY'S LANE: From Greenway Road to Garland Avenue, known and designated as Unit No. 8. 9. EL IZABETH LANE: From Lackland Road to 410 feet west, known and designated as Unit No. 9. 10. ELDRIDGE STREET: From Lovell Avenue to Locke Avenue, known and designated as Unit No. 10. WHEREAS,-by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 3307 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the Uity of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5307 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary, is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: lit. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in fall force and effect from and after the date of its passage. Compliance With Specifications Attached is a tabulation of paving test cores which were made of the gravel base and the asphalt pavement after construction. As shown on the core tests reports, some depth thickness of the asphalt showed marginal compliance to depth requirements. Based on addi- tional cores taken, areas where the hot-mix asphaltic pavement was found deficient in excess of one-half inch thickness were overlaid with hot-mi.x asphalt to specified plan thickness as shown on the core tabulations. The tests show compliance with specifications within acceptable con- struction tolerances. Eight corings were made with the following results: Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 5 1 2 0 Base 6 2 0 0 The eight pavement cores averaged 1.62 inches as compared to 1.50 inches specified and the eight base cores averaged 7.30 inches as compared to 7.00 inches specified. Tests made during construction of sub-base, base and pavement show that the material used was in compliance with specifi- cations. In order to isolate deficient areas on Locke, Libby, Garland and Eliza- beth Lane, 51 additional cores were made at contractor's expense. Recommended Council Action It is recommended that the above project be accepted by adoption of an ordinance and that final payment of $10,029.07 be authorized to R. W. Gibbins, Inc.
