AN ORDINANCE CLOSING AND VACATING THE TEN FOOT EASEMENT ABUTTING LOTS 1 THROUGH 4 AND 25 THROUGH 28, BLOCK 3, LINWOOD ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the easement ten (10) feet in width and two hun- dred and sixty-five (265) feet in length southward from White Settlement Road abutting Lots 1 through 4 and 25 through 28, Block 3, Linwood Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby extinguished, vacated, closed and permanently abandoned as an easement for public utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Wimberley, owner of all abutting property, has requested that the City vacate the easement 10 feet in width and 265 feet in lenth southward from White Settlement Road abutting Lots 1 through 4 and 25 through 28, Block 3, Linwood Addition as shown on the attached map, The subject right-of-way, acquired by dedication, contains sewer and electrical facilities . City departments and private utility companies have reviewed this request and recommend that subject right-of-way be vacated provided subject ease- ment is removed when abutting properties are replatted and utility easements are provided as needed. A satisfactory replat of the abutting property has been sub- mitted to the City staff. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating subject right-of-way as requested, Recommendation It is recommended that an ordinance be adopted vacating subject right-of--way as recommended by the City Plan Commission.
