HomeMy WebLinkAboutResolution 5213-04-2020 A Resolution NO. 5213-04-2020 AUTHORIZE APPLICATION FOR AND AUTHORIZE ACCEPTANCE OF THE GRANT PROJECT FOR THE SEXUAL ASSAULT EVIDENCE TESTING GRANT PROGRAM FROM THE STATE OF TEXAS, OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION AND MAKING ASSURANCES REQUIRED BY THE CRIMINAL JUSTICE DIVISION OF THE GOVERNOR'S OFFICE WHEREAS, the Criminal Justice Division of the Governor's Office (CJD) funds grant projects throughout the state; and WHEREAS, the City Council of the City of Fort Worth finds that it is in the best interest of the citizens of Fort Worth to utilize grant funds from the CJD for Fort Worth Police Department Crime Laboratory Unit for costs associated with the forensic analysis of physical evidence in relation to sexual assault or other sex offenses, including the screening, processing, testing, and/or entering relevant information into CODIS for sexual assault evidence collection kits (SAK) during the Fiscal Year 2021 Grant Cycle; and WHEREAS, the release of the grant funds is contingent upon the completion of specified requirements set by the CJD, including the passage of a Resolution by the City Council containing certain assurances. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS,THAT: 1. The City Council approves the submission of the grant application to the Office of the Governor; 2. The City Council designates the City Manager, through the Assistant City Manager for Police, to apply for, accept, reject, alter or terminate this grant on behalf of the City; and 3. Ratify the application for,and authorize acceptance of,if awarded,the Sexual Assault Evidence Testing Grant Program for Fiscal Year 2021 from the Office of the Governor, Public Safety Office,Criminal Justice Division in the amount of$200,000.00; 2. Authorize the execution of a Grant Agreement with the Office of the Governor, Public Safety Office,Criminal Justice Division; 3.Adopt the attached Resolution for acceptance of grant funds in the amount of$200,000.00 and to make assurances as required by the Sexual Assault Evidence Testing Grant Program;and 4. Adopt attached Appropriation Ordinance. DISCUSSION: The Fort Worth Police Department Crime Laboratory(FWPD-CL)has applied for program funding in the amount of$200,000.00 for costs associated with the forensic analysis of physical evidence in relation to sexual assault or other sex offenses. If awarded,allowable uses of funds are limited to the screening,processing,and/or entering relevant information into Combined DNA Index System for sexual assault evidence collection kits and will pay for: 1)overtime or temporary/contract workers who screen and/or process sexual assault kits,2)contractual services for screening and/or processing of sexual assault kits,3)supplies and equipment used in the screening and/or processing of sexual assault kits,or 4) salaries and benefits for workers who screen and/or process sexual assault kits. FWPD-CL will use the grant funding to outsource backlogged DNA sexual assault kits to a qualified Combined DNA Index System vendor in an effort to reduce the number of sexual assault kit backlogs. Matching funds are not required under the grant.The funding type is reimbursable. Indirect costs are an allowable budget category in the grant.The budget will include indirect costs if applicable. The grant will serve ALL COUNCIL DISTRICTS. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Office of the Governor FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations,Adoption of the Appropriation Ordinance,and receipt of the grant,funds will be deposited to the Grants Operating State Fund. This is a reimbursement grant. The Police Department is responsible for the collection and deposit of funds due to the City if awarded.Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds.
