D. 1941, EXCEPT SUCH PROPMY AS mAY BE Empr FROM TAXATION BY THE CONSTITUTION AND LAWS OF THE STATL OF TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. There is hereby levied and shall be collected, as provided by law, an annua-1 direet-apeelal ad val-orem tax for the v�-tr 11741 for the support and maintenance of a free Public Library in the City of Fort Worth, Texas, of three cents (9¢) on every One Hundred Dollar ($100.00) valuation on all ,property, real, p}rso4al and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, on the first day of Jan- uary, A. D. 1941, liable under the lax to taxation and not exempt therefrom by the Constitution and laws of the State of Texas. The Commissioner of Accounts shall, on Feb'`uary 12, 1942, cause to be paid to the General Construction Company for a repaving lion the sum of Two Hundred Twent$-one and 222/100 Dollars ($221.22). SECTION 11,, There is also hereby levied and there shall be oolletted, as pro- vided by lavi, an annual direct special ad valorem tax for the year 1941, for the use and benefit of the Park Fund of the City of Fort Worth, Texas, of nine cents (90) on every One Hundred Dollar ($100.00) valgatioli on e.11 property, real, peradhal and mixed, situated in and all patsendl property owned in the City of Fort 'N'bYth, Texas, on the first day tf January, A. D. 1941, liable under the Is* to taxation and not exempt therefro2L by the Con- stituti6n and laws of the State of Texas, which levy, in the aggregate sum of nine cents (90), as aforesaid, shall be and is hereby apportioned: For Park operation, maintenance, upkeep and to pay maturities and interest on park notes and warrants, 9 cents. The Commissioner of Accounts shall transfer from cur- rent tax collections the sum of $3,311.96 to pay ma- turities and interest on notes and warrants. After this amount has been transferred to Park Interest and Sinking Fund, the remaining current tax collec- tions will revert to the Park General Fund, as well as all delinquent taxes collected for prior years. SECTION III. There is also hereby levied and there shall be collected, as pro- vided by law, an annual direct special ad valorem tax for the year 1941, for the use and benefit of the Recreation Fund of the City of Fort Worth, Texas, of two cents (20) on every One Hundred Dollar ($100.00) valuation on all property, real, personal and mixed, situated in and all personal prop- erty owned in the City of Fort Worth, Texas, on the first day of January, A. D. 1941, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas, which levy, in the aggregate sum of two cents (2¢), as aforesaid, shall be and is hereby apportioned: For Recreation operation, maintenance, upkeep and to pay maturities and interest on Recreation notes and warrants, 2 cents. The Commissioner of Accounts shall transfer from cur- rent tax collections the sum of $3,602.50 to pay ma- turities, interest and set up a Sinking Fund on notes and warrants. After this amount has been transferred to Recreation Interest and Sinking Fund, the remain- ing current tax collections will revert to the Recrea- tion General Fund, as well as all delinquent taxes col- lected for prior years. SECTION IV. That there is also hereby levied and there shall be collected, as provided by law, an annual direct special ad valorem tax for the year 1941, for General Fund operations and for servicing of General Fund obligations outstanding of the said City of Fort Worth, of 1.69 dollars on every One Hun"' d Dollar ($100.00) valuation on all property, real, personal and mixed, situated in and all personal proparty owned in the City of Fort Worth, Texas, on the first day of January, A. D. 1941, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Texas. The Commissioner of Accounts shall pay each week to the Interest and Sinking Fund forty—five per cent (45%) of the current taxes collected for General fjp Fund operations and debt service until $950,943.25 has been paid to the In— terest and Sinking Fund, after which all of said collections will remain in the General Fund. In this way the General Fund will absorb any Interest and Sinking Fund delinquencies and in consideration of which will receive all delinquent tax collections the entire year. That these special tax levies, which are hereinbefore made, to provide for the payment of interest and to create a sinking fund or to discharge and pay principal and interest on any obligations due or owing by the City of Fort Morth, Texas, are not to be taken as in addition to levies for the same purpose in the respective ordinances authorizing and creating such obligations, but the levies hereinbefore made are made pur— suant to and for the purpose of carrying out and complying with the pro- visions of said prior ordinances, and ad valorem taxes herein are levied upon all taxable property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, as assesead, valued and described in the assessment tax rolls and the tax books of the City of Fort Worth, Texas, for the year 1941, and any supplemental assess— ments thereof, as the same have been or shall be presented to the City Coun— cil of the City of Fort 'Forth, Texas, by the Assessor and Collector of Taxes of said City of Fort North, Texas. SECTION VI, That the taxes herein levied and authorized and required to be collected shall be and become due and payable in two equal installments. The first installment, which amount shall be fifty per cent (50%) of the total sum of the taxes due and payable for the current year, shall be due and payable on the first day of October, A. D. 1941, and the second install► ment, which amount shall be the remaining fifty per cent (50%) of the total sum due and payable in taxes for the current year, shall become due and pay- able on the first day of April, A. D. 1942• Y y� SECTION VII. The first installment of taxes required to be paid by virtue of this ordinance for the current year shall become delinquent on the first day of December, A. D. 1941, and the second installment of taxes rewired to be paid by virtue of this ordinance for the current year shall become delinquent on the first day of June, A. D. 1942. SECTION VIII. Should any taxpayer permit his taxes to become delinquent, that is to say, should fail or refuse to pay the first installment, said install- ment being fifty per cent (50%) of the total amount of taxes due for the current year, before the first day of December, A. D. 1941, as above speci- fied, then and in that event, the second Installment shall also ;:..ediutely become due and delinquent and a penalty shall attach to the payment of such taxes at the rate of one per cent (1%) per month, or fraction thereof, for each month thereafter; and should any taxpayer pay the first installment of his taxes as hereinabove provided, but should permit the second install- ment of his taxes to become delinquent, that is to say, should fail or re- fuse to pay said second installment before the first day of June, A. D. 1942, as above specified, then the penalty shall attach to the payment of the second installment at the rate of one per cent (1%) per month, or frac- tion thereof, on each month thereafter. SECTION IX. That said penalty of one per cent (1%) per month shall be added to said taxes in the event the payment thereof should become delinquent as above set forth and said penalty shall attach on the first day of each month thereafter, until the taxes shall have been paid, which penalty shall be and become a part of said taxes and be payable as such; and provided further that in the event of the publication of the delinquent tax lists, or if suit is brought to recover such taxes and penalties and the delineuent taxpayer shall be subject to the payment of said taxes, penalties and costs, and the same shall be and become a lien upon the property of such taxpayer, as prescribed by the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas, the said taxes with penalties and costs shall be and become and they are hereby made a paramount lien to all other liens whatsoever on the property on which said taxes are levied* SECTION X. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sec— tions of this ordinance, which provision shall be, remain and continue to be in full force and effect. SECTION XI. That this ordinance shall take effect and be in full force and effect from and after the date of its passage as provided by law.
