AN ORDINANCE AMENDING ORDINANCE NO. 1717, SAME BE-
ING AN ORDINANCE GRANTING THE ST. LOUIS, SAN FRAN-
CISCO AND TEXAS RAILWAY COMPANY THE RIGHT TO CON-
STRUCT, MAINTAIN, OPERATE AND REPAIR A CERTAIN SPUR
TRACK IN, ON AND ACROSS CERTAIN PORTIONS OF STAYTON
STREET, WEST BROADWAY AVENUE, WEST DAGGETT AVENUE,
JEROME STREET, WEST JARVIS STREET AND NORTH STREET
IN THE CITY OF FORT WORTH, TEXAS, BY ADDING THERETO
SECTION I(a); PROVIDING FOR INDEMNITY AGAINST CLAIMS
AND DAMAGES IN THE ENJOYMENT OF SAID EASEMENT; RE-
PEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1,,
That Ordinance No. 1717, adopted by the City Council on the loth day
of April, 1931, be amended by adding thereto Section I(a), which shall
read as follows:
SECTION I(a).
It is a condition of the right of the St. Louis, San Fran..
cisco and Texas Railway Company to use and enjoy this grant
and privilege that said railway company shall indemnify and
save whole and harmless the City of Fort Worth, a municipal
corporation, from any and all manner of claims for damages,
real or asserted, to person or property, made against the
said City of Fort Worth by reason of the rights and privileges
herein granted.
SECTION 2.
That all ordinances or parts of ordinances in conflict with the pro-
visions of this ordinance are hereby expressly repealed.
SECTION 3.
That this ordinance shall be effective from and after the date of
its passage.
