AN ORDINANCE AMENDING CHAPTER 27 OF THE FORT
WORTH CITY CODE (1964) AS AMENDED, BY ADDING
A NEW SECTION THERETO, TO BE DESIGNATED AS
SECTION 27-48, PROHIBITING THE CONDUCTING OF
ANY BUSINESS, THE SALE OR OFFERING FOR SALE
OF ANY GOODS OR SERVICES AND THE SOLICITING
OF ANY BUSINESS OR TRADE IN, ON OR UNDER ANY
PUBLIC BUILDINGS OR GROUNDS WITHOUT A LAWFUL
PERMIT, FRANCHISE, CONCESSION OR CONSENT
AGREEMENT FROM THE CITY COUNCIL OR A DULY
AUTHORIZED ADMINISTRATIVE AGENCY OR BOARD
THEREOF; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES
AND PROVISIONS OF THE FORT WORTH CITY CODE
IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Chapter 27 of Fort Worth City Code (1964) , as
amended, is hereby amended, by adding thereto a new Section
designated as Section 27-48, which shall read and be as follows:
Section 27-48 Public Property--Conducting or soliciting
trades on public property without: permit
prohibited
It shall be unlawful to conduct any business,
to sell or offer for sale any goods or services,
and/or to solicit any business or trade in, on or
under any building, grounds or place owned by the
City of Fort Worth or used or occupied by or/on
behalf of the City of Fort worth without a lawful
permit, franchise, concession or consent agreement
issued pursuant to authority granted by the City
Council or a duly authorized administrative agency
or board of the City of Fort Worth.
SECTION 2.
This ordinance shall be cumulative of all prior ordinances
and provisions of the Fort Worth City Code (1964) , as amended,
pertaining to the soliciting or conducting of any trade or business
in or on public places in the City of Fort Worth except in
instances where the provisions of this ordinance are in direct
conflict with the provisions of prior ordinances or the Fort
Worth City Code (1964) , in which instances said conflicting
provisions of such prior ordinances of the Fort Worth City
Code (1964) are hereby repealed, but only to the extent that
such provisions are in direct conflict herewith.
SECTION 3.
If any section, part of a section or provision of any
section of this ordinance shall be held to be void, ineffective
or unconstitutional by a court of competent jurisdiction, the
holding of such section, part of a section or provision of any
section to be void, ineffective or unconstitutional for any
cause whatsoever shall in no way affect the validity of the
remaining sections and provisions of this ordinance, which shall
remain in full force and effect. The City Council would not
have passed any sections, parts of sections or provisions of
any section of this ordinance that were unconstitutional, void
or ineffective if it had known that they were unconstitutional,
viod or ineffective at the time of adopting this ordinance.
SECTION 4.
Any person, firm or corporation violating any of the
provisions of this ordinance shall be fined in any sum not
to exceed Two Hundred Dollars ($200.00) , and each violation
thereof shall constitute a separate offense.

SECTION 5.
This ordinance shall become effective and be in full
force and effect thirty days from and after the date of its
passage and publication as required by law, and it is so
ordained.

Because of the increasing number of individuals, groups and organizations
soliciting City employees in City facilities and/or on City property, it
has become necessary to regulate such activities.
A proposed ordinance has been prepared which provides the following:
"It shall be unlawful to conduct any business, to sell or offer
for sale any goods or services, and/or to solicit any business
or trade in, on or under any building, grounds or place owned
by the City of Fort Worth or used or occupied by or/on behalf of
the City of Fort Worth without a lawful permit, franchise, conces-
sion or consent agreement issued pursuant to authority granted
by the City Council or a duly authorized administrative agency
or board of the City of Fort Worth."
The proposed ordinance provides for a fine not to exceed $200.00 for each
violation occurred by any person, firm or corporation.
Recommendation
It is recommended that the City Council approve the addition to the Code of
the City of Fort Worth, Chapter 27, Section 27-48.
