AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING
FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 240 ACRES OF LAND,
WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE
PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH,
TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL
BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT
THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVI-
LEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PRO-
VIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR
ORDINANCE IN CONFLICT HEREWITH: PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES
NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY
CLAUSE AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of Fort Worth, Texas,
wherein all interested persons were provided with an opportunity to be heard on
the proposed annexation of the territory hereinafter described, was held at the
City Council Chamber in the Municipal Office Building of Fort Worth, Texas, on
the 26th day of March, 1973, which date is not more than twenty (20) days nor
less than ten (10) days prior to the institution of annexation proceedings; and
WHEREAS, notice of such public hearing was published in a newspaper
having general circulation in the City of Fort Worth, Texas, and in the herein-
after described territory on the 14th day of March, 1973, which date is not more
than twenty (20) days nor less than ten (10) days prior to the date of such
public hearing; and
WHEREAS, the population of the City of Fort Worth, Texas is in excess
of 390,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas, was 233.33
square miles on January 1, 1973; and
WHEREAS, the hereinafter described territory lies within the exclusive
extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory lies adjacent to and
adjoins the City of Fort Worth, Texas; and
WHEREAS, the territory hereinafter described contains approximately
240 acres of land;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following described land and territory, lying adjacent to
and adjoining the City of Fort Worth, Texas, is hereby added to and annexed
to the City of Fort Worth, Texas, and said territory hereinafter described
shall hereafter be included within the boundary limits of the City of Fort
Worth, Texas, and the boundary limits of said City, at the various points
contiguous to the areas hereinafter described, are altered and amended so
as to include said area within the corporate limits of the City of Fort
Worth, Texas, to wit:
BEING a portion of the J. Wilcox Survey No. 36, Abstract No. 1719
and a portion of the J. Wilcox Survey No. 35, Abstract No. 1718, situated
about ten (10) miles Northwesterly from the Courthouse of Tarrant County,
Texas and being more particularly described by metes and bounds as follows:
BEGINNING at a point for corner in the present Fort Worth City limit
line in the Northeasterly right-of-way line of Jacksboro Highway (State Highway
No. 199) 275.2 feet East from the West line of the J. Wilcox Survey No. 36,
Abstract No. 1719.
THENCE along and with the present Fort Worth City limit line as
follows:
THENCE South 89 Degrees - 46 minutes East 2,269.5 feet to a point
for corner.
THENCE South 0 Degrees - 14 Minutes West 40 feet to a point for
corner.
THENCE South 89 Degrees - 46 Minutes East 1,874.5 feet to a point
for comer.
THENCE South 1,311.2 feet to a point for corner in the north line
of the J. Wilcox Survey No. 35, Abstract No. 1718.
THENCE South 6 Degrees - 43 Minutes East 1,094.6 feet to a point
for corner.

THENCE South 8 Degrees - 23 Minutes East 441.2 feet to a point for
corner.
THENCE South 11 Degrees - 09 Minutes East 410.8 feet to a point
for corner.
THENCE South 12 Degrees - 57 Minutes East 765.1 feet to a point
for the Northwest corner of the J. Wilcox Survey No. 34, Abstract No. 1717,
same also being the Northeastcorner of the M. Hunt Survey, Abstract No. 161.
THENCE West, along and with the North line of the M. Hunt Survey,
Abstract No. 161, to a point for corner at its intersection with the North-
easterly right-of-way line of Jacksboro Highway (State Highway No. 199).
THENCE Northwesterly, along and with the Northeasterly right-of-way
line of Jacksboro Highway (State Highway No. 199) to the place of beginning
and containing approximately 240 acres of land.
SECTION 2.
THAT the foregoing-described territory and the area annexed shall
be a part of the City of Fort Worth, Texas, and the property so added hereby
shall bear its pro rata share of the taxes levied by the City of Fort Worth,
Texas, and the inhabitants thereof shall be entitled to all of the rights and
privileges of all the citizens and shall be bound by the acts, ordinances,
resolutions and regulations of the City of Fort Worth, Texas.
SECTION 3.
THAT this ordinance shall and does hereby amend every prior
ordinance in conflict herewith, but as to all other ordinances or sections
of ordinancesu not in direct conflict herewith this ordinance shall be and
is hereby made cumulative.
SECTION 4.
THAT if any section, subsection, clause, sentence, phrase, or word
of this ordinance is for any reason held void or unconstitutional, by a court
of competent jurisdiction, such invalidity shall not affect the validity of
the remaining sections, subsections, clauses, sentences, phrases, or words
except as the same are inseparable from and indispensable to the remaining
portions of the ordinance.

SECTION 5.
THAT this ordinance shall be in full force and effect from and after
the date of its passage on first reading and publication and its passage
on second reading as provided for in Section 40 of Chapter XXVIII of the
Charter of the City of Fort Worth and it is so ordained.

Plan Commission Action
The City Plan Commission at its regular meeting on Wednesday, February 28,
1973, recommended the immediate annexation of a 240 acre tract .of land on
the northeast of Jacksboro Highway in the vicinity of Lakeside, Inc. The
area recommended for annexation is one of the two enclaves adjacent to
Jacksboro Highway which are in Fort Worth's exclusive extraterritorial
jurtsdiction and completely surrounded by Fort Worth city limits. This
enclave is also one of the areas recommended for annexation by the Plan
Commission in May 1969 and again in January 1971,
Basic Position
It ig the basic position of the City of Fort Worth, as expressed in the
"POLICY FOR REVIEW OF ANNEXATION AND DEANNEXATION REQUESTS", that "* * *
land be considered for annexation when its proximity to the city, the rate
growlth of the city and other factors indicate that annexation of the area
would aid the city's growth and development, or when anngpcation is required
to guard against the uncontrolled development not consistent with long-
range needs of the area*
Existing Land Use
Most of the 240 acre tract is vacant and undeveloped. There are automobile
,junk yards, a mobile home park, and some residences adjacent to Jacksboro
Highway.
Proposed Land Use
Gifford Hill Company has proposed a gravel mining operation occupying a portion
of this enclave and has requested the County to surface a gravel road running
north from the Jacksboro Highway and along the west boundary line of the Park
Department Wild Life Refuge. It appears that this would be the haul road for
the proposed gravel mining operation. The Parkand Recreation Department has
been requested to grant an easement.for an 8 inch water line which would be
installed to provide water pumped from Lake Worth to serve the gravel mining.

this request, which is subject to final action by the City Council.
Environmental Considerations
The City Plan Commission deems it necessary that this enclave be annexed
immediately to insure that City ordinances and control be available to prevent
air and water pollution and to require a reasonable restoration of the land
after mining operations are completed. These controls may not be necessary
to insure a compatible level of operations but should be applicable if they

require Zoning Board of Adjustment approval-,- on application and after public
notice and hearing. The Zoning Commission will be requested to consider
appropriate zoning for this area if the Council initiates the annexation
process.
Timetable
If Council were to begin annexation proceedings on March 12, the annexation
could be final on May 14, as shown on the attached timetable.
Recommendation
It is recommended that the City Council:
1) Adopt the recommendation of the City Plan Commission; and
2) Instruct the staff to prepare annexation proceedings for
Council action.
