WHEREAS, the City of Fort Worth (City) and Wade Trim, Inc.,
(Engineer) made and entered into City Secretary Contract No.
37641, (the Contract) which was authorized administratively by the
City Manager on the 24th day of September 2008; and
WHEREAS, the Contract involves engineering services for the
following project.
Storm Water Utility Project - Lockwood Court Drainage
Improvements, Project No. 01069: DOE No. 6004
WHEREAS, it has become necessary to execute Amendment No. 1
to said Contract to include an increased scope of work and revised
max1mum fee,
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract.
1.
Article I, of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated September 1, 2009, copies of which are both attached hereto
and incorporated herein. The cost to City for the additional
services to be performed by Engineer total $17,820.00,

Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $42,770.00.

All other provisions of the Contract, which are not expressly
amended herein shall remain in full force and effect.

Dear Mr. Owen,
Per your request, this amendment revises the previously approved Stomp Water Utility
Project, City Secretary Contract No. 37641 for the storm water study of Lochwood Court.
Specifically, this amendment includes the provision for additional Design Level Survey,
Subsurface Utility Engineering — Level "B" (including the use of Ground Penetrating
Radar), and Studies for specific portions of the project. This work is to be included with
and will support the storm water evaluations and preliminary cost preparation associated
with the original contract. This work is being performed to better determine the location
of underground utilities that are located in close proximity with the planned
improvements. More detailed information on the requirements for relocation or upgrade
of these utilities will allow for an improved construction cost estimate.
The specific work to be included is as follows:
• Additional survey as shown on Exhibit A to locate utility appurtenance
such as manhole lids, valves, etc. This work will include a topographic
survey to support the design.
• Perform a subsurface utility exploration by use of ground penetrating
radar as requested by Steve Eubanks.
• Modification to our study, proposed improvement plan, and preliminary
construction cost based upon new information obtained.
• Administration, Project Management and Coordination of the additional
work

Authorize Amendment No. 1 in the Amount of $17,820.00 to City Secretary Contract No. 37641 an
Engineering Agreement with Wade Trim, Inc., for the Storm Water Utility Project – Lochwood Court
Drainage Improvements
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in the
amount of $17,820.00 to City Secretary Contract No. 37641 with Wade Trim, Inc., for the Storm Water
Utility Project – Lochwood Court Drainage Improvements thereby revising the total contract cost to
$42,770.00.
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams,
minimize water pollution and to operate the storm water system in a more effective manner to fully comply
with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction
and system maintenance, master planning, enhanced development review and increased public education and
outreach. (Project No. 01069)
On October 16, 2007, (Ordinance No. 17840-10-2007) the City Council authorized the issuance and sale of
$25,000,000.00 in Storm Water (Drainage) Revenue Bonds, Series 2007, to fund a two year Storm Water
Capital project program.
The need for drainage improvements on Lochwood Court was identified All to home flooding in the area.
Wade Trim, Inc., was selected to study the drainage in the subject area and provide subsequent design
services far drainage improvements.
On September 24, 2008, the City Manager executed administratively anEnginee ring Agreement with Wade
Trim, Inc., for the study of Lochwood Court. It is anticipated that the study project will be expanded to a
design project.
The purpose of the study is to evaluate the existing conditions, identify the required drainage improvements
and to identify a clear design scope of work and estimate of construction costs for identified improvements.
Amendment No. 1 will provide additional survey, Level B subsurface utility engineering and updates to the
original study report.
Wade Trim, Inc., proposes to perform the additional study services for a lump sum fee of $17,820.00. City
staff considers the fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $1,782.00 is required for project management by the Transportation and
Public Works Department.
WadeTrim, Inc., is in compliance with the City 's M/WBE Ordinance by committing to 33 percent M/WBE
participation on the overall contract. This amendment revises the previously approved Storm Water Utility
Project — Lochwood Court Drainage Study. The cost of the study does not exceed the $25,000.00 M/WBE
requirement nor does Amendment No. 1 exceed the $50,000.00 M/WBE amendment requirement.
This project is located in COUNCIL DISTRICT 7, Mapsco 32N.

The Financial Management Services Director certifies that funds are available in the current capital budget,
