HomeMy WebLinkAboutOrdinance 18587-05-2009Ordinance No. 18587-05-24fl9 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE LAW ENFORGEMENT OFFICER STANDARDS AND EDUCATION SECTION OF THE SPECIAL TRUST FUND IN THE AMOUNT OF $4,784.54, UPON RECEIPT OF THE 2409 ANNUAL GRANT FROM THE GOMPTROLLER OF PUBLIG ACCOUNTS, FOR THE PURPOSE OF FUNDING THE LAW ENFORCEMENT OFFICER STANDARDS AND EDUCATION TRAINING PROJECT FOR THE CITY MARSHAL'S DIVISION; PROVIDING FOR A SEVERABIUTY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH: AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCfL OF THE CITY OF FORT WORTH, TEXAS: SEGTlON 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2448- 2409 in the Budget of the Gity Manager, there shall also be increased estimated receipts and appropriations in the Law Enforcement Officer Standards and Education section of the Special Trust Fund in the amount of $4.784.54, upon receipt of the 2049 Annual Grant from the Gomptroller of Public Accounts, for the purpose of funding the Law Enforcement Officer Standards and Education Training Project for the City (vlarshal's Division. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance; which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shalt be cumulative of Ordinance No. 18283 and a(I other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to accept a payment in the amount of $4,784.54 from the Law Enforcement Officer Standards and Education account for the City Marshal's Division; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specia! Trust Fund, Law Enforcement Officer Standards and Education Training Project, by $4,784.54 from available funds. DISCUSSION: The Texas Comptroller of Public Accounts is directed by section 1701.157 of the Occupations Code to make annuai allocations from the Law Enforcement Officer Standards and Education {LEOSE) account to qualified Iaw enforcement agencies. The LEOSE payments are to be used as necessary to ensure the continuing education of certain licensed officers or to provide necessary training, as determined by the agency head, to full-time fully paid Iaw enforcement support personnel in the agency. The allocation is derived from the LEOSE account, which is funded through court costs collected in criminal cases. The City Marshal' s Diuisian qualified for an t_EOSE allacation for the 2009 calendar year and has received a payment totaling $4,784.54. The funds will be used to pay for training expenses in the City Marshal' s Division in accordance with Chapter 1701 of the Occupations Code.
