AMENDMENT TO ENGINEERING CONTRACT

WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc., (Engineer) made
and entered into City Secretary Contract No. 33120 (the Contract) which was authorized by the
City Council on the 1 Oth day of January, 2006; and
WHEREAS, the Contract involves engineering services for the following project:
Central Arlington Heights Storm Drairi Watershed Planning Study (Phase 2) City Project
No. 00080
WHEREAS, it has become necessary to amend said Contract to include an increased
scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the Contract.
1.
Article I, Section A, Scope of services is amended to include the additional engineering
services specified in a proposal letter dated July 15, 2008, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services to be performed by Engineer is
$314,9250
2.
Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not exceed the sum of $503,925..
3.
Engineer acknowledges its commitment to obtain an additional 23% M/WBE
participation for this amendment. The Engineer's commitment for the Contract remains
unchanged.
4.
All other provisions of the Contract which are not expressly amended herein shall remain
in full force and effect.

ATTACHMENT A
CENTRAL ARLINGTON HEIGHTS STORM DRAIN WATERSHED PLANNING STUDY
PHASE 3

SCOPE OF WORK
BASIC SERVICES
Task 1. Conversion to InfoWorks
1.1 Convert the database of the system inventory, and the hydrologic and hydraulic
SWMM models of the existing conditions and Alternatives 1, 3, and 3A
developed during Phase 2 to Wallingford Is InfoWorks SD software. Add the
information from the TV inspection to the Wallingford database.
1.2 Using information from as built plans add the following portions of the storm drain
system and corresponding watershed drainage areas to the converted InfoWorks
models.
• Laterals east of Hulen Street
• Lateral in the alley between Ashland and Tremont, north of Bryce Street
• Lateral in Bell Street, north of the intersection with Interstate 30.
1.3 Validate the InfoWorks SD model with up to two previous storm events using
available historical rainfall data, reports of flooding, and observed water marks.
1.4 Execute the existing conditions model for the 100-year storm. Map flood prone
areasI identify those structures subject to inundation. Estimate average annual
damages due to flooding under existing conditions
Task 2. Improvement Alternatives
2.1 In consultation with City staff, formulate modifications of three alternatives from
the previous study to include upper watershed schematic improvements and
seven additional improvement alternatives that would provide 100-year flood
protection to structures, for a total of ten alternatives. These alternatives are:
• Options 1, 2, and 3; Three modifications of the proposed alternatives of
Phase 2 to include upstream watershed improvements.
• Option 4; Selective buy out of properties to excavate a channel or a series of
small ponds.

• Option 5: Consider upstream improvements without downstream
improvements.
• Option 6: Deep detention alternative around the intersection of Hulen and
Bryce.
• Option 7: Update the alternative of a large detention pond around flood prone
areas proposed by Dunaway Associates in 2003.
• Options 8, 9, and 10: Three combinations of the options outlined above
considering input from value engineering consultant, providing structure
protection only and/or phasing plan of recommended option.
2.2 For the selected alternatives, develop a hydrologic and hydraulic model with
InfoWorks SD. Determine the adequate size of the system to provide 100-year
flood protection to structures. If deemed cost effective, inundation of a few
structures may be possible as long as the alternative considers a buy out of
those properties subject to inundation.
2.3 Prepare an opinion of probable construction costs for each improvement
alternative. Prepare an exhibit for each improvement alternative.
2.4 For two selected improvement alternatives, perform acost-benefit analysis. The
analysis shall follow guidelines and use default parameters from FEMA's BCA
software.
Task 3. Tunnel Feasibility
Perform a tunnel feasibility study following the scope shown in Exhibit A-1. Freese and
Nichols will enter into Subconsultant agreements with Jenny Engineering Corporation
and MasTek for this task. The methodology and results of this tunnel feasibility will be
reviewed by HNTB. FNI shall be responsible for coordinating with both parties to verify
they are provided information to complete their respective tasks.
Task 4. Meetings
4.1 Hold up to five meetings with City staff throughout the course of the study to
discuss results of the conversion to InfoWorks SD, formulation of proposed
alternatives, results, and recommendation.
4.2 Attend up to two meetings to present goals and results to City Council, public, or
other stakeholders.
Task 5. Deliverables and Report
5.1 Prepare a draft report that includes the methodology used for the formulation and
analysis of s#orm drainage improvement alternatives, results, opinion of probable
construction cost, and recommendations. Report will include an exhibit for each
alternative. Deliver 3 hard copies of the draft report to the City for review.

5.2 Based on City review and comments, prepare a final report.
5.3 Deliver 5 hard copies and one electronic version of the final report to the City.
Electronic deliverable shall include the final report, exhibits, InfoWorks SD
modeling files, and applicable GIS layers and maps.
Task 6. Value Engineering Report
Prepare three (3) copies of the report and other backup project technical information
and provide to the value engineering consultant hired by the City. In addition, FNI will
prepare, attend and present at a value engineering meeting which will include other
consultants, City staff, and the City's value engineering consultant. It is assumed the
preparation for this one meeting will include a PowerPoint presentation and project
boards. The timing of this value engineering study will be assumed to occur after
completion of the known alternatives and prior to starting the 3 unknown alternatives
such that input from this value engineering activity can be incorporated into these new
alternatives. It is further assumed the other already completed alternatives will not be
altered from this meeting's feedback.
SPECIAL SERVICES
Assistance with Public Relations
As requested by City staff, prepare additional presentation material about this study that
would facilitate communications with the public. This material may include color maps,
handouts, PowerPoint presentations, or graphics to be posted in the City's website.

RECOMMENDATION:
in the Amount of $314,925.00 to City Secretary Contract
for the Central Arlington Heights Storm Drain Watershed
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in the
amount of $314,925.00 to City Secretary Contract No. 33120, to an engineering agreement with Freese
and Nichols, Inc., for the Central Arlington Heights Storm Drain Watershed Planning Study for a total
contract price of $503,925.00.
DISCUSSION:
The initial Watershed Planning Study performed by Freese &Nichols, Inc., in the Central Arlington Heights
watershed documented severe structural and capacity der"iciencies in the existing storm drain system. Four
different improvement alternatives were investigated, with solutions costing up to $49,000,000.00. Staff has
determined that additional alternatives should be developed and evaluated in order to determine the best
course of action to provide flooding relief within a reasonable budget and without causing excessive
disruption to the neighborhood.
Freese and Nichols, Inc., proposes to evaluate up to ten design alternatives for drainage improvements in
this storm drain system. Also included are conversion of the hydraulic model to more stable modeling
program, developing the hydraulic model for sections of storm drain not previously studied, performing a
detailed tunneling alignment and feasibility study, and presenting selected alternatives to a value
engineering analysis to be conducted by an independent consultant. The results of the study will include a
detailed improvement plan suitable for implementation in one or more capital projects.
Freese and Nichols, Inc., proposes to perform the study for a lump sum fee of $314,925.00. City staff
considers this fee to be fair and reasonable for the scope of services proposed. Phases 1 and 2 were paid
for through 2004 CIP funding. Storm Water Utility funds will be used to implement Phase 3 of the study.
Freese and Nichols, Inc., is in compliance with the City's M/UVBE Ordinance by committing to 23 percent
M/WBE participation on this Amendment No. 1. The Gity's goal on this amendment is 23 percent.
This project is located in COUNCIL DISTRICT 7.
