HomeMy WebLinkAboutOrdinance 6117 ORDINANCE NO. 6 /11 AN ORDINANCE PROVIDING THAT THE NORTH THIRTY-SEVEN (37) FEET OF THE PUBLIC RIGHT OF WAY ABUTTING THE SOUTH PROPERTY LINE OF BLOCK 2, BROADMOOR ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BETWEEN FRANCIS STREET AND BROADMOOR DRIVE, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the north thirty-seven (37) feet of the public right of way abutting the south property line of Block 2, Broadmoor Addition to the City of Fort Worth, Tarrant County, Texas, be- tween Francis Street and Broadmoor Drive, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except that a utility easement is retained in the vacated right of way. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said public right of way is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. B'I.:DATE REFERENCE SUBJECT: Vacation of Service Road, PAGE �/9/69 NUMBER 8100 Block Hwy. 80 West 1 of 1 GRA HAM PZ-336 V-69-14 REED HIU r°'Mr. Charles Weissenborn, agent, with written consent of all adjoining property owners has requested the City to vacate a portion of the U. S. Hwy. 80 West Service Street right-of-way. The area requested to be vacated is the north 37 feet of right-of-way abutting the south property line of Block 2, Broadmoor Addition between Francis Street and Broadmoor Drive as shown on the attached map. The subject right-of-way, acquired by dedication, is 500 feet in length and partially paved (100 feet) . The existing 212 feet right-of-way is much greater than is needed since the opening of I-20, and the remaining 175 feet is all that will be required in the future. The new right-of-way line will conform with the new right-of-way line created by vacation of the service road adjacent to Western Hills Addition. City departments and private utility companies have reviewed this request and have no objection to this vacation, provided the applicant plats the vacated right-of-way with adjoining properties and retains the vacated right-of-way as a utility easement. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested, subject to the conditions recommended above by the City departments and private utility companies. The applicant has submitted a replat which incorporates the condi- tions requested by the City Plan Commission. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission. HDM:ms Attachs.
