ORDINANCE NO. } AN ORDINANCE PROVIDING THAT THE EAST-WEST ALLEY IN BLOCK 10, LAKE PARK PLACE, FROM THE WEST LINES OF LOTS 1 AND 10 EASTWARD TO STONE STREET, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the east-west alley in Block 10, Lake Park Place, an addition to the City of Fort Worth, Tarrant County, Texas, from the west lines of Lots 1 and 10 eastward to Stone Street, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said alley is hereby released and shall re- vert to the adjacent owners of the fee as provided by law, save and except that easements are reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. ROMNSON BILAThe Director of Public Works, City of Fort Worth, with the consent of all W abutting property owners, has requested that the City vacate the east-west alley in Block 10, Lake Park Place, a width of 12 feet and a length of 262 feet from the west lines of Lots 1 and 10 eastward to Stone Street. The subject right-of-way, acquired by dedication, is unimproved. There are existing sanitary sewer, electric and telephone facilities located therein. Granting of this request would permit the property owners within the block to deny access to the rear of their residences therefore abating a nuisance. The reviewing City departments and private utility companies have no objec- tions provided the vacated right-of-way is retained as a utility easement. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating this alley as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right-of- way as recommended by the City Plan Commission.
