ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 16-8 OF THE CODE OF
THE CITY OF FORT WORTH (1964) , AS AMENDED, WHICH
SECTION REGULATES THE PLACING OF SOLID WASTE FOR
COLLECTION, SO THAT SAME SHALL NOT REQUIRE REMOVAL
OF PLASTIC OR PAPER BAGS FROM REFUSE CANS PRIOR TO
COLLECTION; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVID-
ING A PENALTY; AND NAMING AN EFFE CT IVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 16-8 of the Code of the City of Fort Worth
(1964) , as amended, be and the same is hereby amended so that
hereafter same shall be and read as follows:
"Sec. 16-8. Same -- Placing for Collection
"Curb/Alley Line Service. If the building,
house, structure or premises from which household
refuse is to be collected and removed is adjacent
to the alley, the owner, occupant, tenant or lessee
of such premises shall place household refuse
and grass clippings in approved plastic or paper
disposable bags at a point adjacent to his alley
on the scheduled pickup day or no earlier than
6:00 P.M., on the day preceding the scheduled
pickup day, but if there is no alley adjacent to
his premises or if the alley has been abandoned
for the purpose of refuse collection, he shall
place household refuse in approved plastic or
paper disposable bags at a point adjacent to the
front curb thereof on the scheduled pickup day or
no earlier than 6:00 P.M., on the day preceding
the scheduled pickup day.
"Collector Carryout Service. If collector
carryout service is selected, then the owner,
occupant, tenant or lessee of the building, house,
structure or premises from which household refuse
is to be collected shall place household refuse in
approved plastic or paper bags at a point adja-
cent to the dwelling place. The plastic or paper
bags shall be tied or crimped securely.
"The individual customer may choose either
of the above options. However, the Sanitation
Superintendent shall have the authority to desig-
nate the location of such placement, taking into
consideration, among other things, convenience
to collection crews, convenience to the customer,
hazardous conditions such as electric wiring,
danger of the collector being bitten by house-
hold pets, etc."
SECTION 2.
That this ordinance shall be cumulative of all provisions
of the Code of the City of Fort Worth (1964) , as amended, and
all other ordinances of the City of Fort Worth, except in
thoare instances where the provisions of this ordinance are in
direct conflict with the provisions of such Code or other or-
dinances, in which instances said conflicting provisions of
such Code or other ordinances are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall
be declared unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sen-
tences, paragraphs and sections of this ordinance, since the
same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 4.
That the violation of any provision of this ordinance or
of the Fort Worth City Code relating to the collection or dis-
posal of garbage and the payment of fees therefor shall be
deemed an offense and punishable by a fine not exceedirlg-
Two Hundred Dollars ($200) , and each violation thereof and
each day there is a failure to comply with the terms of this
ordinance shall be and is hereby deemed to be a distinct and
separate offense and punishable as such.
SE CT ION 5.
That this ordinance shall become effective and be in full
force and effect from and after the date of its passage and
publication as required by law, and it is so ordained.
